Environmental Clearance (EC)

If your project is a new cement plant, a mining lease, a highway expansion, a thermal power unit, a large township, or any of the dozens of activities listed in the EIA Notification 2006, you cannot turn the first sod of earth without an Environmental Clearance (EC). The clearance is not a formality. It is a structured 12-24 month process that touches Form 1, baseline data across four seasons, an EIA report, a public hearing in the affected district, and a defence before the EAC or SEAC.

• Post-EC: Half-yearly compliance reports on PARIVESH plus periodic SPCB and MoEF&CC Regional Office inspections.

What's New for FY 2026-27

The EC regime has tightened around digital workflow, audit trails and post-clearance accountability. A few changes are worth tracking before you file.

• PARIVESH 2.0 is fully entrenched: All EC, forest, wildlife and CRZ proposals are filed, tracked and disposed on the unified portal. Geo-tagged project boundaries, KML uploads and digital signatures of accredited EIA consultants are now mandatory.
• NABET accreditation enforcement: Only QCI-NABET accredited EIA consultants in the relevant sector and category can sign Form 1, the EIA report and the EMP. Form 1s signed by non-accredited consultants are routinely returned.
• Tighter post-EC monitoring: Half-yearly compliance reports must be uploaded on PARIVESH with photographic evidence, monitoring data and third-party validation. The MoEF&CC Regional Office cross-checks reports against SPCB stack and ambient data.
• Standard ToR updates: Sector-specific standard ToRs have been revised for mining, cement, building/construction and highways — pre-feasibility content, traffic studies and risk assessment chapters now have prescribed depth.
• NGT scrutiny on shortcuts: Recent National Green Tribunal orders have struck down ECs granted without proper public hearings or with truncated baselines. Compressed timelines invite litigation.
• Climate and biodiversity overlays: EIA reports now routinely include climate-change vulnerability assessment, carbon footprint accounting and biodiversity management plans aligned with the Biological Diversity Act.

Why You Cannot Skip the EC Route

Many promoters arrive after talking to a CFE consultant who told them "just file CFE/CFO". That advice works for small units. For listed projects, EC is a separate and prior requirement.

• Statutory bar on construction: Section 3 of the Environment (Protection) Act read with the EIA Notification prohibits commencement of any listed activity without a prior EC. Construction started without EC is unauthorised and routinely halted by SPCB or NGT.
• Lender and investor diligence: Banks, NBFCs and private equity will not disburse term loans for listed projects without a valid EC in place. Even green-channel infra debt funds insist on it.
• Land-use and statutory approvals: State industrial promotion authorities, port trusts, mining departments and town planners increasingly ask for the EC letter before issuing their own NOCs or lease deeds.
• Tender qualification: Government tenders for highways, ports, urban transport and thermal projects often require the bidder or concessionaire to demonstrate EC capability or status at financial close.
• Insurance and ESG reporting: Liability insurers and BRSR reporting under SEBI's framework treat a valid EC and clean compliance history as a baseline disclosure item for listed groups.
• NGT and Supreme Court precedent: Courts have ordered demolition, ex-post-facto rejection and project closure where construction proceeded ahead of EC. The risk is not theoretical.

How It Actually Works

EC is not a single filing. It is a sequenced six-stage workflow on PARIVESH 2.0, and each stage has its own evidence base. Here is what happens at each step.

Step 1: Categorisation and Form 1 Filing

We start with the Schedule to the EIA Notification 2006 and check whether your project is Category A (MoEF&CC level), B1 (SEIAA with full appraisal) or B2 (no EIA required, simpler appraisal). Mistakes here cost months — a Category A project filed at SEIAA is sent back, and a B2 filed at MoEF is held up.

Form 1 along with a Pre-Feasibility Report, layout plans, alternatives analysis and geo-tagged project boundary is uploaded on PARIVESH. The portal automatically routes the file to the right appraisal body.

Step 2: Scoping and Terms of Reference (ToR)

The EAC or SEAC examines Form 1 and prescribes project-specific ToR — essentially a scope document for the EIA study. Standard ToR for the sector is the starting point; project-specific additions cover sensitive ecology, settlements, water draw points and similar concerns flagged at scoping.

ToR issue typically takes 3-6 months. We attend the scoping meeting on your behalf and minimise the chance of overbroad or impractical study requirements.

Step 3: Baseline Data Collection (Four Seasons)

Once ToR is in hand, four seasons of monitoring begin — ambient air, surface and groundwater, noise, soil, ecology, socio-economic, traffic and meteorology. Sampling is done at NABL-accredited labs to MoEF&CC protocols.

This stage alone consumes 9-12 months. It cannot be honestly shortened, and any attempt to backdate or fabricate data is now caught at the appraisal stage through cross-checks with CPCB CAAQMS data.

Step 4: Draft EIA, EMP and Public Hearing

The draft EIA report integrates baseline, impact prediction, the Environment Management Plan (EMP), risk assessment and a disaster management plan. A summary is translated into the local language.

Public hearing is convened by the State Pollution Control Board in coordination with the District Collector. Notice is published in two newspapers (one local language), draft EIA is made available at the SPCB, DC and panchayat offices, and the hearing is held in the affected village or town. The Public Hearing Report becomes part of the record.

Step 5: Final EIA, EAC/SEAC Appraisal and EC Grant

The Public Hearing Report is incorporated into a Final EIA, which is uploaded on PARIVESH for appraisal. The promoter team and consultant present the project to the EAC or SEAC.

Queries are answered in writing on the portal. Once the committee recommends grant, the EC letter with general and project-specific conditions is issued by MoEF&CC or SEIAA. This stage runs 3-9 months depending on committee load and query rounds.

Step 6: Post-EC Compliance

Half-yearly compliance reports are filed on PARIVESH to the MoEF&CC Regional Office and SPCB, listing the status of each EC condition. Modifications, capacity expansions and extensions require fresh applications.

SPCB and Regional Office inspections happen during construction and again after commissioning. Compliance failures trigger show-cause notices, bank guarantee invocation and in serious cases NGT proceedings.

A Real Example: 2 MTPA Cement Plant in Central India

To make the numbers concrete, consider a promoter setting up a 2 MTPA integrated cement plant on 250 hectares with a captive limestone mine 8 km away.

• Categorisation: Cement plant of this capacity falls under Category A (Schedule 3(b)). The limestone mine, being above 5 hectares, is also Category A. Two separate ECs are needed, filed in parallel.
• ToR phase: Form 1 and PFR uploaded in month 1. EAC issues ToR in month 5 after one round of scoping queries on water source and ash management.
• Baseline: Four-season monitoring runs from month 5 to month 17 — covering pre-monsoon, monsoon, post-monsoon and winter at 8 ambient stations, 4 noise stations and 6 water sampling points.
• Public hearing: Conducted in month 19 in the affected panchayat. Issues raised: water draw from the river in summer, dust on village approach roads, employment for local youth. Each is responded to in the Final EIA and EMP.
• Appraisal and EC: EAC meets in month 21, asks for additional clarifications on conveyor dust suppression and groundwater recharge plan. EC issued in month 23 with 45 specific conditions.
• Cost envelope: Consultant fees, four-season monitoring at NABL labs, public hearing logistics and PARIVESH compliance work out to roughly ₹85 lakh to ₹1.4 crore for a project of this scale.

The promoter parallel-tracks Forest Clearance for the mine, CFE from SPCB and water allocation from the state irrigation department, so financial close lands within a month of EC grant.

What Backs Up Each EC Condition After Grant

An EC is not the finish line. Every condition in the letter is a continuing obligation, and the Regional Office cross-verifies them at inspection. The standard evidence pack for each half-yearly compliance report includes the following.

• Ambient and stack data: Continuous monitoring data from CAAQMS and CEMS stations, with calibration certificates, plus manual SPCB samples for cross-reference.
• Water and effluent: Daily flow logs from water meters, ETP/STP inlet-outlet analysis at NABL labs and groundwater monitoring well data.
• Green belt and plantation: Geo-tagged photographs of plantation blocks, survival audit reports and species lists matching the approved plan.
• CSR / CER spend: Capital and revenue corporate environmental responsibility spend with utilisation certificates from the implementing agency or NGO.
• Solid and hazardous waste: Form 4 records under Hazardous Waste Rules, manifests for sent-out waste and authorisation copies from SPCB.
• EMP capex tracking: Status of each Environment Management Plan item with photographs, invoice references and commissioning certificates.

If you cannot show this evidence on file, the half-yearly report is effectively unsupported — and that is what triggers show-cause action.

Where EC Applications Go Wrong

We have seen the same handful of mistakes derail projects that were otherwise viable. Most are avoidable with discipline at the front end.

• Wrong categorisation at Form 1: Treating a Category A as B1 to stay at state level, or splitting a single project into sub-units to dodge thresholds. The EAC sees through it and returns the file.
• Compressed baseline: Trying to finish four-season monitoring in six months by overlapping seasons. Appraisal committees check the dates against CPCB meteorological records and reject the EIA.
• Public hearing shortcuts: Notice published in obscure editions, draft EIA not made available in local language, hearing held outside the affected area. NGT has set aside ECs on each of these grounds.
• Generic EMP: Copy-pasted Environment Management Plan with no link to actual baseline findings or project-specific risks. Committees ask for resubmission.
• Ignoring parallel clearances: Filing EC without simultaneously progressing Forest Clearance, Wildlife NOC or CRZ approval where applicable. Project sits idle even after EC.
• Non-accredited consultant: Form 1 or EIA signed by a consultant not NABET-accredited in the relevant sector and category. The proposal is returned at validation.
• Weak risk and disaster chapter: Generic Risk Assessment with no quantitative consequence analysis. Mandatory after the recent industrial accident jurisprudence.
• Post-EC drift: Skipping half-yearly compliance reports for two or three cycles. Triggers show-cause, bank guarantee encashment and inspection escalations.
