Who pays stamp duty โ€” buyer or seller?+
By default, the buyer pays stamp duty. By contract, parties can agree otherwise but the registration cannot complete until duty is paid. Both parties are jointly liable in case of evasion.
Is stamp duty deductible from income tax?+
Yes โ€” stamp duty paid on first-time home purchase is deductible u/s 80C (within the โ‚น1.5L cap), only under the OLD regime. For investment properties, it adds to cost of acquisition for capital gains computation.
