HUF registration is not a one-day process, but it's also not a multi-month legal saga. Here's the realistic step-by-step from family discussion to first ITR filing.
Identify all coparceners (post-Vineeta Sharma daughters included), list ancestral vs. personal assets, and decide who will serve as Karta. Document the HUF rationale in writing—tax planning, succession clarity, or both. If multiple potential Kartas exist, note that the eldest coparcener is typical but not mandatory. This 2–3 day exercise prevents disputes later.
Draft a one-to-two-page Declaration Deed on state stamp paper naming Karta, coparceners, members, and initial corpus (gift from relative or ancestral asset). Have it notarised by a notary public in the state where Karta resides. The deed is your proof of HUF status date; without it, the AO may reject HUF status retroactively or argue the family business was always personal.
Before applying for HUF PAN, ensure the Karta has an active individual PAN linked to Aadhaar. HUF PAN applications (Form 49A) require Karta's authorised signatory proof and Aadhaar. If Karta's PAN is dormant or Aadhaar unlinked, HUF PAN allotment stalls. If PAN is blocked due to non-filing of ITR, unblock it first.
File Form 49A (HUF status, Karta details, declaration deed, corpus details) with NSDL or UTIITSL. Expect 7–15 working days. Once allotted, the HUF PAN is permanent unless a full partition under Section 171 splits the family into separate HUFs. Do not apply for multiple HUF PANs for the same family; it complicates compliance and invites AO scrutiny.
Open an HUF bank account post-PAN allotment with the declaration deed, PAN allotment letter, Karta's Aadhaar, and Karta's specimen signature. Banks typically complete this in 3–7 days. Set up books of account from the first HUF transaction (mandatory if turnover is above ITR threshold; good practice even below). File ITR-2 or ITR-3 as per turnover. Each year, evaluate old regime vs. new regime. From AY 2027-28 new regime is default, but old regime may still benefit if HUF owns life-insurance policies with 80C deductions or Section 24 home-loan interest is high. Keep regime choice consistent unless circumstances materially change.
