Hits are identified across four dimensions: identical wordmarks, phonetically similar marks (including transliteration across Indian languages), visually similar devices using Vienna codification for figurative elements, and conceptually equivalent marks. Every hit records the publication date and the opposition deadline so neither is ever estimated.
E-commerce listings, social media handles, app store names, MCA company name registrations, GST trade names, and domain registrations are monitored continuously. Unregistered use that builds consumer goodwill in your mark constitutes passing-off exposure โ the watch flags these for review even where no formal trademark application has been filed.
Each hit is graded: fatal (identical mark, identical class, active confusion in trade), material (similar mark, adjacent class, overlapping consumer base), manageable (similar mark, distant class, low overlap), or low (context too dissimilar to matter). A strategy memo is delivered within 5 working days, documenting the legal grounds, commercial impact, estimated cost of each response option, and a recommended action โ oppose, send a legal warning, enter a coexistence agreement, or ignore.
Where the decision is to oppose, a notice of opposition on Form TM-O is prepared with grounds under the relevant sections โ most commonly Section 11 (relative grounds: similar mark, likelihood of confusion) and Section 9 (absolute grounds: descriptive, deceptive, or non-distinctive). An affidavit of evidence with prior-use documents accompanies the notice. Filing occurs through the IP India portal well within the 4-month Section 21 window, with weeks to spare.
After the notice is filed, the applicant has 2 months to file a counter-statement. Evidence rounds follow โ 2 months for the opponent, 2 months for the applicant, 1 month for reply evidence. A hearing is scheduled, written submissions are filed, and the Registrar issues an order either allowing the opposition (application refused) or dismissing it (application proceeds to registration). Settlement and coexistence discussions can take place at any stage throughout this process.
