The Allahabad High Court has ruled that a two-year gap is not required for a second spell of maternity leave under the Social Security Code, Justice Nandan observed that the Financial Handbook provisions were framed under the Government of India Act, 1935 and continue only by virtue of the adaptation of laws order, the court held that the provisions of the Social Security Code will prevail over the Financial Handbook in case of a conflict, this ruling is expected to benefit many women employees who were earlier required to wait for two years before taking a second maternity leave
