You have decided to get married, and now you need a piece of paper that the government, your bank, your passport office, and possibly a foreign embassy will accept without argument. That paper is the marriage certificate, and how you get it depends on whether yours is a civil ceremony, a religious ceremony already performed, an inter-faith match, or a wedding that involves an NRI or foreign national.
India offers three distinct routes โ the Special Marriage Act 1954, the Hindu Marriage Act 1955, and the Foreign Marriage Act 1969 โ and choosing the wrong one wastes weeks. This page explains the routes, the 30-day notice rule, the documentation pack, and the post-marriage steps for passport, banking, and immigration use.
Court marriage procedures look stable, but several practical shifts in the last two years matter for couples planning their timeline.
A wedding ceremony โ Hindu, Christian, Muslim, Sikh, Parsi โ is legally a marriage. But a certificate is what every institution will ask for, and without it you face friction in places you would not expect.
Below is the standard SMA route. The HMA registration route for already-solemnised marriages is shorter and described separately further down.
The SMA is the route for civil marriages, inter-faith marriages, and marriages where either party is an NRI or foreign national. Neither party converts; both retain their religion.
The HMA covers Hindu, Sikh, Jain, and Buddhist ceremonial marriages โ registration here records a marriage that has already taken place. The Foreign Marriage Act covers Indians marrying abroad before an Indian Consulate. Choosing wrong at the start means refiling the notice from scratch.
Under Section 5 SMA, both parties file a written notice with the Marriage Officer of the district where either has resided for at least 30 days. The notice is in the prescribed form, signed by both, with identity, age, and residence exhibits attached.
The Marriage Officer enters the notice in the Marriage Notice Book and displays it on the office notice board โ physical or, increasingly, an online portal. The 30-day clock starts the day the notice is entered.
During the 30 days, any person can file a written objection on a statutory ground โ existing spouse, prohibited relationship, lack of consent, age below the legal minimum, or unsound mind. The objection must be specific; mere disapproval by family is not a ground.
If an objection is filed, the Marriage Officer must enquire within 30 days under Section 8. Frivolous objections are dismissed and the marriage proceeds. Sustainable objections โ rare โ can lead to refusal, appealable to the District Court within 30 days.
On the appointed day, both parties appear before the Marriage Officer with three witnesses. Each party signs a declaration in Form III stating that all Section 4 conditions are met. The Marriage Officer reads the declaration; both parties say in any language they understand: 'I, A, take thee, B, to be my lawful wife / husband.'
The Marriage Officer enters the marriage in the Marriage Certificate Book. Both parties and the three witnesses sign. The certificate under Section 13 is issued the same day or within a few working days.
If you have already had a Hindu, Sikh, Jain, or Buddhist religious ceremony, you do not need to repeat anything. Section 8 HMA and the State Rules let you register the existing marriage with the Sub-Registrar of Marriages.
You file a joint application with ceremonial-marriage proof โ wedding photographs showing the saptapadi or customary ceremony, the invitation card, a priest's declaration, identity and address proofs, and an affidavit. Two witnesses are usually sufficient. Most States issue the certificate within 7-30 days.
If the certificate will be used abroad โ for a spouse visa, joint account opening, or immigration โ the Ministry of External Affairs apostille is needed. State Home Department attestation precedes the apostille in most cases.
Domestically, the certificate is then used to add the spouse's name to passports, open joint accounts, update PAN and Aadhaar records, file nominations, and apply for dependent visas.
