The moment of arrest changes everything. The accused loses freedom, family loses access, employment loses certainty, and reputation enters a public-record state from which there is no easy return. The legal architecture for post-arrest release in India is now Section 480 of the Bharatiya Nagarik Suraksha Sanhita 2023 (BNSS) โ replacing the earlier Section 437 / 439 CrPC. Read with Section 187 BNSS (default bail on completion of investigation period without chargesheet), Section 482 BNSS (anticipatory bail), and the special-statute regimes under PMLA Section 45, NDPS Section 37, UAPA Section 43D(5), POCSO, and SC-ST Act, the post-arrest landscape is bail-friendly in routine offences, bail-difficult in special-law cases, and bail-impossible only in narrow categories.
The Supreme Court in Satender Kumar Antil v. CBI (2022) laid out a graded framework on bail in different offence categories, severely criticised reflexive arrest and undertrial pendency, and directed that arrest is the exception, not the rule. Pankaj Bansal v. Union of India (2023) tightened arrest procedure under PMLA โ written grounds of arrest are now a constitutional precondition. Senthil Balaji v. Directorate of Enforcement (2023) scoped ED's custodial powers. Achin Gupta v. State of Haryana (2024) reinforced restraint in dowry / matrimonial arrests. By 2026, every regular bail application stands on this evolving constitutional foundation.
