That paper is the marriage certificate, and how you get it depends on whether yours is a civil ceremony, a religious ceremony already performed, an inter-faith match, or a wedding that involves an NRI or foreign national.

India offers three distinct routes — the Special Marriage Act 1954, the Hindu Marriage Act 1955, and the Foreign Marriage Act 1969 — and choosing the wrong one wastes weeks. What's New for FY 2026-27

Court marriage procedures look stable, but several practical shifts in the last two years matter for couples planning their timeline.

• Online notice portals: Delhi, Maharashtra, Karnataka, Tamil Nadu, and several other States now accept SMA notices through dedicated marriage portals. Slot booking is digital; paper copies are still uploaded to the Marriage Officer's office.
• Public-display flexibility: Following the Allahabad High Court ruling in Safiya Sultana (2021), several State Marriage Officers now treat public display of the notice as optional on written request from the parties. Practice still varies — confirm at intake.
• Aadhaar-based residence proof: Most districts now accept Aadhaar with current address as the primary 30-day residence proof, reducing the rent-agreement and utility-bill paperwork.
• DPDP Act 2023 alignment: Marriage Officer offices have started limiting which personal details appear on publicly-displayed notices, in line with the data-minimisation principle.
• Apostille acceleration: MEA apostille for marriage certificates now routinely completes in 5-7 working days via authorised agencies, important for NRI couples submitting spouse-visa applications.
• UCC in Uttarakhand: From January 2025 the Uttarakhand Uniform Civil Code applies to marriages of residents — registration is mandatory and live-in relationships must also be registered. Couples residing in Uttarakhand should plan for this additional layer.

Why You Need a Marriage Certificate Even After a Religious Ceremony

A wedding ceremony — Hindu, Christian, Muslim, Sikh, Parsi — is legally a marriage. But a certificate is what every institution will ask for, and without it you face friction in places you would not expect.

• Passport with spouse name: The Regional Passport Office requires a registered marriage certificate to add a spouse's name or to apply for a fresh passport in your married name.
• Spouse and dependent visas: Every consulate — US, UK, Schengen, Australia, Canada, UAE — requires an apostilled marriage certificate for spouse and dependent-visa applications.
• Joint bank accounts and loans: Banks ask for the certificate when you open a joint account, apply for a joint home loan, or claim a deceased spouse's deposits.
• Insurance and nominations: Life insurance, ESI, EPF and gratuity nominations naming a spouse are processed faster when the marriage is registered.
• Inheritance and succession: Succession certificates, transmission of shares, and property mutation in a spouse's name move smoothly when the marriage is on record.
• Court protection: If a family dispute arises, a registered marriage is presumptive evidence — saving years of witness testimony to establish that the marriage took place.
• Government schemes: Maternity benefits, widow pensions, government employee benefits, and reservation-related declarations rely on a registered marriage.

How It Actually Works

Below is the standard SMA route. The HMA registration route for already-solemnised marriages is shorter and described separately further down.

Step 1: Choosing the Right Statute

The SMA is the route for civil marriages, inter-faith marriages, and marriages where either party is an NRI or foreign national. Neither party converts; both retain their religion.

The HMA covers Hindu, Sikh, Jain, and Buddhist ceremonial marriages — registration here records a marriage that has already taken place. The Foreign Marriage Act covers Indians marrying abroad before an Indian Consulate. Choosing wrong at the start means refiling the notice from scratch.

Step 2: Notice of Intended Marriage

Under Section 5 SMA, both parties file a written notice with the Marriage Officer of the district where either has resided for at least 30 days. The notice is in the prescribed form, signed by both, with identity, age, and residence exhibits attached.

The Marriage Officer enters the notice in the Marriage Notice Book and displays it on the office notice board — physical or, increasingly, an online portal. The 30-day clock starts the day the notice is entered.

Step 3: The 30-Day Objection Window

During the 30 days, any person can file a written objection on a statutory ground — existing spouse, prohibited relationship, lack of consent, age below the legal minimum, or unsound mind. The objection must be specific; mere disapproval by family is not a ground.

If an objection is filed, the Marriage Officer must enquire within 30 days under Section 8. Frivolous objections are dismissed and the marriage proceeds. Sustainable objections — rare — can lead to refusal, appealable to the District Court within 30 days.

Step 4: Solemnisation Before the Marriage Officer

On the appointed day, both parties appear before the Marriage Officer with three witnesses. Each party signs a declaration in Form III stating that all Section 4 conditions are met. The Marriage Officer reads the declaration; both parties say in any language they understand: 'I, A, take thee, B, to be my lawful wife / husband.'

The Marriage Officer enters the marriage in the Marriage Certificate Book. Both parties and the three witnesses sign. The certificate under Section 13 is issued the same day or within a few working days.

Step 5: HMA Registration of a Ceremonial Marriage

If you have already had a Hindu, Sikh, Jain, or Buddhist religious ceremony, you do not need to repeat anything. Section 8 HMA and the State Rules let you register the existing marriage with the Sub-Registrar of Marriages.

You file a joint application with ceremonial-marriage proof — wedding photographs showing the saptapadi or customary ceremony, the invitation card, a priest's declaration, identity and address proofs, and an affidavit. Two witnesses are usually sufficient. Most States issue the certificate within 7-30 days.

Step 6: Apostille, MEA Attestation, and the Post-Marriage Pack

If the certificate will be used abroad — for a spouse visa, joint account opening, or immigration — the Ministry of External Affairs apostille is needed. State Home Department attestation precedes the apostille in most cases.

Domestically, the certificate is then used to add the spouse's name to passports, open joint accounts, update PAN and Aadhaar records, file nominations, and apply for dependent visas.

A Real Example: Inter-Faith Couple in Bengaluru

A Hindu software engineer in Bengaluru and a Christian doctor from Kerala wanted to marry without either party converting. Here is how their SMA process unfolded.

• Statute chosen: Special Marriage Act 1954 — both retain their religions; no State conversion law is triggered.
• District: Bengaluru Urban — both had been living in the city for over a year, so 30-day residence was easily proved with Aadhaar and a rent agreement.
• Notice filed: Day 1 — joint notice in the prescribed form, identity proofs, residence proofs, photographs, and a written request for waiver of public newspaper display citing the Safiya Sultana ruling.
• Objection window: Day 2-31 — no objections received. The Marriage Officer scheduled the solemnisation for Day 35.
• Solemnisation: Day 35 — both parties, three witnesses, declarations signed, certificate under Section 13 SMA issued the same afternoon.
• Post-marriage: Within 10 days, the certificate was MEA-apostilled because the doctor planned to take up a fellowship abroad, and the spouse's name was added to both passports.

Total elapsed time: 45 days from filing the notice to having an apostilled certificate in hand. Total spend on government fees and apostille charges: under ₹6,000 — exclusive of professional fees for documentation and coordination.

NRI and Foreign National Marriages

When one or both parties hold a foreign passport or live abroad, the documentation grows but the underlying SMA route remains the same.

• Certificate of no impediment: The foreign party obtains a certificate of no impediment to marriage from their embassy or consulate in India, sometimes called a 'single status certificate' or 'celibacy certificate'.
• Single-status affidavit: A notarised affidavit from the home country, apostilled under the Hague Convention or attested by the Indian embassy if the home country is non-Hague.
• Valid visa: The foreign party must hold a valid Indian visa appropriate to their stay. Tourist visas are accepted; some States require a longer-stay visa, so confirm locally.
• 30-day residence: Either party can supply the 30-day residence — the Indian party in their home district is usually simpler.
• Embassy attendance: Some embassies require their citizen to register the Indian-issued certificate at the embassy within a fixed window for the marriage to be recognised in the home country.
• Spouse-visa file: The apostilled certificate, along with a relationship affidavit, financial proof, and accommodation evidence, forms the core of any subsequent spouse or dependent-visa application.

An apostilled Indian marriage certificate is recognised in over 120 Hague-Convention countries without further legalisation — making it one of the most travel-friendly civil documents an Indian couple can hold.

Where It Goes Wrong

The procedural failures we see again and again are not legal — they are documentation and planning failures. A short list of the avoidable ones.

• Wrong district for the notice: Filing the notice where neither party has 30-day residence makes the notice void. The couple discovers it three weeks later when the Marriage Officer asks for proof and starts again.
• Mismatched names across documents: Aadhaar shows one spelling, the passport another, the 10th certificate a third. The Marriage Officer asks for an affidavit reconciling all variants — a week lost.
• Previous marriage not closed: A divorced party brings the decree but not the proof of finality after the appeal period. The notice is held up until the decree-finality certificate from the Family Court is produced.
• Witnesses unprepared: Witnesses arrive without original ID, or with expired passports, or as substitutes the parties did not check in advance. The solemnisation is rescheduled.
• HMA registration without ceremonial evidence: Couples assume oral declaration suffices. The Sub-Registrar asks for wedding photographs and a priest declaration, both of which take time to source.
• Foreign affidavits not apostilled: A single-status affidavit notarised abroad but not apostilled is rejected. Couriering it back for apostille adds two to three weeks.
• Passport addition attempted without certificate: The Regional Passport Office requires the marriage certificate, not the solemnisation receipt. Applying before the certificate is in hand leads to a rejected application and a fresh fee.
• UCC residents in Uttarakhand skipping registration: Since January 2025, residents must register; failure carries penalty and the marriage may not be presumed to exist for State-law purposes.
