Pollution NOC (Consent from SPCB)

The Pollution NOC — formally Consent for Establishment (CFE) and Consent for Operation (CFO) — is the gateway licence for any industrial or commercial unit in India that may discharge effluent, emit air pollutants, generate solid waste, or otherwise affect the environment. Without it, a factory cannot legally start construction; without it, a unit cannot legally operate. Issued by the relevant State Pollution Control Board (SPCB) under the Water (Prevention and Control of Pollution) Act 1974 and Air (Prevention and Control of Pollution) Act 1981, the NOC is reviewed and granted based on the unit's category — Red, Orange, Green, or White — under the CPCB classification framework.

By 2026, the CFE / CFO process is fully online for most States — Maharashtra Pollution Control Board (MPCB), Karnataka State Pollution Control Board (KSPCB), Tamil Nadu Pollution Control Board (TNPCB), Gujarat Pollution Control Board (GPCB), Delhi Pollution Control Committee (DPCC), and others operate dedicated portals (e.g., MPCB's XGN, KSPCB's online portal, GPCB's XGN) that cover application, fee deposit, document upload, queries, and consent issuance. PARIVESH 2.0 is the central single-window environmental clearance portal for projects requiring central / State-EIA in addition to CFE / CFO.

The CPCB Category Framework

• Red Category:: High-pollution-potential industries (cement, chemicals, pharmaceuticals, fertilisers, distilleries, metallurgy, mining, hazardous waste handling). Detailed CFE; CFO valid 1-3 years; mandatory online emission / effluent monitoring (CEMS / CEQMS); detailed Environment Statement Form V.

• Orange Category:: Medium pollution potential (textile, food processing, automobile, plastic, brick kilns). CFE moderate; CFO valid 3-5 years; periodic monitoring.

• Green Category:: Low pollution potential (electronics assembly, IT, light engineering). CFE light; CFO valid 5 years; minimal compliance.

• White Category:: Essentially non-polluting (call centres, offices, light service operations). Self-declaration in most States; no CFE / CFO required.

CFE — Consent for Establishment

Required before construction begins. Documents: layout, project description, proposed effluent / emission / waste profile, water consumption, fuel consumption, ETP / STP / APC design, hazardous waste plan, raw material list, finished product list, NA / land documents, project cost. Validity: typically until the project's expected operation start date plus a buffer. Once CFE is in hand, construction proceeds; CFO follows after commissioning.

CFO — Consent for Operation

Required before operation begins. Issued post-CFE and post-construction. Site inspection by SPCB; ETP / STP / APC operational verification; sample testing; final consent issued with conditions. Validity 1-5 years depending on category. Renewal must be applied 120 days before expiry.

Other Statutory Overlays

• EC (Environmental Clearance):: For Category A (Central — MoEF&CC) and Category B (State — SEIAA) projects under EIA Notification 2006 — separate from CFE / CFO; runs through PARIVESH portal; ToR / EIA / Public Hearing / EAC review / EC issued.

• Hazardous Waste Authorisation:: Under Hazardous & Other Wastes Rules 2016 (amended 2022) — separate from CFE / CFO; for generators / handlers / disposers.

E-Waste / Plastic Waste / Battery Waste / Bio-Medical Waste:
Each has its own Rules and authorisation framework.

• CGWA NOC for Groundwater Extraction:: Separate from CFE / CFO; from Central Ground Water Authority.
