What's New for FY 2026-27

The way Indians get legal and tax advice has shifted sharply in the last two years. A few procedural and statutory updates change what a good virtual consultation now covers.

• DPDP Act in force: The Digital Personal Data Protection Act is fully operational; document-sharing portals and consultation records now have to meet specified safeguards around consent, retention, and breach reporting.
• New tax regime default: For FY 2026-27 (AY 2027-28), the new income tax regime is the default — consultations on personal tax planning, salary structuring, or NRI returns work from this baseline unless an opt-out is filed.
• Form 10F mandatory e-filing: For NRIs claiming treaty benefits, Form 10F is e-file only; virtual consultations often cover this together with the linked Tax Residency Certificate, Section 195, and Rule 37BB position.
• IMS live on the GST portal: The Invoice Management System changes how input tax credit is accepted, rejected, or kept pending — reviewing supplier contracts now includes IMS-related clauses.
• Companies Act updates: MCA V3 portal is stable, dematerialisation is mandatory for non-small companies, and directors' duties under Section 166 of the Companies Act 2013 are being read more strictly by NCLTs.

How It Actually Works

There is no mystery to the process. Every step has a defined output, and the fee covers the whole flow — not just the minutes on the call.

Step 1: Booking and document upload

You choose a 30, 60, or 90-minute slot through the booking form. Documents — contract, deed, notice, court paper, supporting correspondence — are uploaded through a secure portal. A short written description of your questions and the decision points you want addressed goes with them.

Step 2: Practitioner assignment

Your matter is reviewed and assigned to an advocate, a Chartered Accountant, or both — depending on the subject. Advocates cover litigation, contracts, family, criminal, and civil matters; CAs cover income tax, GST, audit, and financial advisory; both are assigned for cross-domain matters like M&A, NRI property sales, or transactions with tax and legal sides.

Step 3: Pre-call document review

Before the call, the practitioner reads the papers, marks key clauses and risk areas, and prepares the points to walk through with you. This is typically 30 to 60 minutes of preparation, included in the fee. The call begins with the practitioner already knowing your facts.

Step 4: Live video consultation

The session runs on Zoom, Google Meet, or Microsoft Teams for the slot length booked. The practitioner walks through the document, the options available to you, recommended next steps, and the specific questions you raised. The session is not recorded by default; if you want a recording for your files, ask in advance and the setup is done.

Step 5: Written notes

Within two working days of the call, a written summary is emailed to you. It captures the advice given, the risks identified, the clauses to watch, and the recommended next step. This is the document you forward to a co-founder, CFO, family member, or board — and the one you reread weeks later when memory has faded.

Step 6: Follow-up email round

One round of follow-up clarifications by email is included in the fee. Use it to ask the meaning of a clause, confirm a number, or check whether a draft reply you have written matches the advice given on the call.

Step 7: Engagement path if required

If the consultation reveals that you need drafting, registration, court representation, or a multi-month project, a clear scope and quote is issued separately. There is no high-pressure conversion and no surprise billing — the consultation stands on its own and the engagement decision is yours.

A Real Example: NRI Property Sale Consultation

An NRI based in Dubai held inherited residential property in Bengaluru. A buyer offered ₹3.6 crore. The seller wanted to know how much would actually reach his NRO account, what TDS the buyer would deduct, and whether the lower-deduction certificate route was worth pursuing.

• Documents reviewed: Sale agreement draft, the inherited property's title chain, the seller's PAN and Tax Residency Certificate, and the prior CA's email opinion.
• Pre-call review time: Around 50 minutes — the practitioner cross-checked Section 195 read with Rule 37BB and the Form 13 lower-deduction application route.
• Call length: 60 minutes — covered TDS at the default rate of 12.5% LTCG plus surcharge and cess on the full sale value, the reduced rate available under a Form 13 certificate, the Form 15CA and 15CB requirement for repatriation, and the USD 1 million annual NRO cap.
• Written notes deliverable: An eight-page summary covering tax on the transaction, the Form 13 application timeline, exemption available under Section 54 or 54EC if reinvestment was chosen, and the bank documents needed for repatriation.

The seller decided to apply for the Form 13 lower-deduction certificate. That single decision freed up close to ₹38 lakh in working capital during the transaction, against a consultation fee that was a small fraction of that figure.

What You Can Do With the Written Notes

The notes are written to be useful well beyond the call itself.

• Take a clean decision: Sign, refuse, negotiate, reply to the regulator, file the response, or hold off — with the reasoning written down.
• Share with stakeholders: Notes are drafted in plain language and are suitable for forwarding to co-founders, family members, or the finance team without further translation.

Where It Goes Wrong

• Booking the slot too late: Documents need at least one full working day for pre-call review; same-day calls cut into preparation time and dilute the value of the slot.
• Uploading partial documents: Sending only the contract but not the prior correspondence, side letters, or earlier drafts often leads to advice that misses the real risk.
• Treating the call as a transcript dump: The call is for advice, not for the practitioner to read out clauses aloud that you have already read yourself.
• Mixing too many matters into one slot: A 60-minute slot can cover one matter well or three matters poorly — pick a slot length that matches the agenda.
• Confusing consultation with engagement: Consultation gives advice and direction; if action like filing, drafting, or court appearance is needed, that is a separate engagement with its own scope.
• Ignoring the written notes: The notes are the deliverable — they are the document that holds up months later when the memory of the call has faded.
• Mismatching the practitioner to the question: Asking a CA to handle litigation strategy or an advocate to handle GST input credit calculations rarely ends well; match the practitioner to the matter.

If the matter calls for full engagement, the scope and quote are shared separately — there is no obligation to move to engagement, and the consultation stands on its own.
