An examination report is not a refusal โ it is the Registrar's first opinion that your mark, as filed, has issues. By 2026, somewhere between 70% and 85% of trademark applications filed in India receive an examination report citing one or both of two sections โ Section 9 (absolute grounds โ descriptive, generic, non-distinctive) or Section 11 (relative grounds โ similar to an earlier mark). The good news: the majority of well-drafted replies succeed and the application moves to journal publication. The bad news: a poorly drafted reply, or worse, a missed deadline, abandons the application and forfeits the filing fee, the priority date, and 6-12 months of waiting.
The framework is Section 18 of the Trade Marks Act 1999 read with Rule 33 of the Trade Marks Rules 2017. The Registrar examines the application, issues an examination report, and the applicant must file a written response on Form TM-O within 30 days of receipt of the examination report (extendable in limited circumstances). If the Registrar is satisfied, the application proceeds to journal publication. If not, a show-cause hearing is fixed before a senior Examiner / Registrar; oral and written submissions are made; an order is passed accepting, accepting with conditions, or refusing the application. A refusal can be appealed to the High Court.
