Trademark Search

The cheapest moment to discover that your brand name is already taken is before you file. The most expensive moment is six months later, when an examination report citing Section 11 lands on your desk and your packaging, website, app store listing, business cards, and GST registration are all already running on the disputed name. By 2026, India's IP India trademark register holds well over 60 lakh applications across Class 1 to Class 45 of the Nice Classification (12th edition, 2024 revision), with thousands of new filings every working day. The probability that your chosen mark — or something confusingly similar — already exists in your class is high. The probability that it exists in an adjacent class with overlapping consumers is even higher. A real, lawyer-conducted trademark search is the only honest answer.

The framework is the Trade Marks Act 1999 read with the Trade Marks Rules 2017. The two grounds on which a mark gets refused are Section 9 (absolute grounds — descriptive, generic, non-distinctive, customary, deceptive, contrary to public order) and Section 11 (relative grounds — identical or similar to an earlier mark for identical or similar goods / services with likelihood of confusion or dilution of a well-known mark). A search must test the proposed mark against both. Beyond the IP India register, a real search also covers common-law usage — Google, social media, Amazon / Flipkart / app stores, MCA company-name database, GST taxpayer database, and the corresponding domain name on .com / .in / .co.in — because passing-off rights subsist independently of registration.

What a Real Trademark Search Examines

• IP India Database — Identical & Similar:: Wordmark, device, label, slogan; identical-mark search and similar-mark search across the proposed class and adjacent classes; pending and registered marks; abandoned, refused, opposed and removed marks (which can revive).

• Phonetic Search:: Marks that sound similar even if spelled differently — 'Xeon' vs 'Zion', 'Krome' vs 'Chrome', 'Klear' vs 'Clear'. The Registrar applies the phonetic-similarity test under Section 11; we apply it first.

• Visual & Device Search:: For logos and labels — Vienna Codification search for figurative elements, colour combinations, and device similarity; relevant for combined word-and-device marks.

• Conceptual / Meaning Similarity:: Marks with the same idea in different words — 'Sunrise' vs 'Dawn', 'Lion' vs 'Sher'. Conceptual confusion is a recognised ground under Section 11.

• Class & Cross-Class Analysis:: Nice Classification 12th edition (2024); search in the chosen class plus genuinely adjacent classes (e.g. Class 9 software with Class 42 SaaS; Class 25 apparel with Class 35 retail).

• Common-Law & Market Search:: Google, social media handles (Instagram, X, LinkedIn, YouTube), Amazon / Flipkart / Myntra listings, app stores, MCA company-name index, GST taxpayer search, news archives — to surface unregistered prior users with passing-off rights.

• Domain Availability:: .com, .in, .co.in, .org and category-specific TLDs; WHOIS check; cybersquatting / typo-squat patterns mapped.

Why a Lazy Search Costs You

A name picked off the IP India quick-search and filed without phonetic and conceptual checks frequently lands a Section 11 objection. Worst case — a similar registered mark holder opposes the application within the 4-month opposition window post-journal publication, and 2-3 years of brand investment is at risk. Common-law users with goodwill but no registration can sue for passing off. Domain squatters, once they spot your filing, register the matching .com and demand a settlement.
