Transit Bail Application

Transit bail is the protective remedy you reach for when an FIR has been registered against you in a distant State and you need to travel — to surrender, to file substantive anticipatory bail, to attend a court date, or to handle the underlying matter — without the risk of being arrested at the airport, the railway station, or any inter-State checkpoint along the way. It is a temporary order from a court in the State where you are located, granting bail in the event of arrest, valid for a limited window (typically 2-6 weeks), to enable safe travel to the State where the offence is registered.

The remedy now sits in Section 482 of the Bharatiya Nagarik Suraksha Sanhita 2023 (BNSS) — the same provision as anticipatory bail, with the additional dimension of inter-State protection. The Supreme Court in Priya Indoria v. State of Karnataka (2024) conclusively settled the long-debated question of jurisdictional competence, holding that High Courts and Sessions Courts have territorial competence to grant transit anticipatory bail even when the FIR is registered in another State, provided the applicant has a connection to the local jurisdiction (residence, employment, or temporary stay) and is at imminent risk of arrest. The earlier Sushila Aggarwal Constitution Bench (2020) framework on anticipatory bail extends to transit applications.

When You Need Transit Bail

• Distant FIR with No Local Counsel:: FIR registered in a State where you have no local connection or counsel; transit bail in your home State buys time to engage substantive counsel and file substantive anticipatory bail in the FIR State.

• Imminent Travel for Court / Surrender:: You need to travel to the FIR State within days for a court appearance, surrender on warrant, or to file the substantive bail application in person — transit bail eliminates airport / station arrest risk.

• Multiple FIRs Across States:: Where the same allegations are filed across multiple States (common in cheque dishonour, financial fraud, matrimonial vendetta) — transit bail consolidates protection while a Section 406 BNSS transfer / consolidation petition is pursued.

• Look-Out Circular Risk:: LOC may have been issued; transit bail with a specific prayer to address LOC at the airport — the IO is bound to honour the order.

• NRI Returning to India:: NRI with FIR risk on Indian soil; transit bail combined with anticipatory bail filed before return; airport arrest pre-empted.

The Anatomy of a Strong Transit Bail Petition

• Local Connection:: Residence, employment, business, or genuine temporary stay in the State where the petition is filed — anchored to documents (Aadhaar, rent agreement, employment letter, hotel booking).

• Reasonable Apprehension of Cross-State Arrest:: FIR copy, summons, witness statement, social-media announcement, or specific intelligence — the apprehension must be concrete and provable.

• Specific Travel Plan:: Date, mode, route, purpose of travel; without specifics the petition is treated as fishing.

• Substantive Bail Strategy:: Demonstrated intent to file substantive anticipatory bail in the FIR State; transit bail is a bridge, not a destination.

• Conditions Offered:: Cooperation with investigation, surrender of passport (or not, with reasons), no contact with witnesses, intimation to IO of travel — pre-empting State opposition.

• Validity Period Sought:: Typically 4-6 weeks; sufficient to file substantive anticipatory bail and obtain it in the FIR State.

Why Transit Bail Matters in 2026

Inter-State arrest enforcement has digitised. NCRB's CCTNS database links FIR records across States; airport e-gates flag travellers with active warrants; railway and road check-points access central databases. By the time you discover an FIR, the arrest infrastructure to act on it is already in place. Transit bail is the only remedy that lets you move while you defend.
