Environmental Clearance (EC)

Environmental Clearance (EC) is the prior approval issued by the Ministry of Environment, Forest and Climate Change (MoEF&CC) for Category A projects, and by the State Environment Impact Assessment Authority (SEIAA) for Category B projects, under the EIA Notification 2006. EC is mandatory before commencing construction / operation of specified projects — manufacturing, mining, infrastructure, thermal / hydro power, oil & gas, large building / townships, ports / shipyards, and many more listed in the EIA Schedule.

By 2026, the EC process operates entirely through PARIVESH 2.0 — single-window portal for environmental, forest, wildlife, and CRZ clearances. The process flows: Form 1 / Pre-Feasibility Report → ToR (Terms of Reference) → Baseline Studies → EIA Report → Public Consultation → EAC / SEAC Appraisal → EC Issuance → Post-EC Compliance.

Project Categories Requiring EC

• Category A (Central / MoEF&CC):: Large-scale projects — mining, thermal power, oil & gas refining, petrochemicals, ports, airports, large irrigation, nuclear, large CETP / hazardous-waste TSDF, certain primary metallurgy, isolated storage of hazardous chemicals.

• Category B1 (State / SEIAA — Full EIA):: Medium-scale projects — building / construction above 1,50,000 sqm built-up, smaller industrial units, smaller mining, township projects.

• Category B2 (State / SEIAA — Limited or No EIA):: Smaller projects with reduced scrutiny; some categories exempt from public hearing.

What Determines EC Timeline & Outcome

Categorisation Accuracy: Wrong categorisation causes months of delay or wrong-jurisdiction filings.

ToR Comprehensiveness: ToR specifies baseline-study scope; comprehensive ToR upfront prevents EAC questions later.

Baseline Data Quality: 4-season ambient air monitoring is the binding timeline constraint; other studies (water, ecology, socio-economic) parallel.

Public Hearing Conduct: District Magistrate / SPCB-led; documented submissions; report quality determines EAC questions.

EIA Report Quality: Cumulative impact, transboundary impact, alternatives analysis, EMP credibility, RA depth.

EAC / SEAC Defence: Presentation, technical clarifications, condition negotiation.

Post-EC Compliance

Half-Yearly Compliance Reports: Submitted to MoEF&CC RO / SPCB on PARIVESH; comprehensive compliance against EC conditions.

Periodic Inspection: SPCB / MoEF&CC RO inspections during construction and operation; compliance gaps trigger show-cause notices.

Modification / Amendment: Where project parameters change (capacity, technology, location), EC modification application required.

Validity & Extension: EC typically valid for 7 years (mining 30 years, depending on project); construction must commence within 5 years; extension applications where needed.
