Annulment of Marriage

A marriage that should never have happened in the eyes of the law is not the same as a marriage that broke down later. That distinction matters more than most people realise. An annulment treats your marriage as if it never legally existed; a divorce ends one that did. The grounds, the evidence, the limitation period, the property consequences, even the status of children — all of it changes depending on which path you take.

If your spouse was already married when they married you, lied about a material fact you would never have agreed to, was incapable of consummating the marriage, or you were forced into the wedding under threat — Section 11 or Section 12 of the Hindu Marriage Act 1955 (or Section 24 / 25 of the Special Marriage Act 1954) lets you ask the Family Court to declare the marriage void or voidable. The window to act is often narrow, the evidence burden is high, and the petition has to be pleaded with precision.

What's New for FY 2026-27

Family law procedure has shifted under the three new criminal codes operative since 1 July 2024, and the changes affect any annulment matter that runs in parallel with a criminal complaint.

• BNS replaces IPC: Bigamy is now under Section 82 of the Bharatiya Nyaya Sanhita 2023 (earlier Section 494 IPC). Cruelty by husband or relatives is Section 85 BNS (earlier 498A IPC).
• BNSS replaces CrPC: All procedural references in maintenance, custody, and protection orders sought alongside the annulment now flow through the Bharatiya Nagarik Suraksha Sanhita 2023.
• BSA replaces Evidence Act: The Bharatiya Sakshya Adhiniyam 2023 governs admissibility of WhatsApp chats, emails, call recordings, and other digital records — the Section 63 BSA certificate is mandatory for electronic evidence.
• Family Court e-filing: Most metropolitan Family Courts now accept e-filing of annulment petitions, e-service of summons through approved gateways, and virtual hearings for routine dates.
• DPDP Act for medical evidence: Court-ordered medical examination reports involve sensitive personal data and are now handled under the Digital Personal Data Protection Act 2023.
• Aadhaar-linked verification: Registrar of Marriages records are increasingly verified through Aadhaar, making bigamy proof through public records faster than before.

Why Choose Annulment Over Divorce

Annulment is not always the right answer. Sometimes a contested divorce on cruelty or desertion grounds is faster and simpler. Annulment is worth pursuing only when one of these is true:

• Status from inception matters: You want the record to show you were never legally married — for remarriage in a community where divorcees face stigma, for visa or immigration purposes, or for religious reasons.
• Bigamy was concealed: Discovering after marriage that your spouse had a subsisting prior marriage is a Section 11 ground that gives you both civil annulment and a parallel criminal remedy under Section 82 BNS.
• Fraud on a material fact: Concealment of a serious illness, prior criminal conviction, prior child from another relationship, or identity itself can amount to fraud under Section 12(1)(c) HMA.
• Force or coercion at the wedding: Marriages performed under threat to the petitioner or close family are voidable if filed within 1 year of the force ceasing.
• Pregnancy by another at marriage: Section 12(1)(d) HMA — if the wife was pregnant by someone other than the husband at the time of marriage and the husband did not know, the marriage is voidable.
• Property consequences differ: Annulment affects Section 25 HMA permanent alimony differently from divorce; specific property carved out in the petition can be protected from joint claims.

How It Actually Works

An annulment is not a quick declaration. It is a full Family Court petition with pleadings, evidence, cross-examination, and a reasoned decree. Here is what each stage looks like.

Step 1: Ground Selection and Limitation Memo (1-2 days)

We reduce your facts to a written ground-selection memo. Section 11 or Section 12? Which clause? When was the ground discovered? Is the petition still within the 1-year window where applicable? Have you continued to cohabit after discovery — which can defeat a Section 12 petition?

Step 5: Evidence, Cross-Examination, and Arguments (12-24 months)

After the respondent's written statement, the case enters trial. Chief evidence is led by affidavit. Cross-examination of the petitioner is detailed — every claim is tested. Documentary evidence is marked as exhibits with Section 63 BSA certificates for digital records. Court-ordered medical examination, if any, is conducted by a medical board.

Step 6: Decree of Nullity and Post-Decree Steps (1-3 months)

The Family Court delivers a reasoned decree. If the petition succeeds, a decree of nullity is granted — recording the marriage as void or voidable from inception. The decree is communicated to the Registrar of Marriages, status records are updated, and any consequential orders on property and custody are implemented.

If either party intends to appeal, the 90-day window under Section 28 HMA starts from the decree date.

A Real Example: Bigamy Discovered Two Years In

Take a Pune-based software engineer whose marriage was solemnised in Delhi in 2022. Two years in, her spouse's behaviour and travel patterns led her to suspect a parallel family in another city.

• Discovery (March 2026): An RTI application to the Sub-Registrar in the suspected city returned a certified copy of a 2018 marriage certificate showing the spouse already married to another woman. The earlier marriage had never been dissolved.
• Ground and limitation: Section 11 HMA (void marriage due to bigamy) — no limitation, but petition filed promptly to avoid arguments of acquiescence.

What Evidence Each Ground Demands

Family Courts dismiss vague annulment petitions. Each ground has a specific evidentiary spine that must be in place before filing.

• Bigamy (Section 11): Certified copy of the spouse's prior marriage certificate, RTI extract from the Registrar of Marriages, witness affidavits, photographs of the prior partner with the spouse, school or hospital records naming the prior spouse.
• Prohibited relationship or sapinda (Section 11): Family tree with birth certificates, genealogical evidence, witness affidavits from elders, religious-community records.
• Impotence (Section 12(1)(a)): Court-ordered medical board examination, expert testimony from a qualified medical practitioner, contemporaneous communications referring to non-consummation, witness corroboration on absence of cohabitation.
• Mental incapacity (Section 12(1)(b)): Psychiatric assessment reports, prior treatment records, witness evidence on conduct around the marriage date, treating doctor's testimony.
• Force or fraud (Section 12(1)(c)): Police complaint records, contemporaneous emails or messages showing duress, witness affidavits, evidence of immediate separation after the force ceased or fraud was discovered.
• Pregnancy by another (Section 12(1)(d)): Medical records of pregnancy date, DNA evidence where ordered by court, evidence that the husband did not know at the time of marriage.

Continuing to live together as husband and wife after discovery of a Section 12 ground will defeat the petition. Document the date of separation.

Where Annulment Petitions Go Wrong

Most failed annulment petitions fail not because the ground was wrong but because of avoidable errors in pleading, evidence, or timing.

• Filing after limitation: Most Section 12 grounds carry a 1-year limitation from discovery of the ground or cessation of force. Filing beyond this window leads to technical dismissal regardless of merit.
• Continued cohabitation after discovery: Living with the spouse as husband or wife after discovering fraud, impotence, or pregnancy by another is treated as condonation and defeats the Section 12 petition.
• Vague pleadings: "Spouse is impotent" or "spouse defrauded me" without dates, witnesses, and supporting evidence will be struck down at the framing-of-issues stage.
• Wrong court jurisdiction: Filing in a court that lacks territorial jurisdiction wastes months. The Family Court must be where parties last resided together, where the marriage was solemnised, or where the petitioner now resides.
• Choosing annulment when divorce is easier: Where evidence for the void or voidable ground is thin but evidence of cruelty or desertion is strong, a contested divorce often delivers a faster outcome with similar practical effect.
• Missing the Section 63 BSA certificate: Digital evidence — WhatsApp, email, call recordings — filed without the Section 63 BSA certificate of authenticity is inadmissible. Many petitions collapse at the evidence stage for this reason.
• Ignoring parallel criminal proceedings: In bigamy, dowry, or cruelty matters, parallel criminal complaints affect strategy. Coordinating the civil annulment and the criminal complaint is essential.
• Fearing for children's legitimacy: Section 16 HMA protects children of void and voidable marriages. Abandoning a meritorious annulment because of misplaced fear about children's status is based on outdated understanding.
