Overview of Criminal Trial Defence

A criminal trial decides whether a person walks free or loses liberty. Since 1 July 2024 the trial framework in India has changed fundamentally — the Bharatiya Nyaya Sanhita 2023 (BNS) has replaced the IPC, the Bharatiya Nagarik Suraksha Sanhita 2023 (BNSS) has replaced the CrPC, and the Bharatiya Sakshya Adhiniyam 2023 (BSA) has replaced the Evidence Act. By FY 2026-27, almost every fresh trial is being conducted under the new codes, with strict timelines, mandatory electronic evidence handling, and zero-FIR / e-FIR procedures now operational across most states.

FAQs for Criminal Trial Defence

Trials for offences committed before 1 July 2024 continue under the IPC and CrPC. Offences committed on or after 1 July 2024 are tried under the BNS, BNSS, and BSA. Many courts now run mixed dockets, so the procedural code applied depends on the date of the alleged offence.

Yes. The accused can move for discharge under Section 250 BNSS at the framing-of-charge stage, or seek quashing under Section 528 BNSS read with Article 226 of the Constitution before the High Court if the FIR/chargesheet does not disclose any offence.

Almost every modern prosecution relies on electronic evidence — CCTV, call records, WhatsApp chats, emails, CDR. Without a valid Section 65B BSA certificate from the person in lawful control of the device, the electronic evidence is inadmissible. Many convictions have been reversed on this single ground.

BNSS sets internal timelines — judgment within 30/45 days of arguments, prosecution evidence within 30 days of charges, and so on — but actual durations remain 12–24 months for most Sessions trials due to court load. Special courts (NDPS, PMLA, POCSO) sometimes move faster.

Yes. Section 430 BNSS empowers the appellate court to suspend the sentence and grant bail pending appeal. We routinely move suspension applications immediately after conviction, supported by the appeal memorandum.
