Domestic Violence Case Filing

Domestic violence is not only physical. The Protection of Women from Domestic Violence Act 2005 (PWDVA) recognises emotional, sexual, verbal, and economic abuse inside a shared household — and gives the aggrieved woman fast civil reliefs that don't wait for a criminal trial. Protection orders, residence orders, monetary relief, custody, compensation — all from a Magistrate, often within a few weeks of filing.

For FY 2026-27, with the Bharatiya Nyaya Sanhita (BNS) and Bharatiya Nagarik Suraksha Sanhita (BNSS) replacing the IPC and CrPC, and V3 e-filing systems live in many districts, the procedural plumbing around PWDVA has changed. The substantive framework of the 2005 Act remains the same — but how you file, serve, execute, and appeal now runs on different rails.

What's New for FY 2026-27

The PWDVA itself has not been amended in 2025-26. The procedural ecosystem around it — criminal code, e-filing, mediation reporting — has shifted enough that every fresh petition reads differently from one drafted two years ago.

• BNS and BNSS replace IPC and CrPC: Section 85 of the Bharatiya Nyaya Sanhita 2023 now covers marital cruelty (earlier Section 498A IPC); Section 144 of the BNSS 2023 covers maintenance (earlier Section 125 CrPC). PWDVA petitions now cross-reference the new sections.
• Electronic service of notice: Section 64 BNSS allows e-summons in many districts; respondents abroad or in another state can be served by email and authorised messaging — turnaround on service has dropped sharply.
• Mediation reporting on V3 portals: Section 14 counselling reports prepared by Protection Officers and registered service providers are uploaded to court portals in V3-active districts, removing older paper-only delays.
• DPDP Act 2023 compliance: Protection Officers, service providers, and shelter homes handling case data must follow Digital Personal Data Protection norms. Petitioner consent for sharing data with police, hospital, or counsellor is now documented in writing.
• Recent Supreme Court guidance: Prabha Tyagi (2022) confirmed the woman need not be in the shared household on the date of filing; Satish Chander Ahuja (2020) clarified daughter-in-law's residence right against parents-in-law; Kahkashan Kausar (2022) curbed omnibus allegations against in-laws.

Why PWDVA Often Outpaces Other Reliefs

When a marital or live-in relationship turns abusive, women have several legal options. PWDVA usually moves first — and faster — for reasons that matter on the ground.

• Speed: Magistrate orders within weeks of filing; criminal cruelty trials take years.
• Width of abuse covered: Physical, sexual, verbal, emotional, and economic abuse — not just bodily harm. Economic abuse covers control over your finances, denial of basic needs, and dispossession of stridhan.
• Civil burden of proof: Preponderance of probabilities — far lower than the criminal 'beyond reasonable doubt' bar.
• Residence right with teeth: Section 19 protects your roof. No other Indian statute gives the aggrieved woman this level of housing security inside the shared household.
• Monetary reliefs in one petition: Maintenance, medical expenses, loss of earnings, education costs, mental-torture compensation — all claimed and quantified together.
• Live-in coverage: Same reliefs available to long-term cohabiting partners under the Indra Sarma test.
• Cumulative with other laws: Filing under PWDVA does not bar criminal cruelty cases, Section 144 BNSS maintenance, or divorce proceedings.

How It Actually Works

From the first phone call to the final order, the case moves through six well-defined phases. Each has its own deliverables and its own risk of going sideways if rushed.

Step 1: Confidential Brief and Document Audit (1-2 days)

The first meeting is private and unrushed. We capture every incident with a date, location, and the document that proves it — medical records, photos, screenshots, police complaints, bank statements. The brief is stored in a restricted folder with a written confidentiality undertaking. Where the situation is unsafe, the very first call also covers an immediate residence plan and police support.

Step 2: Strategy and Reliefs Memo (1-2 days)

We map facts to reliefs — which incidents support protection (Section 18), which support residence (Section 19), which support monetary relief (Section 20), which support custody (Section 21), and which support compensation (Section 22). The memo also decides on parallel filings: Section 85 BNS criminal complaint, Section 144 BNSS maintenance, divorce. The aim is reinforcement, not duplication.

Step 3: Drafting the Petition with DIR (3-5 days)

The petition is drafted incident-by-incident, not in generic paragraphs. The Domestic Incident Report (DIR) is prepared with the Protection Officer or a registered service provider. The Section 23 interim relief application is always annexed. Affidavits, photographs, medical certificates, and an indexed evidence bundle are filed together so the court has the full documentary spine at first listing.

Step 4: Filing and Section 23 Interim Order (same day or next listing)

Filing is at the Magistrate's court of competent jurisdiction. The court takes the petition on first listing and, where the documentary spine is in place, grants ex-parte interim orders on protection, residence, and maintenance at that hearing itself. Copies of the interim order are then served on the respondent through the Protection Officer, police, or authorised electronic mode.

Step 5: Service, Reply, Evidence, and Cross-Examination (3-9 months)

Once served, the respondent files a reply — often disputing income, the relationship, or specific incidents. Rejoinder follows. Witnesses are examined and cross-examined. The Magistrate may also pass orders for counselling under Section 14, especially in early-stage matters where reconciliation is still possible. We track each hearing with a court diary and prepare you specifically for cross-examination.

Step 6: Final Order, Execution, Breach, and Appeal

The Magistrate passes the final order on all prayed reliefs. Recovery of maintenance arrears uses the warrant route under Section 20(6). Breach of protection orders is prosecuted under Section 31 — imprisonment up to one year and/or fine. Either party can appeal to Sessions under Section 29 within 30 days; further revision lies to the High Court in appropriate cases.

A Real Example: Pune, IT Family, Working Wife

Consider a 34-year-old salaried professional in Pune, married seven years, with one child aged four. Her husband works in IT — declared income ₹38 lakh per annum on ITR. She earns ₹6 lakh per annum. After 18 months of verbal abuse, two physical assaults with hospital records, control over her bank accounts, and repeated threats of eviction, she filed a PWDVA petition. Interim orders granted at first hearing:

• Protection order: No contact through any medium; no entry to her bedroom area in the shared household; restraint on third-party threats routed through family members.
• Residence order: She and the child continue in the shared household; husband restricted to a different floor; in-laws restrained from causing eviction.
• Interim monetary relief: ₹48,000 per month for her and the child; lump-sum ₹85,000 for medical expenses and school fee arrears.
• Interim custody: Custody with the mother; visitation by the father on Saturdays at a neutral venue, 4-7 pm, with no overnight stay.

Eight months later, the Magistrate passed the final order: monthly maintenance revised to ₹62,000 with annual indexation; mental cruelty compensation of ₹3,50,000; stridhan list returned in full; protection and residence orders made absolute. The husband's Section 29 appeal to Sessions was dismissed.

Interim relief inside three weeks of filing changed the daily reality of the household — protection, residence, and money — even while the full hearing took eight months.

What Backs Up Each Order

Each relief is only as strong as the evidence behind it. Courts have become sharper in 2025-26 about generic, undocumented allegations. Specifics carry the order; vague pleadings invite dismissal or reduction on appeal.

• Protection order: Specific incidents with date, time, location, and the document or witness that proves each one. Medical records and police complaints carry the most weight.
• Residence order: Marriage certificate or live-in proof, shared household evidence (utility bills, rent agreement, joint photographs), and threat-of-eviction documentation.
• Monetary relief: Respondent's tax returns, salary slips, bank statements, property records, lifestyle proof (vehicles, foreign travel, club memberships). Quantum is calibrated to standard of living, not survival.
• Custody and visitation: Child's school records, medical records, and welfare-of-child evidence. Counsellor or paediatrician reports help in contested matters.
• Compensation for mental torture: Psychiatric records, therapy notes, sustained communication patterns showing emotional abuse, and economic loss quantification.

Where It Goes Wrong

Most PWDVA petitions that under-deliver share the same drafting failures. Each of these is avoidable with a careful documentary spine.

• Vague incidents without dates or witnesses: Courts read down generic pleadings. Each material incident needs a date, location, and proof.
• Omnibus allegations against extended family: Post Kahkashan Kausar (2022), undifferentiated allegations against parents-in-law, brothers-in-law, and sisters-in-law are suspect. Plead specific roles or drop the party.
• No respondent income proof: If you don't prove what the respondent actually earns, maintenance defaults to survival levels. Tax returns and bank statements decide the number.
• Missing Section 23 prayer: Skipping the interim relief application means no protection for months. Always pray for it; let the court decide.
• Stridhan list filed late: If stridhan is not pleaded and listed early, recovery becomes contested. List jewellery, gifts, and receipts at the time of filing.
• Live-in pleaded without the Indra Sarma checklist: Long cohabitation, shared household, financial interdependence, social presentation as a couple — all need to be pleaded specifically.
• Ignoring counselling orders under Section 14: Skipping counselling sessions ordered by the Magistrate weakens the petitioner's standing at the final hearing.
• Late Section 31 breach complaint: If the respondent violates a protection order, file the breach within days, not weeks. Delay dilutes urgency and remedy.
