A trademark objection is not a rejection. It is the Registrar telling you, in writing, what part of your application looks weak under the statute and inviting you to defend it. Most Indian trademark applications attract at least one objection โ by some estimates well over half โ and the difference between a registration and an abandonment is almost always the quality of the reply. The objection arrives as the Examination Report under Section 18 of the Trade Marks Act 1999, issued by the Examiner of Trade Marks 1-3 months after filing, and it gives the applicant 30 days from the date of receipt to file a reply on Form TM-O. Miss the 30 days and the application is treated as abandoned under Rule 33 of the Trade Marks Rules 2017. File a careless reply and the matter heads to a show-cause hearing where the burden is heavier and the chance of success lower.
Two statutory grounds drive the vast majority of examination reports. Section 9 โ absolute grounds โ refuses marks that are descriptive of the goods or services, generic, customary in trade, non-distinctive, deceptive, or contrary to public order. The defect is in the mark itself, and the answer must show distinctiveness โ either inherent or acquired through use. Section 11 โ relative grounds โ refuses marks that are identical or confusingly similar to earlier registered or pending marks for identical or similar goods or services, or that dilute a well-known mark. The defect is in the conflict, and the answer must show dissimilarity, distinct consumer base, consent or coexistence. A real reply on Form TM-O distinguishes the two grounds and answers each with the appropriate weapon โ case law, distinctiveness evidence, prior-use proof, and where required disclaimers, limitations, or amendment of the specification.

The 30-day clock from receipt of the report is unforgiving โ and 'receipt' for an electronic report means the day it is uploaded to the IP India portal, not the day you discovered it. A boilerplate reply that does not engage with the specific cited marks or sub-clauses cited by the Examiner reads as form-filling rather than advocacy and is almost always insufficient at the show-cause stage. We treat the Form TM-O reply as a piece of written advocacy, not a checkbox.
