FSSAI Registration

You cannot legally sell, store, transport, or even give away food in India without an FSSAI number — that 14-digit code printed on every pack of biscuits, every restaurant bill, every Swiggy listing. The Food Safety and Standards Act 2006 makes this threshold non-negotiable. Run a tiffin service from your kitchen, import olive oil, manufacture pickles, operate a cloud kitchen, sell honey on Amazon, or open a roadside dhaba — the rule applies the same way to all of you.

The hard part isn't the registration itself. It is picking the right tier — Basic, State, or Central — and getting the Kind of Business (KoB), product list, capacity, and premises layout correct on day one. A wrong-tier application gets rejected, the fee refund takes weeks, and you restart from scratch. What's New for FY 2026-27

FSSAI has tightened compliance significantly over the last two years. Here is what changed and how it affects new applications and existing licences this year.

• FoSCoS auto-validation: PAN, GSTIN, Aadhaar, and address proofs are now cross-validated in real time during application. Wrong data triggers immediate rejection instead of slow query loops.
• Front-of-Pack Nutrition Labelling: The Indian Nutrition Rating (INR) star system is being phased in for packaged foods. Salt, sugar, saturated fat, and energy thresholds drive the star count printed on the front of every pack.
• Mandatory hygiene rating display: Restaurants, sweet shops, meat retail, and food service must display the 1-5 star FSSAI hygiene rating at the entrance and on aggregator listings.
• E-commerce KoB codes: Dedicated FBO categories for cloud kitchens, dark stores, e-commerce food operators, and quick-commerce platforms have been carved out — old generic codes now trigger rejection.
• Marketplace seller checks: Swiggy, Zomato, Amazon, Flipkart, Blinkit, and Zepto now validate FSSAI numbers against FoSCoS before onboarding sellers. Fake or expired numbers are caught on day one.
• Digital inspection reports: Food Safety Officers file inspection reports through the FSSAI mobile audit app. Reports appear on the FBO's FoSCoS dashboard within 48 hours.

Why You Actually Need FSSAI

The licence is more than a regulatory tick-box. It is the document that decides whether you can sell, scale, and survive in food business.

• Marketplace gatekeepers: Swiggy, Zomato, Amazon, Flipkart, Blinkit, and Zepto reject seller onboarding without a valid FSSAI number — your business cannot reach customers.
• Bank and investor due diligence: Term loans, working capital, and equity funding rounds include a licence-check step. Operating on Basic when State is required is a financing dealbreaker.
• Export and import clearance: Customs holds shipments without Central FSSAI for importers and exporters. A single detained container costs more than a year of compliance.
• Government tenders: School meals, hospital catering, military supplies, Railways, and Defence catering all require Central licence as the entry threshold.
• Insurance claims: Product liability and recall insurance policies repudiate claims if the licence was invalid at the time of the incident.
• Consumer trust signal: The 14-digit FSSAI number on the pack and the hygiene rating at the door are the first thing modern consumers check.
• Penalty exposure: Section 31 attracts up to ₹5 lakh penalty plus seizure and criminal prosecution — repeat offences can trigger imprisonment.

How It Actually Works

Here is the seven-step sequence we follow from your first call to the licence landing in your inbox.

Step 1: Tier and KoB Mapping (1-2 days)

We start with your annual turnover, daily production capacity, premises locations, and the full list of Kinds of Business you operate or plan to. Multi-state distribution, imports, e-commerce listings, airport / seaport / Defence supply, or capacity above State-tier caps push you into Central regardless of turnover. The trigger is the higher of turnover and capacity, not the lower. We document this mapping in writing so the tier choice is defensible if challenged later.

Step 2: Document and Layout Pack (3-5 days)

PAN, address proof, rent agreement or ownership deed, blueprint with dimensions, equipment-and-machinery list with capacity, NABL water-test report, food safety management plan, pest-control contract, and KYC of the authorised signatory are assembled. For Central licences, we also add Form IX nomination of the designated person, NOCs from the State Pollution Control Board, Fire department, and the Municipal Trade Licence.

Step 3: FoSCoS Application and Fee (1-2 days)

On foscos.fssai.gov.in we file Form A for Basic or Form B for State and Central. KoB, product categories per FSS Regulations, capacity, validity tenure, and authorised signatory are uploaded. The government fee is paid online — ₹100 per year for Basic, ₹2,000-5,000 per year for State depending on capacity, and ₹7,500 per year for Central. An Application Reference Number (ARN) is issued instantly.

Step 4: Designated Officer Review and Inspection (7-30 days)

For Basic tier, the registration is usually issued without inspection if documents are clean. For State and Central, the Designated Officer reviews documents and conducts a site inspection of premises, equipment, hygiene, and water quality. Queries raised on the portal are answered the same day so the file does not slide into deemed rejection.

Step 5: Licence Issue and Number Allocation

The 14-digit FSSAI number is allocated and the licence PDF is downloadable from FoSCoS. This number must appear on every pack, every restaurant menu, every invoice, every website footer, every aggregator listing, and every advertisement of the FBO. The number is your operational permission to sell food in India.

Step 6: Labelling and Pack Artwork Activation (1-2 weeks)

We review your pack artwork before printer plates are made — FSSAI logo, licence number, ingredient list in descending weight order, nutrition table per 100g, allergen declarations, veg / non-veg mark, country of origin for imports, FoPNL star rating where applicable, batch number, manufacturing date, and best-before. Wrong labels lead to product recall.

Step 7: Compliance Calendar Setup

We set renewal triggers at 180, 90, and 30 days before expiry on our compliance calendar. Annual return Form D1 due 31 May is calendared for manufacturers and importers. Half-yearly Form D2 windows are added for milk and milk product manufacturers. Modification, product addition, and director-change SOPs are documented in your file.

A Real Example: A Pune Cloud Kitchen Going Multi-City

Take a Pune-based cloud kitchen running on Swiggy and Zomato. Year-one turnover was ₹18 lakh and they held a Basic Registration. By year two they crossed ₹40 lakh and expanded to Pimpri-Chinchwad and Aurangabad — and the licence math changed entirely.

• Turnover crossed ₹12 lakh: Basic Registration was no longer valid — they had been operating on the wrong tier for three months before realising it during a Swiggy renewal check.
• Three premises addresses: Each kitchen needs its own State Licence with that specific premises address — one licence does not cover all three locations.
• Aggregator suspension: Swiggy and Zomato suspended listings for two of the three kitchens during the FoSCoS validation cycle — every day of suspension cost ₹8,000-12,000 in lost orders.
• KoB mapping: Three KoBs endorsed per licence — cloud kitchen, central preparation unit, and transport for inter-outlet movement of semi-finished food.
• 5-year validity chosen: Locked the lower per-year State fee and reduced renewal frequency to once every five years instead of annually.

Total filing cost across the three State Licences was ₹19,500 in government fees plus our professional fee. The whole cycle took 32 days end to end. Without the right tier mapping at the start, two months of revenue would have been lost while listings stayed suspended.

Annual Return, Renewal, and Modification

The licence is not a one-and-done document. It is a live registration that needs maintenance every year — miss a step and the consequences hit your operations immediately.

• Form D1 by 31 May: Manufacturers and importers file product-wise quantity manufactured, sold, imported, and stock held during the previous financial year on FoSCoS.
• Form D2 half-yearly: Milk and milk product manufacturers file in May and November — quantity procured, processed, and sold for the respective half.
• Renewal window: Between 30 and 180 days before expiry. Late renewal up to 90 days post-expiry attracts ₹100 per day; beyond 90 days the licence is treated as dead and a fresh application is filed under defaulter status.
• Modification within 30 days: Premises change, director change, KoB addition, product addition, or capacity expansion must be endorsed on the licence within 30 days of the event.
• Inspection readiness: Food Safety Officers can visit any time. Sample collection, premises check, document audit, and the digital report all land on your FoSCoS dashboard.
• Show-cause response: Improvement notices give you 14 days to respond before suspension. Replies go through us with the regulatory framing and a remedial action plan.

An expired FSSAI licence is not a paperwork problem — it is a shutdown. Marketplace listings vanish overnight, customers see closed restaurants on aggregators, and your brand is publicly delisted.

Where It Goes Wrong

These are the eight filing mistakes that lead to rejection, suspension, or shutdown — and they are all preventable with a careful first-time application.

• Wrong tier choice: Picking Basic when turnover or capacity actually pushes you into State — the application is rejected and you restart with a slow fee refund cycle.
• Incomplete KoB endorsement: Listing only one KoB when actual operations include storage and transport — the uncovered activities become illegal even with a valid licence.
• Missing NABL water-test: A non-NABL water test report is a default rejection trigger for State and Central licences across every state.
• Outdated blueprint: Layout or blueprint that does not match the current premises — the inspection fails and the file is sent back for resubmission.
• Stale director or signatory data: Failing to update the licence after a director, partner, or proprietor change leads to deemed invalidity during enforcement.
• Old number on new packs: Printing packs with the previous licence number after a modification or renewal — recall and seizure risk under Section 31.
• Defective annual return: Filing Form D1 with rounded annual totals instead of product-wise quantities — the return is treated as defective and the late fee starts running.
• Ignoring the 90-day post-expiry rule: Letting the licence go more than 90 days past expiry — operations must stop and a fresh application is filed under defaulter status.
