End-to-end cheque dishonour litigation under Section 138 of the Negotiable Instruments Act 1881 โ demand notice, complaint, summary trial, recovery and settlement, with BNS overlay.
A cheque was deposited. The bank returned it โ "insufficient funds", "payment stopped", "account closed", "signature differs", "exceeds arrangement". On paper, that is a financial inconvenience. Under Indian law, since 1988 it is a criminal offence punishable with imprisonment up to two years and a fine up to twice the cheque amount, under Section 138 of the Negotiable Instruments Act 1881. By FY 2026-27, cheque-bounce complaints constitute the single largest category of pending criminal litigation in Indian magistrate courts โ and the framework has been refined by the Bharatiya Nyaya Sanhita 2023 overlay (cheating Sections 318/336 BNS where intent to defraud is shown), the Bharatiya Sakshya Adhiniyam 2023 for electronic evidence, and clarified jurisdictional rules after Dashrath Rupsingh Rathod and the 2015 NI (Amendment) Act.

We also coordinate parallel civil recovery suits under Order XXXVII CPC for liquid documents, and BNS Section 318 cheating prosecutions where a pattern of fraudulent cheque issuance is documented.
The single most decided case on a cheque-bounce file is the thirty-day demand notice. Get it wrong โ wrong recipient, wrong amount, wrong dispatch evidence, missed window โ and the prosecution dies regardless of merit.
Within 30 Days After 15-Day Window Expires โ File Complaint:
Complaint under Section 138 read with Section 142 NI Act before the jurisdictional Magistrate. Beyond this 30-day window, condonation requires sufficient cause to be shown โ granted only sparingly.
The 2015 amendment to the NI Act settled jurisdictional confusion. The complaint can be filed where the payee's bank branch (the branch where the cheque was deposited for collection) is located. For cheques deposited via account-payee channel, this is typically the payee's home branch. This reversed the unworkable Dashrath Rupsingh position that required filing where the drawer's bank was situated. Forum selection now favours the complainant โ but the bank-deposit slip and the branch address must be on record.
On conviction, imprisonment up to two years, or fine up to twice the cheque amount, or both. Settlement at any stage is recognised โ the Supreme Court and High Courts routinely permit compounding under Section 147 NI Act, often with cost. Appeal lies to Sessions Court within 30 days; revision to High Court thereafter.

Section 143 NI Act summary trial run efficiently โ affidavit-evidence, limited cross, focused arguments โ not the meandering full-trial pace that drags 4+ years.
Most Section 138 cases settle. We negotiate with the chargesheet, evidence, and bank memos already on record โ the drawer pays more, faster, when the file is tight.
Order XXXVII CPC summary suit on the cheque as a liquid document, in parallel โ criminal pressure plus civil decree, recovery from both sides.
Where a pattern of fraudulent cheque issuance, account closure or stop-payment is documented, Sections 318/336 BNS cheating prosecution layered on top โ non-bailable, harder to settle on the drawer's terms.
