Environmental Impact Assessment (EIA)

If your project needs an Environmental Clearance (EC) before it breaks ground, the Environmental Impact Assessment is the mandatory gateway — and it is not a box-ticking exercise. Under the EIA Notification 2006 (S.O. 1533(E)) and the Environment Protection Act 1986, projects from thermal power plants and mines to highways, ports, and large real estate must demonstrate environmental acceptability before any construction or expansion begins. Skipping or shortcutting this process carries criminal liability under Section 15 of EP Act 1986.

End-to-end, a Category A EIA realistically takes 12 to 24 months. The binding constraint is four-season ambient air monitoring — you cannot compress it without regulatory risk. What you can control is how well your Form 1, Terms of Reference, baseline studies, EIA Report, and public hearing are prepared. Poor handling at any one stage creates cascading delays that are expensive to recover from.

What's New for FY 2026-27

Several procedural and substantive changes have taken effect through 2025-26 that directly affect how EIA applications are processed and how post-EC compliance is monitored.

• PARIVESH 2.0 Phase III: Auto-generated Standard ToR modules are live for 12 project categories, cutting ToR review time by an estimated 30–45 days for straightforward Category B1 applications.
• Half-yearly compliance enforcement: MoEF&CC has circular-mandated stricter scrutiny of six-monthly compliance reports from 2025 — late or incomplete submissions now trigger automatic show-cause notices to the project proponent.
• Revised general EC conditions: Updated conditions tighten groundwater extraction limits, set a 100 m buffer for waterbodies near industrial projects, and mandate real-time CAAQMS (Continuous Ambient Air Quality Monitoring Stations) for Category A projects.
• Cumulative impact as standard: EAC now routinely requires cumulative impact assessments for projects sharing a basin or airshed with other facilities — standalone EIA reports without this analysis face additional rounds of clarification.
• Hybrid public hearings: Maharashtra, Gujarat, Karnataka, and Tamil Nadu allow hybrid in-person plus video public hearing proceedings; the mandatory 30-day pre-hearing notice window still applies in full.

Who Needs Environmental Clearance

• Mining and quarrying: Coal, iron ore, bauxite, limestone, sand, and all scheduled minerals above threshold area — EC is required before lease execution, not just before operations start.
• Power generation: Coal, gas, and nuclear plants above threshold capacity are Category A; hydro projects of 25 MW or more and large renewable parks also require EC; installed capacity determines Category A vs B1.
• Industrial manufacturing: Cement at 1 MTPA clinker or above, petrochemicals, bulk chemicals, pharma API, paper and pulp — capacity thresholds in the EIA Schedule fix the category and the appraisal authority.
• Infrastructure and urban projects: Highways of 100 km or more, ports with annual capacity of 5 MTPA or more, airports, industrial areas of 500 ha or more, and construction with built-up area of 1.5 lakh sq m or more all need EC.
• Expansion beyond EC limits: Any increase in production, throughput, or footprint beyond EC-approved parameters triggers either an amendment EC or a fresh EC — the regulator determines which track applies.
• River valley and coastal projects: Dams, barrages, irrigation systems, and coastal industrial facilities need EC alongside separate Forest or CRZ clearances, both managed concurrently on PARIVESH 2.0.

How It Actually Works

The EIA process under EIA Notification 2006 follows a defined sequence. There is no legal shortcut, but rigorous preparation at each gate avoids the back-and-forth that stretches timelines unnecessarily.

Step 1: Pre-Feasibility and Form 1 (1–2 months)

Your starting point is a project description covering location, capacity, technology, and alternatives analysis. Form 1 (or Form 1A for construction projects) is submitted on PARIVESH 2.0. This step fixes your Category — A, B1, or B2 — which determines your appraisal authority and whether a full EIA is required at all. A misclassification found later means re-filing under the correct authority and losing all elapsed time.

Step 2: Terms of Reference (ToR) — 3–6 months

EAC or SEAC reviews Form 1 and issues project-specific ToR — the defined scope your baseline studies and EIA Report must cover. Standard ToR modules on PARIVESH 2.0 now accelerate this for 12 project categories. ToR is valid for three years; your baseline studies must be completed within this window or you apply for an extension before it lapses.

Step 3: Baseline Studies — the Long Lead (3–12 months)

Ambient air quality monitoring requires four full seasons of data from a minimum of four NABL-accredited monitoring stations. Groundwater and surface water quality, soil, ecology — flora, fauna, and biodiversity — and socio-economic surveys run concurrently. Specialist studies such as seismic hazard, traffic impact, hydrology, and CRZ delineation are added per your ToR. You cannot rush this phase: lab accreditation windows and seasonal monitoring cycles are fixed by science, not by your project schedule.

Step 4: EIA Report Preparation (1–2 months)

Your MoEF-accredited EIA Consultant compiles the full EIA Report against your ToR. Chapters cover project description, alternatives, baseline environment, impact prediction, mitigation measures, Environmental Management Plan (EMP), Risk Assessment, and Disaster Management Plan. The report and Form 2 are submitted on PARIVESH 2.0. The quality of this document directly determines how many clarification rounds follow at appraisal.

Step 5: Public Hearing (1–2 months from notice)

SPCB publishes a 30-day public notice in local newspapers and online. The hearing is held in the project-affected village or district headquarters, chaired by the District Magistrate. Local residents, gram panchayats, and civil society organisations may raise objections on record. SPCB compiles the Public Hearing Report, which becomes a mandatory annexure to your EAC or SEAC submission.

Step 6: EAC/SEAC Appraisal and EC Issuance (3–9 months)

The committee reviews your EIA Report, baseline data, and Public Hearing Report together. Written clarifications and a formal presentation may both be required. After satisfactory review, the committee recommends conditions and EC is issued by MoEF&CC for Category A or SEIAA for Category B. EC validity is typically 5–10 years depending on project type. No construction beyond EC scope is permitted without an amendment EC in place.

A Real Timeline: Cement Plant Expansion in Chhattisgarh

A cement manufacturer sought to expand clinker production from 2 MTPA to 3.5 MTPA — Category A under the EIA Schedule. Here is how the clock actually ran.

• Months 1–2: Form 1 submitted on PARIVESH 2.0; Category A confirmed; pre-feasibility report and limestone quarry alternatives analysis appended.
• Months 3–8: ToR issued by EAC after one round of written clarification; standard module applied with project-specific additions for groundwater drawdown and cumulative dust impact from an adjacent cluster.
• Months 4–15: Four-season air monitoring at six stations; groundwater and surface water survey across a 10 km radius; ecology study extended due to a protected area 8 km away; socio-economic survey across 15 project-affected villages.
• Months 16–19: EIA Report compiled at approximately 1,200 pages including annexures; EMP budgeted at ₹42 crore capital environment expenditure; public hearing conducted across two talukas with 340 attendees and 28 written submissions.
• Months 20–28: EAC review across three committee meetings; four rounds of written clarification on cumulative PM10 loading; conditions finalised; EC granted by MoEF&CC with 34 specific conditions; construction commenced in month 30.

Total elapsed time: 28 months. The binding constraints were the four-season monitoring cycle and two additional EAC rounds needed to resolve cumulative impact questions from the adjacent cement cluster. Pre-submission cumulative analysis would realistically have saved 3–4 months.

After the EC: What Compliance Looks Like

Getting the EC is the beginning of your compliance obligation, not the end. EC conditions run for the full project life — construction, commissioning, operation, and closure.

• Half-yearly compliance reports: Submitted on PARIVESH 2.0 every six months, covering all EC conditions, monitoring data, EMP implementation status, and CSR expenditure. Late filings now trigger automatic show-cause under 2025 MoEF circulars.
• SPCB and Regional Office inspections: Periodic physical inspections cross-check on-ground compliance against EC conditions; findings are uploaded to PARIVESH 2.0 and form part of your permanent compliance record.
• Amendment EC applications: Any change in project scope, capacity, technology, or layout beyond the original EC requires an amendment application and fresh EAC/SEAC review of the changed component before work proceeds.
• Real-time monitoring for Category A: Updated EC general conditions require CAAQMS installation with live data transmission to CPCB and SPCB portals — this infrastructure must be budgeted from project inception, not treated as an afterthought.

An EC with violated conditions is an EC at risk. The NGT has cancelled ECs for non-compliance in documented precedent cases — post-EC management is a legal obligation, not a formality.

Where EIA Applications Fail

• Wrong category on Form 1: Filing Category B1 for a project that is Category A shifts appraisal to SEAC, which lacks jurisdiction — the application is rejected and the full clock restarts under EAC.
• Insufficient baseline station coverage: Fewer monitoring locations than your ToR specifies, or data from a non-NABL laboratory, results in data rejection at appraisal and a fresh monitoring cycle — often a full year lost.
• Seasonal data gaps: Missing one monitoring season — most commonly monsoon, which teams skip due to field access difficulty — invalidates the four-season requirement and sets you back up to a year.
• EIA Report not ToR-aligned: EAC compares each chapter against ToR items line by line. A missing chapter or inadequately predicted impact generates formal deficiency notices that can run across multiple appraisal rounds.
• Public hearing procedural defects: An incomplete 30-day notice period, hearing held in the wrong location, or gaps in SPCB facilitation can be challenged before NGT and invalidate the EC once issued.
• No cumulative impact analysis: EAC has deferred or rejected multiple applications since 2023 for failing to assess cumulative impacts in shared basins or industrial clusters — this analysis is no longer optional for most Category A projects.
• Unauthorised pre-EC construction: Starting site work before EC is issued, or exceeding EC-approved capacity during ramp-up, is the most common enforcement trigger and the hardest violation to defend in proceedings.
