Pollution NOC (Consent from SPCB)

If you are setting up a factory, warehouse with a DG set, hotel, hospital, food processing unit, or even a large IT office with effluent or emissions, the State Pollution Control Board (SPCB) wants to hear from you before you pour the first slab of concrete. The approval is called Pollution NOC, and it comes in two flavours: Consent for Establishment (CFE) before construction, and Consent for Operation (CFO) before you switch on the machines.

Get the category wrong and you either get rejected or end up complying with conditions written for a far heavier polluter. Skip the CFE and you are looking at closure notices the day an inspector walks in. What's New for FY 2026-27

The consent regime is one of the most actively reformed compliance frameworks in India. Here is what shifted and what you should plan for.

• Ease of compliance push: CPCB has continued nudging State boards to auto-renew White category and grant longer validity for Green category units with clean track records. Several States now offer up to 15-year CFO for non-polluting Green units.
• Single-window portals: Most SPCBs are now integrated with the Parivesh 2.0 single-window environment portal for EC, CFE, CFO and authorisations under Hazardous, E-Waste, and Plastic Waste Rules. Common login, common dashboard.
• Self-certification expansion: White category units in most States get auto-acknowledged on submission, without a manual approval cycle. Documentation discipline still matters because random audits happen.
• Revised Pollution Index: CPCB's updated classification has reclassified several activities — small biscuit bakeries, certain printing presses, and selected solvent-free manufacturers have moved from Orange to Green. Re-check your category before filing.
• CEMS and CEQMS: Continuous Emission and Effluent Quality Monitoring Systems with live data feed to SPCB and CPCB servers are now mandatory for all 17 highly polluting industries and most Red category units.
• E-waste and Plastic EPR integration: Producer / importer / brand owner registrations on the CPCB EPR portal are now cross-checked at CFO renewal for relevant sectors.

Why You Cannot Treat This as a Tick-Box Filing

Most pollution consent rejections are not because of pollution. They are because the application told a different story than the site.

• Wrong category locks you in: If you file as Green when the activity is actually Orange, the SPCB will either reject or grant consent with Orange-grade conditions you did not budget for.
• CFE conditions become CFO conditions: Whatever you commit in CFE — ETP capacity, stack height, ambient monitoring, green belt area — is checked at CFO inspection. Over-commit and you build infrastructure you didn't need; under-commit and you fail inspection.
• Bank loan and subsidy gateway: Term loans, MSME subsidies, capital subsidy schemes, and SIDBI/MUDRA top-ups for manufacturing units almost always ask for CFE before disbursal of construction tranches.
• GST and IEC follow-through: Customs and DGFT now reference SPCB consent for several import categories. Without a valid CFO, certain BIS, FSSAI, and Drugs Licence renewals stall.
• Closure orders are real: An SPCB closure order disconnects electricity through the DISCOM. Coming back from a closure adds weeks of revenue loss plus compounding fees.
• Insurance and ESG reporting: BRSR-reporting companies need vendor SPCB compliance proof. Buyers in apparel, auto-component, and food chains audit consent status quarterly.

How It Actually Works

Here is the full lifecycle from site selection to renewal — what we do at each stage and what the SPCB looks at.

Step 1: Categorisation and Document Audit (3-5 days)

We start by mapping your process to the CPCB's updated sectoral classification. The right category depends on raw materials, products, fuel, water consumption, effluent generation, air emissions, and solid waste — not just the industry name on your GST certificate.

We then audit your documents: layout, process flow, mass balance, ETP / STP / APC design, stack heights, and hazardous storage. Gaps get flagged and fixed before filing rather than after a query letter arrives.

Step 2: CFE Application Filing (5-10 days)

Filing happens on the State SPCB's online portal — MPCB MoEFCC integration, KSPCB Parivesh, DPCC Online Consent Management, GPCB XGN, and so on. We attach layout, project description, design drawings, supporting NOCs, and pay fees online.

Fee structure depends on the gross fixed assets (excluding land), with separate slabs for Water Act and Air Act consents. We compute and challan it correctly the first time.

Step 3: Query Resolution and CFE Issue (30-60 days)

SPCB regional officers typically raise one or two rounds of queries — on ETP design, ambient air monitoring, fuel choice, or green belt percentage. We respond with technical clarifications, drawing revisions, and undertakings.

A site visit happens for Red and most Orange category cases. The CFE is then issued with conditions. We walk you through every condition so nothing surprises you at CFO stage.

Step 4: Construction and Commissioning

Construction proceeds in line with CFE conditions. Effluent Treatment Plant, Sewage Treatment Plant, Air Pollution Control devices, stack, online monitoring sensors, and hazardous waste storage shed are built and commissioned.

We help prepare the commissioning report, the trial run data, and the laboratory analysis from a NABL-accredited lab — these are the backbone of the CFO application.

Step 5: CFO Application and Site Inspection (45-90 days)

CFO is filed after trial production. SPCB schedules a site inspection, takes samples of treated effluent and stack emissions, and verifies the build against the CFE.

Where parameters meet norms, CFO is issued with operating conditions, monitoring frequency, and reporting obligations. Where any parameter is off, a short corrective period is given before re-sampling.

Step 6: Ongoing Compliance and Renewal

CEMS and CEQMS data flows continuously to SPCB and CPCB. Monthly returns, half-yearly Environmental Statements (Form V) for Red and Orange units, and hazardous waste manifests are filed on time.

Renewal is filed 120 days before CFO expiry. A delayed renewal application is treated as operations without consent — the same as not having a CFO at all.

A Real Example: A 4-Unit Pharma Formulation Plant in Gujarat

A pharma formulations company set up a tablet, capsule, syrup, and ointment facility on a 4,000 sq.m plot in Sanand. Investment in plant and machinery was ₹38 crore. Here is how the consent timeline played out.

• Category: Orange (Pharma formulation without API synthesis). Pollution Index in the Orange band.
• CFE fee paid: ₹3.85 lakh combined for Water Act and Air Act, computed on gross fixed assets net of land.
• CFE timeline: Filed in week 2, GPCB site visit in week 5, queries on ETP design and solvent storage cleared in week 7, CFE issued in week 9.
• Construction: Eleven months, including a 25 KLD ETP with MEE backup, scrubbers on dust collectors, and a 30-metre stack on the boiler.
• CFO filed: Two months after commissioning, with NABL lab reports for effluent, stack, ambient air, and noise.
• CFO issued: Day 73 after filing, valid for 5 years with online CEQMS reporting and quarterly hazardous waste manifests.

Total cost across consultants, fees, and lab testing was under 0.3% of project cost — small change against the risk of a closure order on a ₹38 crore facility.

Ongoing Compliance After CFO Is Issued

Getting the consent is the start. Keeping it clean is what avoids show-cause notices and protects renewal.

• CEMS / CEQMS uptime: Live monitoring data must flow to SPCB and CPCB servers with 85%-plus uptime. Sensor downtime triggers automatic alerts.
• Monthly returns: Effluent quantity, emission data, fuel consumption, and hazardous waste generation are filed monthly through the SPCB portal.
• Form V Environmental Statement: Red and Orange units file Form V annually by 30 September for the preceding financial year.
• Hazardous waste authorisation: Separate authorisation under Hazardous and Other Wastes Rules 2016, with manifests for every shipment to a TSDF or co-processor.
• Plastic, E-Waste, and Battery EPR: Producers, importers, and brand owners register on CPCB's EPR portal and meet annual recycling targets.
• Surprise inspections: SPCB officers may inspect any time. Maintain a consent file with the latest CFO, condition-wise compliance status, lab reports, and CEMS logs ready for inspection.
• Pre-renewal audit: Six months before CFO expiry, we run a paper and field audit so the renewal application goes in clean.

A consent is only as strong as the file you can show an inspector in 15 minutes. Build the file from day one — do not assemble it after the show-cause arrives.

Where It Goes Wrong

These are the mistakes that turn a routine consent into a multi-year fight with the regional office.

• Starting construction before CFE: The single most expensive mistake. SPCB issues a stop-work and compounding notice. Some States insist on full demolition of unauthorised portions.
• Filing under a milder category: Inspectors check actual raw materials and effluent. A White or Green claim that fails to match the site is treated as misrepresentation.
• Undersized ETP or APC: Designs based on minimum flow rather than peak flow fail at CFO sampling. Re-design after construction is far more expensive than getting it right upfront.
• Ignoring stack height norms: Each State has minimum stack height formulas based on fuel and SOx load. Short stacks fail air quality modelling and inspection.
• Letting CFO lapse: Operating one day beyond CFO expiry is operations without consent. Renewal must reach SPCB at least 120 days before expiry.
• Missing Form V or returns: Non-filing of half-yearly and annual returns is a standalone offence under the Water and Air Acts and a renewal blocker.
• No NABL lab reports: SPCBs accept only NABL-accredited or SPCB-empanelled lab reports. Reports from non-accredited labs are returned and the timeline restarts.
• Treating EC and CFE as the same: EC under EIA Notification 2006 is separate from CFE. Category A and many Category B projects need EC first, then CFE.
