A contested divorce moves through seven structured phases. The first three usually take under 30 days; the rest depend on the court's calendar and whether mediation succeeds.
You start with a long, confidential conversation. Marriage history, the specific incidents that broke trust, communications, financial position, prior litigation and the children's situation are all reviewed. Every fact is anchored to a document or named witness before it appears in a pleading. Vague averments are the single most common reason cases collapse two years later at the evidence stage.

The divorce petition is drafted with specific incidents, dates, witnesses and supporting documents. Filed simultaneously: a Section 24 application for maintenance pendente lite, a Section 26 application for custody, and where required an injunction restraining alienation of joint assets. The respondent files reply, often with a counter-petition โ commonly for restitution under Section 9 HMA. The court refers the matter to mediation under Section 89 CPC and the Mediation Act 2023. If mediation fails, the court frames issues โ specific questions of fact to be decided. Chief examination is by affidavit, followed by cross-examination of both parties and witnesses, and documentary evidence under BSA 2023. Written submissions, oral arguments, then judgment. The decree dissolves the marriage and addresses permanent alimony under Section 25 HMA, custody under Section 26, and any property orders. Permanent alimony can be lump-sum or periodic; lump-sum is typically tax-exempt as a capital receipt in the recipient's hands.
Either side has 90 days to appeal to the High Court under Section 19 HMA. If no appeal is filed, the decree is acted on โ maintenance is enforced through bank attachment or salary garnishment if defaulted, and custody orders are given effect through Family Court supervision.
