End-to-end PWDVA 2005 case filing โ protection, residence, monetary, custody and compensation orders for women facing domestic violence in India.
Domestic violence is not only physical. The Protection of Women from Domestic Violence Act 2005 (PWDVA) recognises emotional, sexual, verbal, and economic abuse inside a shared household โ and gives the aggrieved woman fast civil reliefs that don't wait for a criminal trial. Protection orders, residence orders, monetary relief, custody, compensation โ all from a Magistrate, often within a few weeks of filing.
For FY 2026-27, with the Bharatiya Nyaya Sanhita (BNS) and Bharatiya Nagarik Suraksha Sanhita (BNSS) replacing the IPC and CrPC, and V3 e-filing systems live in many districts, the procedural plumbing around PWDVA has changed. The substantive framework of the 2005 Act remains the same โ but how you file, serve, execute, and appeal now runs on different rails.
The PWDVA itself has not been amended in 2025-26. The procedural ecosystem around it โ criminal code, e-filing, mediation reporting โ has shifted enough that every fresh petition reads differently from one drafted two years ago.
When a marital or live-in relationship turns abusive, women have several legal options. PWDVA usually moves first โ and faster โ for reasons that matter on the ground.
From the first phone call to the final order, the case moves through six well-defined phases. Each has its own deliverables and its own risk of going sideways if rushed.
The first meeting is private and unrushed. We capture every incident with a date, location, and the document that proves it โ medical records, photos, screenshots, police complaints, bank statements. The brief is stored in a restricted folder with a written confidentiality undertaking. Where the situation is unsafe, the very first call also covers an immediate residence plan and police support.
We map facts to reliefs โ which incidents support protection (Section 18), which support residence (Section 19), which support monetary relief (Section 20), which support custody (Section 21), and which support compensation (Section 22). The memo also decides on parallel filings: Section 85 BNS criminal complaint, Section 144 BNSS maintenance, divorce. The aim is reinforcement, not duplication.
The petition is drafted incident-by-incident, not in generic paragraphs. The Domestic Incident Report (DIR) is prepared with the Protection Officer or a registered service provider. The Section 23 interim relief application is always annexed. Affidavits, photographs, medical certificates, and an indexed evidence bundle are filed together so the court has the full documentary spine at first listing.
Filing is at the Magistrate's court of competent jurisdiction. The court takes the petition on first listing and, where the documentary spine is in place, grants ex-parte interim orders on protection, residence, and maintenance at that hearing itself. Copies of the interim order are then served on the respondent through the Protection Officer, police, or authorised electronic mode.
Once served, the respondent files a reply โ often disputing income, the relationship, or specific incidents. Rejoinder follows. Witnesses are examined and cross-examined. The Magistrate may also pass orders for counselling under Section 14, especially in early-stage matters where reconciliation is still possible. We track each hearing with a court diary and prepare you specifically for cross-examination.
The Magistrate passes the final order on all prayed reliefs. Recovery of maintenance arrears uses the warrant route under Section 20(6). Breach of protection orders is prosecuted under Section 31 โ imprisonment up to one year and/or fine. Either party can appeal to Sessions under Section 29 within 30 days; further revision lies to the High Court in appropriate cases.
Consider a 34-year-old salaried professional in Pune, married seven years, with one child aged four. Her husband works in IT โ declared income โน38 lakh per annum on ITR. She earns โน6 lakh per annum. After 18 months of verbal abuse, two physical assaults with hospital records, control over her bank accounts, and repeated threats of eviction, she filed a PWDVA petition. Eight months later, the Magistrate passed the final order: monthly maintenance revised to โน62,000 with annual indexation; mental cruelty compensation of โน3,50,000; stridhan list returned in full; protection and residence orders made absolute. The husband's Section 29 appeal to Sessions was dismissed.
Interim relief inside three weeks of filing changed the daily reality of the household โ protection, residence, and money โ even while the full hearing took eight months.
Each relief is only as strong as the evidence behind it. Courts have become sharper in 2025-26 about generic, undocumented allegations. Specifics carry the order; vague pleadings invite dismissal or reduction on appeal.
Most PWDVA petitions that under-deliver share the same drafting failures. Each of these is avoidable with a careful documentary spine.
