When a parent dies intestate and leaves a flat to four children, or when three siblings inherit ancestral land and one wants to step out, or when a co-owner wants to give up her undivided share in favour of the other co-owners โ the instrument that does the job cleanly is a Relinquishment Deed. It is not a sale, not a gift to a stranger, not a partition โ it is a legal heir or co-owner formally releasing her undivided share in favour of the other co-owners, usually for no consideration, in immovable property they hold together.
Done correctly, a Relinquishment Deed is one of the cleanest, fastest and cheapest ways to consolidate title within a family. Done incorrectly โ typed on plain paper, unregistered, signed by some heirs but not others, attempting to relinquish in favour of an outsider โ it creates exactly the title problems it was meant to solve, and shows up as a defect when the property is sold ten years later.
The legal framework: Section 17 of the Registration Act, 1908 makes a Relinquishment Deed of immovable property compulsorily registrable, the State Stamp Schedule under the Indian Stamp Act, 1899 sets the rate (typically 1โ5%, with concessional family rates in Delhi, Maharashtra, Karnataka and several other States), Section 122 of the Transfer of Property Act, 1882 distinguishes a relinquishment from a gift, and Section 56(2)(x) of the Income-tax Act exempts transfers between specified relatives โ which keeps a family relinquishment outside the deemed-income net.

Sale Deed: with consideration, full conveyance stamp duty (5โ7%), Section 194-IA TDS at 1% above โน50 lakh, capital gains tax on the seller.
