You and our team review your commercial status: Are you already selling in the USA, or is this a future launch? Is the USA the only target, or are you planning Madrid designations to Canada, EU, Australia, Singapore? Based on this, we choose the right filing basis β Section 1(a) if you have current use, Section 1(b) if you're launching soon, Section 44(d) if you've filed in India within the last 6 months, Section 44(e) if you have an Indian registration, or Madrid if you're targeting 3+ countries. This step locks in cost, timeline, and prosecution risk.
We search the USPTO TESS database (Trademark Electronic Search System) for identical, phonetic, and conceptual matches. We also run Google, Amazon, social media, and domain searches for common-law use β unregistered marks used by others in the US that could block your filing. If risks are high, we advise against filing or pursue prosecution with a strong consent argument. If risks are low, we proceed to filing.
For Section 1(a) filings, we prepare the Specimen of Use β product packaging photos, website screenshots with purchase buttons, point-of-sale displays, or service invoices. The Specimen must show the exact mark on the exact good in actual commerce β not a mock-up. For Section 1(b), we draft the Intent declaration and a contemporaneous specimen showing the mark ready for use upon launch. Goods identification is mapped to Nice classes and the USPTO ID Manual.
We file your application electronically via the USPTO TEAS (Trademark Electronic Application System). TEAS Plus costs $250β350 USD per class if identification fits the ID Manual; TEAS Standard costs slightly more but allows broader identification. We file priority claims (Section 44(d)) if you have a pending foreign application. The application is assigned a serial number within 1 day.
The Examining Attorney reviews your application within 3β4 months and either approves it for publication or issues an Office Action (refusal or requirement). Common issues: specimen refusal, goods identification too broad, likelihood of confusion with an existing mark. Each Office Action gets a 3-month reply window. We manage the entire loop, including arguments on distinctiveness and trade-channel differences.
Once approved, your application is published in the Official Gazette (USPTO's weekly bulletin). This triggers a 30-day opposition window during which anyone can challenge your registration. If no oppositions are filed, your application proceeds to registration (for Section 1(a)) or Notice of Allowance (for Section 1(b)). We monitor this window and respond to any TTAB oppositions filed against you.
If you filed Section 1(b), after goods/services actually launch in US commerce, you file a Statement of Use (Form 1.76) with a current Specimen. This must be filed within 6 months of Notice of Allowance; you can request extensions (up to 5 times, totalling 36 months). Once approved, the registration certificate is issued. For Section 1(a), registration is granted upon publication (if no opposition); for Madrid designations, designation approval is handled by WIPO within 12β18 months.
