Startup India is the Government of India's flagship Action Plan administered by the Department for Promotion of Industry and Internal Trade (DPIIT), under which an eligible early-stage business โ incorporated as a Private Limited Company, Limited Liability Partnership (LLP) or Registered Partnership โ can secure formal DPIIT recognition, after which it becomes eligible for a layered set of tax, regulatory and ecosystem benefits that materially improve runway, valuation, and access. By 2026, the Startup India recognition has matured from a marketing label into a genuinely material commercial instrument: a recognised startup can claim the Section 80-IAC three-year income-tax holiday (3 years out of 10 from incorporation), the Section 56(2)(viib) angel-tax exemption (no tax on premium received above fair market value, subject to conditions), access the Startup India Seed Fund Scheme (SISFS), the Fund of Funds for Startups (FFS) via SIDBI, fast-track patent and trademark filings under the IPR scheme, public-procurement preferences (relaxed prior-experience, EMD waivers) on the GeM portal, and self-certification under nine labour and three environmental laws.
Eligibility is precisely defined. The entity must be (i) incorporated as a Pvt Ltd, LLP or Partnership; (ii) not older than 10 years from incorporation; (iii) have an annual turnover not exceeding โน100 crore in any financial year since incorporation; (iv) be working towards innovation, development or improvement of products / processes / services, or a scalable business model with high potential of employment generation or wealth creation; and (v) not be formed by splitting up or reconstruction of an existing business. The recognition application is filed online on the Startup India portal with the Certificate of Incorporation, brief, pitch deck, and a short narrative establishing innovation / scalability. DPIIT recognition is the gateway; the substantive tax benefits โ Section 80-IAC and Section 56(2)(viib) โ require separate, additional applications with the Inter-Ministerial Board (IMB) and the CBDT respectively.

We position the application around the unique product / process / service, the technology or business-model innovation, the addressable-market scale, the employment / wealth-creation projection, and the IP backbone. The narrative is paired with the pitch deck, founder profiles, prototype / product evidence, customer / pilot evidence, and capital-raise plan. For Section 80-IAC, the IMB application is filed separately with audited or projected financials, business plan, and a pre-emptive response to the standard IMB queries โ substituting a generic checklist with a tailored application materially raises the approval probability.
