Court Marriage Certificate

A marriage certificate is no longer a sentimental document. By FY 2026-27 it is the foundation document for joint bank accounts, spouse visa applications, dependent passport endorsement, immigration paperwork, insurance nominations, property transfers, hospital next-of-kin authority, and inheritance. The Supreme Court's 2006 direction in Seema v. Ashwani Kumar for compulsory registration of marriages — now legislated in most States — has converted the certificate from optional to operationally essential.

Two distinct legal routes lead to a marriage certificate in India. The Special Marriage Act 1954 — the secular, civil-marriage statute — applies where the parties are of different faiths, where the parties are of the same faith but choose a civil ceremony, or where one or both parties are foreign nationals. The Hindu Marriage Act 1955 (and equivalent personal-law statutes — Christian Marriage Act, Parsi Marriage and Divorce Act, the Indian Muslim Marriages Act-equivalent registration framework) applies to ceremonial marriages under the respective personal law, with subsequent registration under State rules. The Foreign Marriage Act 1969 covers Indian citizens marrying abroad.

Special Marriage Act 1954 — The Civil Marriage Route

• Section 4 — Conditions:: Neither party has a living spouse; both are of sound mind and capable of giving valid consent; male is 21 or older, female is 18 or older (parties are also subject to any State amendment raising the female age, where applicable); they are not within prohibited degrees of relationship except where custom permits.

• Section 5 — Notice of Intended Marriage:: Written notice in the prescribed form to the Marriage Officer of the district where at least one party has resided for not less than 30 days immediately preceding the notice. The Marriage Officer publishes the notice (online portal in most States in 2026) and a paper notice on the office board.

• 30-Day Notice / Objection Period:: Any person can object within 30 days of publication on grounds that the marriage would contravene Section 4 conditions. The Marriage Officer enquires into objections; baseless objections are dismissed within 30 days; sustainable objections proceed to enquiry. The Supreme Court in Safiya Sultana (2021) upheld the optional nature of public notice display where parties elect privacy — practice varies by State.

• Section 12 — Solemnisation:: After 30 days from notice (and disposal of any objection), the marriage is solemnised by the Marriage Officer in the office or any reasonable place; three witnesses sign; declaration is read; certificate is issued under Section 13. The certificate is conclusive evidence of the marriage.

Hindu Marriage Act 1955 — Registration of a Ceremonial Marriage

Section 5 conditions (eligibility), Section 7 ceremonies (saptapadi where customary), and Section 8 registration. The marriage is solemnised through the customary ceremony; registration is then done before the Sub-Registrar / Registrar of Marriages of the district. State-level rules (Delhi, Maharashtra, Karnataka, Tamil Nadu, etc.) prescribe the form, fee, witnesses, and timeline. Online appointment systems are operational across most metros in 2026.

Inter-Faith, Inter-State, NRI and Foreign National Marriages

• Inter-Faith Marriage:: Special Marriage Act is the standard route — neither party converts; both retain their faith; marriage is civil. State-level interventions on inter-faith conversions (in Madhya Pradesh, Uttar Pradesh, Karnataka and others) impose additional declarations / scrutiny where conversion is involved; SMA marriage without conversion is unaffected.

• Inter-State Marriage:: Notice can be given to the Marriage Officer of either party's district of residence (30-day prior residence requirement). The certificate issued is valid across India.

• NRI / Foreign National Marriage:: Special Marriage Act covers marriages where one or both parties are foreign nationals — additional documentation: passport, valid visa, certificate of no impediment to marriage from the foreign embassy, single-status / unmarried affidavit notarised and apostilled, photographs. Post-marriage, certificate apostille / MEA attestation is essential for use abroad.

• Foreign Marriage Act 1969:: Indian citizens marrying abroad — at the Indian Mission / Consulate. Same 30-day notice framework, with the Marriage Officer being the diplomatic / consular officer.

Use of the Certificate Post-Marriage

Joint bank accounts; spouse-name addition to passport (or fresh passport with spouse name); dependent visa applications; PAN / Aadhaar / driving licence updation; insurance nomination; property mutation; gratuity / EPF nomination; succession certificate basis.
