The Trade Licence is one part of a bigger compliance stack. You also need Shop & Establishment registration, and depending on your trade (food, manufacturing, healthcare), you'll need sector-specific licences. Why Trade Licence and Shop & Establishment Registration Matter

• Sealing and Shutdown Risk Without It: Operating without a valid Trade Licence exposes you to immediate sealing of premises. Reinstatement requires penalty + arrears + re-processing fees, costing far more than proactive filing.
• Daily Penalty Exposure — ₹500 to ₹5,000+ per day: Most Municipal Acts impose a per-day or per-month penalty for non-compliance. This becomes a continuous liability — ₹500/day × 365 days = ₹1.8L+ in a year. Renewal costs ₹2,500–₹7,999; non-renewal costs 10× more in fines.
• Labour Inspector Visits — Fines and Disputes: Without Shop & Establishment registration, a labour inspector can issue Show-Cause notices, levy penalties for illegal working hours, employee count, or leave violations, and de-register your business. Both licences together proof your compliance.

How It Actually Works

The process is sequential but parallel in parts. We start with classification and registration, then move to Municipal licensing and inspections. Here's what actually happens:

Step 1: Trade Classification & Licence Stack Mapping (1–2 working days)

We classify your trade against the State's Shops Act schedule and the Municipal Act's list of trades. Step 3: Municipal Trade Licence Application (5–10 working days)

We upload the application to your city's Municipal Corporation portal. We attach: PAN, Aadhaar, S&E certificate, property tax receipt, occupation certificate, society NOC (if applicable), and fire NOC (if area/capacity triggers it). Most applications are auto-approved if documents are complete. You pay the licence fee online; the portal issues a provisional certificate same-day. Final licence arrives within 10 working days.

Step 4: Site Inspections (Where Required, 7–15 working days)

For food, eating houses, clinics, and polluting trades, the ULB schedules an inspection. The health officer, sanitary inspector, fire officer, or pollution officer visits the premises to verify fire exits, space, equipment, and hygiene. We accompany you or send a brief on your behalf. Most inspections pass without issues if premises are ready. Any defect is flagged; you get 3–7 days to fix and request re-inspection.

Step 5: Trade-Specific Licences (Parallel Track, 15–60 days per licence)

Depending on your trade: FSSAI (for food), Eating House (police, for restaurants), Pollution NOC (for manufacturing/kitchen), Drug Licence (for pharmacy), Clinical Establishment (for clinics/hospitals), Factory Registration (for manufacturing). Each has its own application, inspection, and fee. We file all applicable licences in parallel to compress timelines. Trade Licence typically arrives first (10 days); specialized licences follow in 20–60 days.

Step 6: Renewal Calendar & Compliance (Annual and Beyond)

Once all licences are live, we set up a renewal calendar with reminder triggers 60 days, 30 days, and 15 days before expiry. Trade Licence renews annually (April–March). • Trade-Specific Licence Renewals: Each has its own renewal date and fee. FSSAI renews annually; Eating House and Pollution typically renew annually. Renewal is a repeat of the filing and inspection process. We track all dates and trigger applications 30 days before expiry.
• Property Tax Proof (Annual or Biennial): Most ULBs require a property tax receipt within the last 12 months as proof of premises legitimacy. Ensure property tax is paid on time; it's often listed in renewal checklists.

Common Mistakes That Lead to Sealing, Penalties, and Legal Issues

• Filing Only the Trade Licence, Ignoring Shop & Establishment: Trade Licence alone doesn't satisfy labour law. The absence of S&E makes the business technically 'illegal' from an employment standpoint. A labour inspector can de-register and levy penalties. Both licences must exist in parallel.
• Forgetting Eating House and FSSAI for Food Businesses: A restaurant with only Trade Licence is vulnerable to health-department raids. FSSAI non-compliance results in closure for 1–3 months, brand damage, and ₹5,000–₹50,000 fines.
• Ignoring Pollution Clearance for Manufacturing, Kitchens, Generators: Any trade with emissions needs Pollution NOC. The Pollution Control Board can seize equipment and levy ₹10,000–₹100,000+ fines. This is the most common sealing trigger after non-renewal.
• Letting Shop & Establishment Expire Without Renewal: S&E renewal is easy (5 working days, minimal cost) but easily forgotten. Upon expiry, a labour inspector can issue prosecution notices and fines of ₹10,000–₹50,000+.
• Missing the Trade Licence Renewal Date: Renewal applications open 30–45 days before expiry. Many owners don't notice until the licence is already expired. Late renewal incurs penalty @ 1–2% of licence fee per month. Beyond 6 months, the licence is cancelled; fresh application as a 'defaulter' is costly.
• Not Updating Trade Category or Premises Details: If you change the trade or move premises, the licence must be updated or reissued. Operating under an outdated licence is non-compliance; the ULB can issue Show-Cause. New licence: ₹2,500–₹7,999 (full fee).
