India produces over 9 million tonnes of plastic waste annually — making plastic waste management one of the country's most pressing environmental challenges and one of its tightest regulatory regimes. By 2026, the framework anchored in the Plastic Waste Management Rules 2016 and the 2022 amendments has fundamentally restructured the industry through Extended Producer Responsibility (EPR): producers, importers, and brand owners (PIBOs) of plastic packaging are now mandatorily responsible for the end-of-life management of their packaging — through collection, recycling, end-of-life-disposal targets, and audited compliance.

The framework: Plastic Waste Management Rules 2016 + 2022 EPR amendments; CPCB EPR Portal (eprwaste.cpcb.gov.in) for registration, target tracking, certificate transactions; 4 categories of plastic packaging — Category I (rigid plastic), Category II (flexible plastic — single layer, multi-layer), Category III (multi-layered plastic ML/MLP), Category IV (compostable plastic); annual EPR targets escalating year-on-year; Plastic Waste Processors (PWPs) — recyclers, end-of-life disposers, waste-to-energy operators — registered separately to receive plastic waste and issue EPR certificates.

The Plastic Waste Architecture

• Producers, Importers, Brand Owners (PIBOs):: Mandatory EPR Registration on the CPCB portal; annual plastic packaging usage declared; EPR targets year-on-year (Category I: 70% in 2024-25, escalating; Category II / III / IV at varying rates); fulfilment through direct purchase of EPR certificates from registered processors / PROs.

• Plastic Waste Processors (PWPs):: Recyclers, end-of-life disposers, co-processors (cement kilns), waste-to-energy. Authorisation from SPCB; CPCB EPR portal registration; capacity declared; certificates issued for processed waste; compliance with Schedule II ESM SOPs.

• Producer Responsibility Organisations (PROs):: Intermediaries between PIBOs and PWPs; aggregate collection; manage targets on behalf of multiple PIBOs; ensure compliance.

• Recyclers:: Mechanical recycling, chemical recycling, energy recovery — different ESM SOPs; capacity authorisation; output sale of recycled plastic / energy.

Waste Generators (Brand Owners with Plastic Footprint):
Identify packaging used; quantify per category; project EPR target; secure fulfilment route (direct vs PRO).

Key Compliance Deliverables

Annual EPR Plan — submitted to CPCB; Quarterly Returns; EPR Certificate transactions; Annual Compliance Report; Audit / verification of certificate transactions. Non-compliance: penalty under Section 15 EP Act 1986; SPCB / CPCB show-cause; PCB / NGT proceedings.
