Trademark Watch

A registered trademark is not the end of the protection journey — it is the beginning. Once your mark is on the register, every new application filed by anyone else for an identical or similar mark is published in the Trade Marks Journal (issued periodically by the IP India Registry). From the date of journal publication, the world has 4 months under Section 21 of the Trade Marks Act 1999 to oppose the application by filing Form TM-O. If no one opposes, the mark proceeds to registration — and your brand now coexists on the register with a confusingly similar one. The dilution begins. The infringement litigation, if it ever happens, becomes harder. The customs IPR recordal becomes ambiguous. The damage is permanent.

The Registry publishes thousands of new marks every issue across Class 1 to Class 45 of the Nice Classification (12th edition). Manually scanning each issue for similarities to your brand is not realistic. A real trademark watch service automates this — running phonetic, visual, conceptual and identical-mark detection algorithms against every newly published application in your watched classes, flagging hits within days, and giving you the time to decide: file an opposition, send a cease-and-desist, attempt a coexistence agreement, or take no action. The 4-month opposition window is unforgiving. Once it closes, the cheapest defence is gone.

Why Self-Watch Misses the Window

The TM Journal is voluminous — manual review by an in-house team, even if attempted, misses phonetic and conceptual hits. Cross-class confusion is invisible to a single-class watch. The 4-month window from publication to opposition deadline runs in calendar time, not working days, and once missed there is no extension. By the time an infringement is discovered through market presence (often 1-3 years later), the cheapest remedy — opposition — is gone, and you are in court for cancellation under Section 57 or infringement / passing-off litigation. Watch is the lowest-cost insurance for the brand you have already paid to register.
