The moment an Indian employer crosses 20 employees (EPF) or 10 employees (ESIC), two parallel social-security obligations switch on — Employees' Provident Fund under the EPF & MP Act, 1952, and Employees' State Insurance under the ESI Act, 1948. By 2026, both regimes are almost fully digital — Shram Suvidha for one-time registration, Unified Member Portal and EPFO Member Passbook for employees, e-Sewa and ECR (Electronic Challan-cum-Return) for monthly compliance, and UAN-Aadhaar e-KYC as a precondition for any contribution being credited.

The compliance is light if you build it right; it becomes a nightmare if you don't. A late ECR triggers damages under Section 14B (5% to 100% of the dues) plus interest under Section 7Q (12% p.a.). An unrecognised employee in ESIC can claim arrears for years and trigger inspection. An employer who has not done UAN-Aadhaar seeding will see contributions sitting in suspense and employees flooding HR with passbook complaints. The wage-ceiling debate (₹15,000 for EPF, ₹21,000 for ESIC), international workers, contractors, gig workers and the four labour codes (when notified) make ongoing compliance a moving target.

Why Employers Get Penalised — Even When They 'Pay on Time'
