Annulment of Marriage

Annulment is fundamentally different from divorce. Divorce ends a valid marriage; annulment declares that the marriage was never valid in the first place (void) or was voidable from inception. The legal effect is striking: an annulled marriage is treated as having never existed, removing most consequences — alimony, marital property claims, social stigma in many circles — that follow a divorce. The grounds are narrow but real: bigamy, prohibited relationship, sapinda relationship, fraud, force, impotence, mental incapacity at the time of marriage, and pregnancy by another person at the time of marriage. Each ground is statutorily defined and time-bound.

The framework is Section 11 of the Hindu Marriage Act, 1955 (void marriages) and Section 12 (voidable marriages); Section 24 (void) and Section 25 (voidable) of the Special Marriage Act, 1954; Section 18 of the Indian Divorce Act, 1869 for Christians; and corresponding provisions under Muslim and Parsi personal law. The Supreme Court has consistently treated annulment as a serious remedy with strict standards of proof — a casual or false annulment claim collapses on first cross-examination. Properly pleaded with concrete evidence (medical records, prior marriage certificates, bigamy proof, fraud documentation, force / coercion evidence), annulment delivers a final and clean exit, often faster than a contested divorce.

Grounds — Void vs Voidable

• Section 11 HMA (Void Marriages):: Bigamy (prior marriage subsisting); prohibited degrees of relationship; sapinda relationship (without custom permitting it). A void marriage is null from inception; declaration is to remove ambiguity.

Section 12 HMA (Voidable Marriages) — Limitation Bound:
Impotence at marriage and continuing to filing; lack of valid consent due to force, fraud, or material concealment; pregnancy by another person at the time of marriage; mental disorder making spouse unfit for marriage and procreation.

• Time Limits:: Force / fraud — within 1 year of force ending or fraud being discovered; pregnancy — within 1 year of marriage and before sexual intercourse; impotence and mental incapacity — generally any time during the marriage.

• Special Marriage Act:: Similar grounds with adapted language; bigamy is a substantive ground.

• Christian Law (Section 18 ISA):: Impotence, prohibited relationship, lunacy / idiocy, prior marriage subsisting; broadly similar grounds.

Why Annulment Petitions Often Fail (And How We Make Them Succeed)

Vague pleadings on fraud — courts require specific, material misrepresentation that goes to the root of the marriage (concealing prior marriage, suppressing serious mental illness, deceiving caste / religion in some cases). Impotence pleaded without medical evidence — demands forensic / medical examination as ordered. Force pleaded without contemporaneous record — demands witnesses, communications, complaints.
