A Gift Deed is the legal instrument by which one person (the donor) voluntarily transfers ownership of property โ movable or immovable โ to another person (the donee) without consideration. It looks simple. It is not. By 2026, in any Indian gift transaction โ a father gifting a flat to his son, a mother gifting jewellery to her daughter, a brother gifting shares to his sister, an uncle gifting land to his nephew โ the Gift Deed must comply with Sections 122-129 of the Transfer of Property Act 1882, mandatory registration under Section 17 of the Registration Act 1908 for immovable property, attestation by two witnesses, and the income-tax framework under Section 56(2)(x) of the Income-tax Act 1961. Done correctly, the gift transfers clean title, attracts concessional stamp duty (where donor and donee are specified relatives under State Schedule), and creates no income-tax exposure on the donee. Done poorly โ typical with template downloads โ the gift is void, the registration is rejected, the stamp duty is mis-paid, or the donee gets a Section 56(2)(x) tax notice three years later.
The legal architecture: Section 122 TPA 1882 defines gift as voluntary transfer without consideration; Section 123 TPA mandates that gift of immovable property must be by registered instrument signed by donor and attested by two witnesses; Section 124 TPA deals with gift of existing and future property; Section 126 TPA governs revocation; Section 129 TPA exempts Mohammedan gifts (Hiba) from these formalities. Stamp duty is governed by State Stamp Acts and Schedules โ most States provide concessional rates (โน100 to 2-3% of market value) for gifts to specified relatives (spouse, children, parents, siblings) versus full rates for non-relatives. Income tax under Section 56(2)(x) exempts gifts from specified relatives, on marriage, by will / inheritance, or under โน50,000 in aggregate from non-relatives โ anything else is taxable as Income from Other Sources at slab rate in the donee's hands.
