Criminal Trial Defence

A criminal case does not start in court — it starts the moment an FIR is registered or a chargesheet lands. Every hearing after that either tightens the noose or loosens it, and the difference is usually not eloquence in final arguments. It is the quiet work done early: the right discharge application, the right objection to a Section 65B BSA certificate, the right contradiction logged during cross-examination.

Since 1 July 2024, criminal trials in India run on three new codes — the Bharatiya Nyaya Sanhita (BNS), the Bharatiya Nagarik Suraksha Sanhita (BNSS), and the Bharatiya Sakshya Adhiniyam (BSA). Old IPC and CrPC reasoning still surfaces in courts, but a defence built on obsolete sections is a defence that opposing counsel will dismantle. You need counsel who has rebuilt the playbook for the new codes.

What's New for FY 2026-27

The new codes are no longer fresh — they are now the standard framework, and the procedural details that were uncertain in 2024 have been clarified by High Courts through the last 18 months. A defence strategy must reflect that.

• BNSS timelines now enforced: Section 258 mandates judgment within 30 days of arguments (extendable to 45). Section 251 sets framing-of-charge within 60 days of first hearing. Courts increasingly hold the prosecution to these clocks.
• Electronic FIR (e-FIR) and zero FIR: Section 173 BNSS recognises both. Defence must scrutinise jurisdiction transfer and the original time of registration — delays now leave a paper trail.
• Forensic visit compulsory above 7 years: Section 176(3) BNSS requires forensic team attendance for offences punishable with 7 years or more. Absence of the forensic report or visit log is a serious prosecution gap.
• Video recording of searches and statements: Sections 105 and 180 BNSS make video recording of seizures and witness statements the norm. Missing or doctored recordings open Section 65B BSA challenges.
• Trial in absentia for proclaimed offenders: Section 356 BNSS permits trial without the accused if declared proclaimed and absconding for 90 days. Counter-strategy is to surface and move recall promptly.
• Plea bargaining widened: Sections 289-300 BNSS expand eligibility and process. For mid-range offences with weak defences, this is a real exit route, not a last resort.

Why Strategy Beats Volume in Criminal Trials

Most criminal trials are lost not because the prosecution is strong, but because the defence is reactive — showing up, cross-examining, objecting in the moment. A planned defence inverts that.

• Discharge is the first real test: If the chargesheet does not disclose the ingredients of the offence, you should never be on trial. Section 250 BNSS discharge is a written application, not a passing argument.
• Cross-examination needs a script: Random questions help the prosecution. A scripted cross extracts the contradictions that the final argument will weaponise — and nothing more.
• Electronic evidence decides modern trials: CCTV, WhatsApp, call records, location pings. Each one needs a Section 65B BSA certificate from the right custodian. Defective certificates collapse the prosecution case.
• Witness gaps matter more than witness presence: Who the prosecution did NOT examine — the independent panch, the second eyewitness — is often a stronger defence than attacking those who deposed.
• Sentencing is a separate battle: If conviction is likely, mitigation, prior conduct, and Section 393 BNSS framing of sentence can mean the difference between custody and a fine.
• Bail and appeal are continuous: Sections 480, 482, 483 BNSS for bail; Section 430 for suspension of sentence; appeal memorandum filed within 30 days of conviction. One team, no handovers.

How It Actually Works

Step 1: Confidential Brief, Vakalatnama and Intake (1-2 Days)

Vakalatnama is filed, the case file is opened, and conflict checks are completed. Everything from this point is privileged.

Step 2: Case Theory and Strategy Memo (3-7 Days)

We prepare a written defence narrative — a single coherent story that every motion, cross, and argument will support. Alongside it sits a contradictions chart (prosecution statement A vs B vs FIR vs chargesheet), a witness analysis, and a motions roadmap.

You sign off on the strategy memo before any application is filed. Nothing surprises you in court.

Step 3: Pre-Trial Motions (Ongoing through First 90 Days)

Discharge under Section 250 BNSS if the chargesheet is weak. Quashing under Section 528 BNSS in the High Court for FIRs that are mala fide or do not disclose offences. Bail applications, recall of witness, production of documents, and forensic re-examination — each filed at the right tactical moment.

Often, the case never reaches evidence stage. That is the goal of this phase.

Step 4: Cross-Examination of Prosecution Witnesses

When trial begins, each prosecution witness is cross-examined against a pre-drafted script aligned to the case theory. Section 65B BSA objections are raised before electronic evidence is exhibited. Panchnama contradictions, Investigating Officer omissions, and medico-legal gaps are logged for final argument.

Step 5: Accused Statement and Defence Evidence

The Section 351 BNSS statement (formerly Section 313 CrPC) is drafted with care — every incriminating circumstance the court puts to you needs a calibrated answer. A casual statement here loses cases that were otherwise winnable.

Defence witnesses are then examined; expert opinions (forensic, handwriting, digital) are introduced; a written statement is filed.

Step 6: Final Arguments, Judgment and Appeal

Written submissions and oral arguments tie every contradiction to a legal proposition. If acquittal follows, the order is delivered and we monitor for any State appeal.

If conviction follows, we move immediately for suspension of sentence under Section 430 BNSS, file the criminal appeal to High Court within 30 days, and continue the same case theory at the appellate stage.

A Real Example: A Sessions Trial Defended on Electronic Evidence

Consider an accused facing trial under Sections 318 (cheating) and 336 (forgery) BNS, where the prosecution relies heavily on WhatsApp chats and a recovered laptop.

• Charge: Cheating ₹42 lakh through forged email correspondence with the complainant. Maximum punishment 7 years.
• Prosecution evidence: WhatsApp screenshots from complainant's phone, mirrored emails, and a laptop seized from accused's office allegedly containing draft forgeries.
• Defence move 1: Section 65B BSA certificate for WhatsApp screenshots issued by complainant himself, not by a person in lawful control of the relevant device server. Objection logged.
• Defence move 2: Hash value of seized laptop image at FSL did not match the hash value at the time of seizure panchnama. Chain of custody broken.
• Defence move 3: Section 351 BNSS statement explained legitimate business correspondence; defence expert produced original email headers showing IP origin outside the accused's premises.
• Outcome: Court held electronic evidence inadmissible for non-compliant Section 65B certificates. Without the electronic chain, the cheating ingredient could not be proved beyond reasonable doubt. Acquittal.

The case was not won in final arguments. It was won the day the Section 65B BSA objection was framed in writing, before the prosecution exhibit went on record.

Almost every modern criminal trial turns on electronic evidence. The Section 65B BSA certificate is the single point at which a strong prosecution can collapse — and a weak defence can hand over a conviction.

What Backs Up Each Stage of the Defence

Where Criminal Defences Go Wrong

Most preventable losses come from a small set of recurring mistakes. We see them often enough to list them.

• Skipping the discharge stage: Counsel treats charge-framing as a formality. A written Section 250 BNSS application, well argued, ends many cases before evidence begins.
• No case theory: Each hearing is improvised. Contradictions extracted in cross are forgotten by final arguments because no one wrote them down.
• Late Section 65B BSA objections: Objection raised at final arguments rather than at the point of exhibit. By then, courts are reluctant to revisit admissibility.
• Casual Section 351 BNSS statement: Accused is sent in unprepared. Answers like 'I don't know' to incriminating circumstances are treated as evasion and used against you.
• Ignoring witness gaps: Defence attacks who deposed instead of highlighting who did not — the missing independent panch is often the strongest reasonable-doubt argument.
• No sentencing preparation: If conviction looks likely, mitigation evidence must be ready on the day of judgment, not collected after.
• Missing the appeal window: Criminal appeal must be filed within 30 days of conviction. Suspension of sentence under Section 430 BNSS is moved alongside. Delay means custody.
• Wrong forum for quashing: Section 528 BNSS quashing lies in High Court, not Sessions. Filing in the wrong forum wastes months.
