What's New for FY 2026-27

Environmental regulation has moved fast in the last eighteen months. Several rules have been amended, new portals have replaced legacy forms, and SEBI has widened the BRSR Core net. The headlines you should be planning around:

• BRSR Core expansion: SEBI has extended BRSR Core reasonable assurance to the top 1,000 listed entities by market capitalisation, up from the top 150 earlier. Assurance on the nine attributes covering 49 KPIs is now part of the annual report cycle.
• EPR digital portal: The Centralised EPR portal under CPCB is now the only route for plastic, e-waste, battery and used-oil obligations. Producers, importers, brand owners and recyclers transact entirely on the portal — paper filings have ended.
• Online emission monitoring: CPCB has tightened the Online Continuous Emission and Effluent Monitoring System (OCEMS) network. Seventeen highly polluting industrial categories must transmit real-time data; missed transmission days are counted as non-compliance.
• Hazardous waste schedule update: Schedule I and II of the Hazardous and Other Wastes Rules have been amended to reclassify several solvents, sludges and recovered metals. Existing authorisations need a category recheck before the next renewal.
• Liquid Waste Rules in draft: Draft Liquid Waste Management Rules now sit alongside Solid Waste Management Rules 2016. Industries discharging treated effluent on land or to drains should expect a new authorisation layer through 2026.
• Climate disclosure linkages: RBI's disclosure framework for climate-related financial risks for regulated entities and SEBI's draft transition-finance taxonomy mean lenders are asking for the same data ESG teams produce. One dataset, multiple disclosures.

Why You Need Coordinated Environmental Advice

Most businesses come in after something breaks — a closure notice, a lender ESG questionnaire, a missed renewal. Coordinated advice prevents that pattern. The businesses that benefit most:

• Multi-site industrials: If you run plants in two or more States, each State Pollution Control Board has its own portal, its own consent fee schedule and its own inspection rhythm. One advisor coordinating across boards beats five local consultants who never reconcile data.
• Listed parents: If you are inside the top 1,000 by market cap, BRSR Core assurance forces a level of data discipline that finance and sustainability teams cannot deliver alone. The advisor builds the controls between operational data and the disclosed KPI.
• PE and VC portfolios: Funds with environmental KPIs in their LP commitments need standardised data across portfolio companies. A single advisor brings comparable disclosures, common targets and a roll-up that LPs accept.
• Acquirers: If you are buying a factory, a mining lease or a real-estate parcel, environmental diligence is not a tick-box. You need a clear gap report, a fix cost, an indemnity recommendation and a closing-condition list — before signing the SPA.
• Sectors with active NGT exposure: Pharma, dyes and intermediates, tanneries, common effluent treatment, mining, sand and stone crushers and construction in CRZ zones face standing NGT scrutiny. Advisory has to include litigation readiness, not just compliance.
• EPR-heavy producers: Consumer goods, electronics, packaging and battery brands have multi-million-unit EPR obligations every year. Target-setting, certificate procurement and audit defence is now a year-round operation.

How It Actually Works

The engagement is built in six stages. The first three set the foundation; the next three keep it running and protect it.

Step 1: Diagnostic and Compliance Audit

The first two to four weeks are spent reading. We pull every existing approval, every monitoring report for the last twenty-four months, every SPCB inspection memo, every EPR certificate purchased and every BRSR field already populated.

The output is a single compliance dashboard — site by site, approval by approval, with validity dates, gap notes and risk rating. You see your environmental position on one screen for the first time.

Step 2: Strategy and Roadmap

With the gaps visible, we sequence the work. Renewals inside ninety days take priority. SPCB notices already on file get a reply schedule. New approvals for planned capex enter the queue with realistic lead times — Environment Clearance alone runs nine to eighteen months at the Expert Appraisal Committee level.

The roadmap is written, dated and shared with the board or audit committee where required.

Step 3: Filing and Renewal Cycle

Each filing has its own choreography. CFE applications need site plans, manufacturing process flow, raw material consumption and pollution control commitments. CFO renewals need actual monitoring data. EPR filings need quantification of products placed on the market and matching certificate procurement. Hazardous Waste authorisations need manifest trails and downstream channel agreements.

Filings are submitted with full backing files preserved, because the SPCB or CPCB inspector who arrives eighteen months later will ask for them.

Step 4: ESG, BRSR and Climate

This stream runs on its own calendar but uses the same operational data. We help finance and sustainability functions build the data pipeline from energy meters, water flow meters, waste manifests and HR records into the BRSR Section A, B and C fields. For BRSR Core attributes, we add audit-trail controls before the assurance provider arrives.

Climate disclosure layers on top — Scope 1, 2 and 3 inventory under the GHG Protocol, scenario analysis for physical and transition risk, and where the board has committed, Science Based Targets initiative alignment.

Step 5: Crisis Response

Show-cause notices, sudden closure orders, inspection adverse findings, accidents and NGT applications are handled on emergency timelines. The first twenty-four hours are about stabilising — drafting a reply, filing for a stay if production is at risk, and aligning the technical fix with the legal response.

Beyond the immediate crisis, we close the underlying gap so the same issue does not return.

Step 6: Quarterly and Annual Review

Every quarter we revisit the dashboard. Renewals coming up, returns due, monitoring exceptions, regulatory changes that affect category or fee. Once a year we do a full reset against the annual report cycle, BRSR disclosures, board reporting and budget plans for the next year.

A Real Example: Mid-Size Pharma Group, Four Plants

Take a pharma group with four formulation plants across Maharashtra, Gujarat and Andhra Pradesh, parent listed and inside the top 1,000 by market capitalisation.

• Approvals in play: Four ECs, eight CFE / CFO pairs, four Hazardous Waste authorisations, EPR for plastic packaging and used batteries, and BRSR Core for the listed parent. More than forty periodic returns and reports across a year.
• Diagnostic finding: Fourteen open items — two CFO renewals due inside ninety days, one SPCB show-cause unanswered for forty days, three EPR shortfalls from FY 2025-26, missing OCEMS calibration certificates at two stacks, and Section C BRSR fields populated without a source audit trail.
• Quarter one work: Closed the show-cause with a technical reply and a stack repair commitment, filed both CFO renewals with current monitoring data, and bought certificate shortfalls on the EPR portal at the prevailing band of around ₹35 per kilogram for category I plastic.
• Quarter two work: Built the BRSR Core data pipeline, ran a dry-run assurance with the appointed firm, fixed two control gaps before reasonable assurance commenced, and submitted the parent's BRSR with all 49 KPIs assured.
• Annual fee outline: Retainer at around ₹6 lakh per month covering ongoing advisory, plus per-filing fees for renewals, plus a BRSR Core engagement at around ₹9 lakh for the year. Crisis-day response covered inside the retainer.

What Stays on Your Plate Each Year

Even after every approval is in place, the year never goes quiet. The repeating obligations are what catches most operating teams off guard.

• Monthly and quarterly returns: Form 4 hazardous waste returns, monthly OCEMS uptime reports, quarterly water cess returns where applicable and monthly EPR transaction reporting under the centralised portal.
• Annual filings: Form 1 hazardous waste annual return by 30 June, Environmental Statement (Form V) by 30 September, EPR annual returns by 30 June and BRSR annexed to the annual report.
• Renewals: CFE typically five-year validity, CFO three to five years depending on the State, Hazardous Waste authorisation five years, EPR registration three years. The calendar tracks renewal application windows, not just expiry.
• Monitoring obligations: Ambient air monitoring, stack monitoring, effluent monitoring and ground-water monitoring — frequency varies by category. NABL-accredited laboratory records are preserved for inspection access.
• BRSR data cycle: Energy, water, waste, emissions and social KPIs collected month on month with controls; annual reasonable assurance for BRSR Core attributes; voluntary limited assurance for the remaining BRSR.
• Board reporting: ESG and compliance status to the Risk Management Committee or Stakeholder Relationship Committee at least quarterly, with a dedicated sustainability section in the annual report.

Where It Goes Wrong

The errors we see across files inherited from elsewhere repeat themselves. Most are correctable, several are expensive when missed.

• Renewal applied late: CFO and EC renewals must be applied four to six months before expiry. Late applications mean the unit operates under expired consent — which is the exact factual basis for an SPCB closure order.
• Wrong EPR category: A producer registered under the wrong category buys certificates that do not discharge the obligation. The audit catches it, the shortfall is back-billed and an environmental compensation can be levied.
• Operating records mismatch: Stated capacity in CFO, monitoring data, returns filed and ledger data must reconcile. SPCB inspectors triangulate these now; mismatched numbers are flagged.
• Show-cause replies drafted in-house: Plant managers writing to SPCBs without legal review create admissions that get used later. A reply is a litigation document — treat it that way.
• BRSR Section C copy-pasted year on year: BRSR Core assurance fails when the underlying records do not exist. Boilerplate disclosures collapse at first sample-testing by the assurance provider.
• Missed NGT timelines: Original applications, appeals and review windows in the Green Tribunal are short — fifteen to thirty days. A missed window costs the substantive right, not just an extension.
• DPCC and SPCB confusion: Delhi (DPCC) operates differently from neighbouring State Boards. NCR clients sometimes file at the wrong board entirely and lose months.
• Hazardous waste manifests: Manifest copies must match transporter records and downstream recycler entries. Mismatches trigger TSDF and recycler audits, which then come back to the generator.

A show-cause reply is a litigation document — every line you sign at the plant becomes evidence in the next NGT case.
