Trademark Objection Reply

An examination report is not a refusal — it is the Registrar's first opinion that your mark, as filed, has issues. By 2026, somewhere between 70% and 85% of trademark applications filed in India receive an examination report citing one or both of two sections — Section 9 (absolute grounds — descriptive, generic, non-distinctive) or Section 11 (relative grounds — similar to an earlier mark). The good news: the majority of well-drafted replies succeed and the application moves to journal publication. The bad news: a poorly drafted reply, or worse, a missed deadline, abandons the application and forfeits the filing fee, the priority date, and 6-12 months of waiting.

The framework is Section 18 of the Trade Marks Act 1999 read with Rule 33 of the Trade Marks Rules 2017. The Registrar examines the application, issues an examination report, and the applicant must file a written response on Form TM-O within 30 days of receipt of the examination report (extendable in limited circumstances). If the Registrar is satisfied, the application proceeds to journal publication. If not, a show-cause hearing is fixed before a senior Examiner / Registrar; oral and written submissions are made; an order is passed accepting, accepting with conditions, or refusing the application. A refusal can be appealed to the High Court.

What a Real Objection Reply Contains

• Section 9 — Distinctiveness Reply:: If the objection is descriptive / generic / non-distinctive, the reply must establish acquired distinctiveness through use — invoices, advertising spend, social media reach, sales geography, awards, third-party recognition, surveys. Inherent distinctiveness arguments — coined mark, arbitrary mark, suggestive mark — are also pleaded with case law (ITC v. Nestle, Cadila Healthcare v. Cadila Pharmaceuticals, etc.).

• Section 11 — Similarity Reply:: If the objection cites a prior similar mark, the reply distinguishes on goods / services (different class, different consumers), trade channels, mark structure (visual / phonetic / conceptual differences), market coexistence, consent letter from the prior-mark owner, or attacks the prior mark's vulnerability (non-use, abandoned, removed).

• Evidence of Use & Distinctiveness:: Affidavit of use; sales invoices (year-wise, geography-wise); advertising and marketing spend; social media analytics; press coverage; awards; third-party endorsements; consumer surveys (where warranted).

• Specification Amendment:: Where the objection is to the breadth of goods / services description, a narrowed specification is offered to align with actual use and remove conflict.

• Consent Letter / Coexistence Agreement:: Where the cited prior mark is owned by a related entity or a non-conflicting business, a consent letter or coexistence agreement is obtained and submitted.

• Show-Cause Hearing Representation:: Where a hearing is fixed, written submissions are filed in advance; oral arguments are made before the Registrar; case-law is cited; an order is awaited.

The Most Common Mistakes That Lose the Reply

Filing a generic boilerplate reply that does not address the specific cited prior marks or distinctiveness grounds. Missing the 30-day deadline and seeking extension on weak grounds. Submitting evidence without an affidavit. Not annexing the cited prior-mark search to demonstrate distinguishing features. Not appearing at the show-cause hearing — automatic refusal. Filing the reply on the wrong form. Each of these is preventable; we close all of them as part of the engagement.
