Step 1: Strategy & Filing Basis Selection (3–5 Days)

Step 2: US Trademark Search & Conflict Assessment (5–7 Days)

Step 5: Office Action Reply & Prosecution (As Needed, 3–6 Months)

Step 6: Publication & Opposition Window (30–60 Days)

Once approved, your application is published in the Official Gazette (USPTO's weekly bulletin). This triggers a 30-day opposition window during which anyone can challenge your registration. If no oppositions are filed, your application proceeds to registration (for Section 1(a)) or Notice of Allowance (for Section 1(b)). Step 7: Statement of Use (Section 1(b) Only) & Registration (6 Months to 36 Months)

If you filed Section 1(b), after goods/services actually launch in US commerce, you file a Statement of Use (Form 1.76) with a current Specimen. This must be filed within 6 months of Notice of Allowance; you can request extensions (up to 5 times, totalling 36 months). Once approved, the registration certificate is issued. For Section 1(a), registration is granted upon publication (if no opposition); for Madrid designations, designation approval is handled by WIPO within 12–18 months.

Section 8/15 Maintenance — The Non-Negotiable Calendar

• Section 15 Incontestability (Optional but Valuable): Between the 5th and 6th anniversary, file a Section 15 Declaration, converting the registration to incontestable status. In a future infringement suit, the other party cannot challenge the validity of your registration based on likelihood of confusion or other grounds. • Goods Identification Too Broad or Narrow: Claiming 'all software' (rejected as too broad) or 'iOS app only' (too narrow, limiting your rights). We align your description with ID Manual entries to pass the first time.
• Missing Priority Claims: Filing Section 1(a) in the US without claiming priority under Section 44(d) from your pending Indian application, losing the 6-month priority window. These misalignments weaken your case in infringement or TTAB opposition.
