A criminal case does not start in court โ it starts the moment an FIR is registered or a chargesheet lands. Every hearing after that either tightens the noose or loosens it, and the difference is usually not eloquence in final arguments. It is the quiet work done early: the right discharge application, the right objection to a Section 65B BSA certificate, the right contradiction logged during cross-examination.
Since 1 July 2024, criminal trials in India run on three new codes โ the Bharatiya Nyaya Sanhita (BNS), the Bharatiya Nagarik Suraksha Sanhita (BNSS), and the Bharatiya Sakshya Adhiniyam (BSA). Old IPC and CrPC reasoning still surfaces in courts, but a defence built on obsolete sections is a defence that opposing counsel will dismantle. You need counsel who has rebuilt the playbook for the new codes.
The new codes are no longer fresh โ they are now the standard framework, and the procedural details that were uncertain in 2024 have been clarified by High Courts through the last 18 months. A defence strategy must reflect that.
Most criminal trials are lost not because the prosecution is strong, but because the defence is reactive โ showing up, cross-examining, objecting in the moment. A planned defence inverts that.

We start with a closed-door briefing. You walk us through the case in your words, and we review the FIR, chargesheet, statements, panchnama, prior bail orders, and any forensic reports. We prepare a written defence narrative โ a single coherent story that every motion, cross, and argument will support. Alongside it sits a contradictions chart (prosecution statement A vs B vs FIR vs chargesheet), a witness analysis, and a motions roadmap.
You sign off on the strategy memo before any application is filed. Nothing surprises you in court.
Discharge under Section 250 BNSS if the chargesheet is weak. Quashing under Section 528 BNSS in the High Court for FIRs that are mala fide or do not disclose offences. Bail applications, recall of witness, production of documents, and forensic re-examination โ each filed at the right tactical moment.
Often, the case never reaches evidence stage. That is the goal of this phase.
When trial begins, each prosecution witness is cross-examined against a pre-drafted script aligned to the case theory. Section 65B BSA objections are raised before electronic evidence is exhibited. Panchnama contradictions, Investigating Officer omissions, and medico-legal gaps are logged for final argument.

The Section 351 BNSS statement (formerly Section 313 CrPC) is drafted with care โ every incriminating circumstance the court puts to you needs a calibrated answer. A casual statement here loses cases that were otherwise winnable.
Defence witnesses are then examined; expert opinions (forensic, handwriting, digital) are introduced; a written statement is filed.
Written submissions and oral arguments tie every contradiction to a legal proposition. If acquittal follows, the order is delivered and we monitor for any State appeal.
If conviction follows, we move immediately for suspension of sentence under Section 430 BNSS, file the criminal appeal to High Court within 30 days, and continue the same case theory at the appellate stage.
Consider an accused facing trial under Sections 318 (cheating) and 336 (forgery) BNS, where the prosecution relies heavily on WhatsApp chats and a recovered laptop.
