FSSAI LICENSE AND REGISTRATION

Food Safety and Standards Authority of India (FSSAI) is an autonomous body established under the Ministry of Health & Family Welfare, Government of India. The FSSAI has been established under the Food Safety and Standards Act, 2006, which is a consolidating statute related to food safety and regulation in India.

The FSSAI's role in food quality is to ensure safety and providing satisfaction to every customer. Food Safety and Standards Authority of India (FSSAI) deals in providing the controlling procedures for the same. FSSAI issues a 14-digit License number to food business operators who are in compliance with the rules and regulations under the FSS act.

The Food authority regulates and checks for safe food manufacture, storage, Distribution, and Handling practices of Food Business Operators (FBO).FSSAI checks if the Food Business Operators are regulations and standards mentioned in the FSSAI Act, 2006.

FSSAI aims at laying down the scientific standards for articles of food and to regulate the manufacturing, storage, distribution, import, and sale of food.

FSSAI has addressed it compulsory to get the license to overcome the adulteration in the food and poor products.

FSSAI issues three types of License based on the nature of the food business and Turnover of the business:

  1. Basic FSSAI Registration: For turnover of less than Rs.12 lakh.
  2. Central License: For Turnover between Rs.12 Lakh and Rs. 20 Crore.
  3. State License: For Turnover of more than Rs.20 Crore.

FORMS REQUIRED TO APPLY FOR FSSAI LICENSE:

FORM A: This form is required for Basic FSSAI Registration.

FORM B: This Form is required for Central and State License.

Form IX: Form IX is the nomination form that is to be submitted forward with the FSSAI application.

FSSAI dated 18th September 2018, that Form IX is not required where food business is operated by a Proprietorship Firm as Proprietorship is a business enterprise that is owned and controlled by one person who possesses the entire Authority and Responsibility with respect to business.

 

FSSAI REGISTRATION/ LICENSE ELIGIBILITY:

It is difficult for a few Food Business Operators (FBO) to decide what license to go for State or Central.

The Eligibility Criteria has been listed down that helps to determine your kind of business and you can proceed to apply for a license.

 

NO LICENSE, ONLY REGISTRATION IS REQUIRED FOR THE FOLLOWING KIND OF BUSINESS:

The following are the Business having Turnover up to Rs. 12Lakh per annum.

1. Petty Food Business Operators
2. Temporary or fixed stall
3. Hawker – Selling packaged or freshly prepared food by travelling (usually on foot or movable carts) from one location to other location.
4. Vegetable Oil Processing Units
5. Meat Processing
6. Storage – Cold/Refrigerated/with or without Atmospheric Controlled
7. Wholesaler – distribution of food product from the manufacturer to retailer
8. Distributor –  distribution of food product from the original  place of manufacture to a person who makes the final delivery or to the final consumer
9. Supplier – distribution of food product to the consumer as per requirements raised by the consumer.
10. Retailer of food product
11. Marketer – promoter of food product
12. Hotels, Restaurant, and Bars, Club/Canteen, Mid Day Meal Canteens
13. Food Agencies
14. Dhaba
15. The dairy unit including Milk Chilling Units processing Upto 500 Ltrs of Milk per day or upto 2.5 MT of Milk Solids per annum.

 

STATE OR CENTRAL LICENSE IS REQUIRED IN THE FOLLOWING CASES:

5.  Storage – Cold/Refrigerated with Storage Capacity Upto 10,000 MT with Storage Capacity more than  10,000 MT
6. Storage – Atmospheric Controlled + Cold with Storage Capacity Upto 1,000 MT with Storage Capacity more than  1,000 MT

12. Club/Canteen, Dhaba, Mid Day Meal Canteen Having Turnover more than 12 Lacs per Annum NA
13. Caterer, Mid day Meal Caterer Having Turnover upto 20 crore per Annum Having Turnover more than Rs. 20 Crores per annum
14. Food Vending Agencies Having Upto 100 Vending
Machines in only one State/UT
More than 100 Vending Machines and/or located in two or more States/UTs
