The Food Safety and Standards Act, 2006 consolidated India's food law into a single statute and created the Food Safety and Standards Authority of India (FSSAI) as the apex regulator. Every Food Business Operator (FBO) โ manufacturer, processor, packager, importer, distributor, wholesaler, retailer, transporter, storage operator, caterer, restaurant, cloud kitchen, hotel, food-truck, e-commerce food seller, and home-baker โ is legally required to obtain an FSSAI Registration or Licence before commencing operations. By 2026, the entire FSSAI lifecycle โ application, modification, renewal, return-filing, hygiene-rating, and inspection-response โ runs through the unified FoSCoS (Food Safety Compliance System) portal at foscos.fssai.gov.in, with state-level and central-level adjudication built in.
FSSAI compliance is structured in three tiers based on turnover and scale. Basic Registration applies to FBOs with annual turnover below โน12 lakh โ petty manufacturers, small retailers, hawkers, itinerant vendors, temporary stalls and small home-based operators. State Licence applies to FBOs with turnover between โน12 lakh and โน20 crore, including small-to-mid manufacturing units, restaurants, hotels (3-star and below), wholesalers and storage operators within prescribed capacity thresholds. Central Licence applies to FBOs with turnover above โน20 crore, large manufacturing units, importers, exporters, e-commerce food platforms, operators in airports / seaports / Defence / Railways, and units with multi-state operations or capacities above the State-licence ceiling. Manufacturing, processing, storage, retail, catering, transport and import are treated as separate kinds of business (KoB) and each location-KoB combination needs its own registration or licence.
Operating without the correct tier โ or with a State Licence where Central is required, or with manufacturing-only when storage is also being done โ is a frequent cause of show-cause notices, product seizures, and prosecution under Sections 31, 48, 50-65 of the FSS Act. We map the right tier at the outset, file cleanly on FoSCoS, build the labelling, return-filing and renewal calendar, and absorb routine renewals so the FBO never operates a single day on a stale licence.
Central Licence (Turnover > โน20 Crore or Special Category):
Large manufacturers, importers, exporters, e-commerce food sellers / aggregators, food businesses in airports / seaports / Defence / Railways, multi-state operators, 5-star hotels. Form B on FoSCoS. Fee โน7,500 per year. Valid 1-5 years. Inspection by Central Designated Officer.
Wrong tier โ Basic held when State or Central required; KoB mismatch โ manufacturing licence held but storage / wholesale not added; product category not endorsed (e.g., licence for biscuits but actually making confectionery); labelling non-compliant; Form D1 return not filed; renewal lapsed; capacity in licence understated versus actual production. Each is a routine notice and a routine โน2-5 lakh exposure. Mapping the full operation correctly at the outset is what keeps the kitchen, factory and warehouse running undisturbed.
