Trademark Objection Reply

A trademark objection is not a rejection. It is the Registrar telling you, in writing, what part of your application looks weak under the statute and inviting you to defend it. Most Indian trademark applications attract at least one objection — by some estimates well over half — and the difference between a registration and an abandonment is almost always the quality of the reply. The objection arrives as the Examination Report under Section 18 of the Trade Marks Act 1999, issued by the Examiner of Trade Marks 1-3 months after filing, and it gives the applicant 30 days from the date of receipt to file a reply on Form TM-O. Miss the 30 days and the application is treated as abandoned under Rule 33 of the Trade Marks Rules 2017. File a careless reply and the matter heads to a show-cause hearing where the burden is heavier and the chance of success lower.

Two statutory grounds drive the vast majority of examination reports. Section 9 — absolute grounds — refuses marks that are descriptive of the goods or services, generic, customary in trade, non-distinctive, deceptive, or contrary to public order. The defect is in the mark itself, and the answer must show distinctiveness — either inherent or acquired through use. Section 11 — relative grounds — refuses marks that are identical or confusingly similar to earlier registered or pending marks for identical or similar goods or services, or that dilute a well-known mark. The defect is in the conflict, and the answer must show dissimilarity, distinct consumer base, consent or coexistence. A real reply on Form TM-O distinguishes the two grounds and answers each with the appropriate weapon — case law, distinctiveness evidence, prior-use proof, and where required disclaimers, limitations, or amendment of the specification.

How a Real Form TM-O Reply Is Built

• Examination Report Decoded:: Each objection in the report is mapped to the exact sub-clause of Section 9 or Section 11; the cited prior marks are downloaded; the Examiner's reasoning is reconstructed from the file.

• Section 9 Reply — Distinctiveness:: Argument that the mark is inherently distinctive (suggestive rather than descriptive); failing which, evidence of acquired distinctiveness — sales figures, advertising spend, market share, consumer recognition surveys, media coverage, awards and accolades — to invoke the proviso to Section 9(1).

• Section 11 Reply — Prior-Mark Distinguishing:: Goods or services dissimilarity argued (different Nice classes, different consumer base, different trade channels); mark dissimilarity argued (visual, phonetic, conceptual differences); consent letter or coexistence agreement from the cited prior owner where commercially possible; honest concurrent use under Section 12 where applicable.

• Specification Amendment:: Where the cited prior mark is in a narrow specification, the applicant's specification can be amended to carve around the conflict — preserving registration in the commercially relevant scope.

• Disclaimer / Limitation Strategy:: Disclaimer of exclusive right over a non-distinctive element under Section 17; limitation to a specific colour combination, region or trade channel where it secures registration without commercial loss.

• Show-Cause Hearing:: If the written reply is not accepted, the Registrar lists a hearing; counsel attends, files written submissions, cites recent IPAB / High Court decisions, and argues acceptance; written hearing notes filed within prescribed time.

• Post-Hearing Appeal:: If the Registrar still refuses registration, an appeal lies before the Intellectual Property Division of the relevant High Court (after IPAB abolition by the Tribunals Reforms Act, 2021); review or writ remedies considered where appropriate.

Why Late and Lazy Replies Fail

The 30-day clock from receipt of the report is unforgiving — and 'receipt' for an electronic report means the day it is uploaded to the IP India portal, not the day you discovered it. A boilerplate reply that does not engage with the specific cited marks or sub-clauses cited by the Examiner reads as form-filling rather than advocacy and is almost always insufficient at the show-cause stage.
