A Power of Attorney (PoA) is one of the most powerful — and most misused — instruments in Indian law. Used correctly, it lets a trusted person sign deeds, operate bank accounts, defend a suit, manage tenants, register property, or close a transaction on your behalf when you cannot be physically present. Used carelessly, it has been the source of property frauds running into thousands of crores — which is exactly why the Supreme Court intervened in Suraj Lamps & Industries (P) Ltd. v. State of Haryana (2011) and held that a 'Sale through GPA' transfers no title in immovable property. Since that judgment, the law on PoA — and especially property PoA — has tightened considerably.
The legal architecture is built around the Powers of Attorney Act, 1882, the Indian Stamp Act, 1899 read with the State Stamp Schedule (rates differ widely — Maharashtra, Karnataka, Tamil Nadu, Delhi all charge differently, and a property PoA can attract stamp duty equivalent to a conveyance in some States), Section 17 of the Registration Act, 1908 (which makes PoA mandatorily registrable when it authorises sale of immovable property worth ₹100 or more), the Notaries Act, 1952 for notarisation, and — for NRIs and persons abroad — consularisation / apostille rules under the Hague Convention or via the Indian Embassy.
