Why is stamp duty so different across states?+
Stamp duty is a state subject under the Constitution. Each state's revenue department fixes its own rates. Maharashtra has multiple sub-rates (Mumbai/Pune/Rest), Delhi varies by gender, and Karnataka has slabs by property value.
Who pays stamp duty โ buyer or seller?+
By default, the buyer pays stamp duty. By contract, parties can agree otherwise but the registration cannot complete until duty is paid. Both parties are jointly liable in case of evasion.
Is stamp duty deductible from income tax?+
Yes โ stamp duty paid on first-time home purchase is deductible u/s 80C (within the โน1.5L cap), only under the OLD regime. For investment properties, it adds to cost of acquisition for capital gains computation.
