Every week the Indian Trade Marks Journal publishes hundreds of new applications — and one could be confusingly close to your brand. You have exactly four months from the publication date to file a notice of opposition under Section 21 of the Trade Marks Act 1999. What's New for FY 2026-27

The trademark landscape has seen meaningful procedural changes heading into FY 2026-27 that affect how oppositions are filed and how watch services operate.

• E-filing mandatory: Form TM-O and all opposition documents are submitted exclusively through the IP India e-filing portal. Physical filings at registry offices are no longer accepted for opposition proceedings.
• Form TM-48 at point of filing: Power of attorney on Form TM-48 must accompany the opposition notice at the time of filing — it cannot be submitted as a subsequent document. Engaging a watch service with attorney-on-record resolves this at onboarding, not at crisis point.
• VC hearings now standard: Opposition hearings before the Trade Marks Registry are conducted via video-conferencing by default, which has shortened scheduling queues and reduced representation costs for brands outside the four registry cities.
• AI-assisted examination: CGPDTM has implemented AI-based phonetic and visual similarity screening during examination, flagging some conflicts earlier in the application pipeline. However, examination objections are not oppositions — a mark can still proceed to registration if objections are overcome, so the watch window remains non-negotiable.
• DPDP Act brand-name implications: Brands in data-product, edtech, and fintech categories should now monitor for applications that intersect with product names implicated by the Digital Personal Data Protection Act 2023, enforcement of which begins in FY 2026-27.

Why Your Brand Needs a Trademark Watch

• Registered marks don't defend themselves: Your registration gives you rights; it does not automatically notify you when a confusingly similar mark is published in the journal. Enforcement is entirely your responsibility.
• The 4-month deadline is absolute: Section 21 provides no extension mechanism and no discretionary relief after the window closes. A missed deadline permanently forecloses the opposition route — leaving cancellation under Section 57 as the only recourse, which is slower and harder to succeed on.
• Phonetic and visual similarity is non-obvious: "Naksha" versus "Naxxa", a device mark in similar colours, a translated concept in a different script — these require expert assessment, not a casual public search, before the clock runs out.
• Online squatting compounds fast: An unregistered user who builds goodwill in your mark over two or more years in a different channel can raise a passing-off defence. Catching them early — before that goodwill accumulates — is materially cheaper than civil litigation.
• Adjacent class filings create surprise flanks: Competitors sometimes register first in a tangential class — Class 35 for retail services, Class 43 for restaurants — and then expand into your core category. Cross-class monitoring closes this gap before it opens.
• Asymmetric information: If your competitor runs a watch service and you do not, they see your new applications before you see theirs. A watch service removes that information disadvantage entirely.

How It Actually Works

The service runs across six stages, from profile setup through prosecution to order.

Step 1: Watch Onboarding & Class Mapping

Your watched portfolio is documented — registered marks, pending applications, key device elements, primary and adjacent classes, geographic scope, and a list of competitors whose filings need priority attention. A watch profile is built and activated within one week. The profile determines which Journal entries trigger an alert and which online channels are monitored on your behalf.

Step 2: TM Journal Scanning

Each issue of the Indian Trade Marks Journal is scanned within days of publication. Hits are identified across four dimensions: identical wordmarks, phonetically similar marks (including transliteration across Indian languages), visually similar devices using Vienna codification for figurative elements, and conceptually equivalent marks. Every hit records the publication date and the opposition deadline so neither is ever estimated.

Step 3: Online & Marketplace Monitoring

E-commerce listings, social media handles, app store names, MCA company name registrations, GST trade names, and domain registrations are monitored continuously. Unregistered use that builds consumer goodwill in your mark constitutes passing-off exposure — the watch flags these for review even where no formal trademark application has been filed.

Step 4: Hit Grading & Strategy Memo

Each hit is graded: fatal (identical mark, identical class, active confusion in trade), material (similar mark, adjacent class, overlapping consumer base), manageable (similar mark, distant class, low overlap), or low (context too dissimilar to matter). A strategy memo is delivered within 5 working days, documenting the legal grounds, commercial impact, estimated cost of each response option, and a recommended action — oppose, send a legal warning, enter a coexistence agreement, or ignore.

Step 5: Opposition Filing on Form TM-O

Where the decision is to oppose, a notice of opposition on Form TM-O is prepared with grounds under the relevant sections — most commonly Section 11 (relative grounds: similar mark, likelihood of confusion) and Section 9 (absolute grounds: descriptive, deceptive, or non-distinctive). An affidavit of evidence with prior-use documents accompanies the notice. Filing occurs through the IP India portal well within the 4-month Section 21 window, with weeks to spare.

Step 6: Prosecution to Registrar's Order

After the notice is filed, the applicant has 2 months to file a counter-statement. Evidence rounds follow — 2 months for the opponent, 2 months for the applicant, 1 month for reply evidence. A hearing is scheduled, written submissions are filed, and the Registrar issues an order either allowing the opposition (application refused) or dismissing it (application proceeds to registration). Settlement and coexistence discussions can take place at any stage throughout this process.

A Real Example: Spice Brand vs. Adjacent-Class Applicant

Consider a mid-sized spice brand — registered in Class 30 (spices, condiments, sauces) — that has a trademark watch in place.

• Journal hit in month 1: A new application, "Naksha", is published in Class 29 (processed foods, edible oils) by a Rajasthan-based competitor — phonetically identical to the brand's registered mark "Naksha" in Class 30.
• Hit grade: Material. Identical wordmark. Adjacent class with shared retail distribution channels. Significant likelihood of consumer confusion, particularly in general trade outlets.
• Strategy memo recommendation: Oppose on Section 11 grounds — prior registration in a related class, identical wordmark, established and overlapping trade channels, and documented prior commercial use from 2019.
• Opposition filed: Notice of opposition with evidence affidavit — sales invoices, advertising spend records, retailer testimonials — submitted in month 2 of the 4-month window, with six weeks remaining.
• Outcome: The applicant agreed in post-filing discussions to restrict the mark to edible oils in three northern states only, with a formal coexistence deed. The opposition was withdrawn on signed and registered terms.

The watch caught the hit 48 days after publication. The strategy memo was ready in 5 days. Without a watch, this brand would have discovered the conflict at the point of market confusion — well after registration and well after the opposition window had permanently closed.

After Filing: Stages in Opposition Prosecution

Filing the notice of opposition begins the prosecution timeline. Each stage has a fixed statutory period under the Trade Marks Rules 2017.

• Counter-statement: The applicant has 2 months from service of the opposition notice to file a counter-statement under Rule 46. Failure to file a counter-statement within time means the opposition is treated as having succeeded automatically.
• Opponent's evidence: Within 2 months of receiving the counter-statement, you file evidence in support of the opposition — affidavits of prior use, sales invoices, advertising expenditure records, and consumer surveys where relevant.
• Applicant's evidence: The applicant then has 2 months to file evidence in support of the application. You receive this material and analyse it to identify weaknesses for the reply round.
• Reply evidence: A further 1-month window is available for the opponent's reply affidavit, addressing specific claims raised in the applicant's evidence.
• Hearing & order: A hearing date is fixed — now typically via video-conferencing. Both sides present oral arguments and file written submissions. The Registrar's order either allows the opposition (application refused) or dismisses it (application proceeds to registration).
• Appeal route: An adverse Registrar's order can be appealed to the relevant High Court under Section 91 of the Trade Marks Act 1999 within 3 months of the order date. Appeals add 18-36 months to the overall matter.

Where It Goes Wrong

Most lost oppositions — and most missed opportunities to file one — come down to the same repeating errors.

• Relying on public search only: IP India's public search does not notify you when a new application is published in your class. It is a lookup tool, not a watch service — you have to know to look, and to look at every issue, within days of publication.
• Watching only your exact class: A competitor filing in Class 35 (retail services) or Class 43 (restaurant services) can threaten a Class 30 food brand. Adjacent class monitoring is not optional for brands with broad consumer recognition.
• Ignoring phonetic and device similarity: "Faida" and "Fayde", two logos in matching colours with similar figurative elements — these escape a wordmark-only keyword search but constitute confusion in trade on the Section 11 test.
• Slow internal approval chains: Waiting 3-4 weeks for a senior stakeholder to approve the opposition decision burns the window from the inside. The strategy memo needs to reach decision-makers within days of the hit, not weeks.
• Filing without use evidence: A notice of opposition filed without an accompanying affidavit of prior use is treated as a bare notice and carries minimal weight at the evidence stage. The Registrar expects documentary evidence from the date use is claimed.
• Missing Form TM-48: Form TM-O filed without a contemporaneous Form TM-48 (power of attorney) is treated as defective under current IP India portal rules. The opposition may not be formally recorded, and the window is lost.
• Informal coexistence: A phone call or email understanding with an applicant to stay out of your market has no standing before the Registry. Settlement must be in a formal coexistence deed with proper execution and, where appropriate, registry notification.

The opposition window does not pause for internal approvals. Build your decision chain before the hit arrives, not after.
