The clearance is not a formality. It is a structured 12-24 month process that touches Form 1, baseline data across four seasons, an EIA report, a public hearing in the affected district, and a defence before the EAC or SEAC.

Many promoters arrive after talking to a CFE consultant who told them "just file CFE/CFO". That advice works for small units. For listed projects, EC is a separate and prior requirement.
EC is not a single filing. It is a sequenced six-stage workflow on PARIVESH 2.0, and each stage has its own evidence base. Here is what happens at each step.
We start with the Schedule to the EIA Notification 2006 and check whether your project is Category A (MoEF&CC level), B1 (SEIAA with full appraisal) or B2 (no EIA required, simpler appraisal). Mistakes here cost months โ a Category A project filed at SEIAA is sent back, and a B2 filed at MoEF is held up.
Form 1 along with a Pre-Feasibility Report, layout plans, alternatives analysis and geo-tagged project boundary is uploaded on PARIVESH. The portal automatically routes the file to the right appraisal body.
The EAC or SEAC examines Form 1 and prescribes project-specific ToR โ essentially a scope document for the EIA study. Standard ToR for the sector is the starting point; project-specific additions cover sensitive ecology, settlements, water draw points and similar concerns flagged at scoping.
ToR issue typically takes 3-6 months. We attend the scoping meeting on your behalf and minimise the chance of overbroad or impractical study requirements.
Once ToR is in hand, four seasons of monitoring begin โ ambient air, surface and groundwater, noise, soil, ecology, socio-economic, traffic and meteorology. Sampling is done at NABL-accredited labs to MoEF&CC protocols.
This stage alone consumes 9-12 months. It cannot be honestly shortened, and any attempt to backdate or fabricate data is now caught at the appraisal stage through cross-checks with CPCB CAAQMS data.
The draft EIA report integrates baseline, impact prediction, the Environment Management Plan (EMP), risk assessment and a disaster management plan. A summary is translated into the local language.
Public hearing is convened by the State Pollution Control Board in coordination with the District Collector. Notice is published in two newspapers (one local language), draft EIA is made available at the SPCB, DC and panchayat offices, and the hearing is held in the affected village or town. The Public Hearing Report becomes part of the record.
The Public Hearing Report is incorporated into a Final EIA, which is uploaded on PARIVESH for appraisal. The promoter team and consultant present the project to the EAC or SEAC.
Queries are answered in writing on the portal. Once the committee recommends grant, the EC letter with general and project-specific conditions is issued by MoEF&CC or SEIAA. This stage runs 3-9 months depending on committee load and query rounds.
Half-yearly compliance reports are filed on PARIVESH to the MoEF&CC Regional Office and SPCB, listing the status of each EC condition. Modifications, capacity expansions and extensions require fresh applications.
SPCB and Regional Office inspections happen during construction and again after commissioning. Compliance failures trigger show-cause notices, bank guarantee invocation and in serious cases NGT proceedings.
To make the numbers concrete, consider a promoter setting up a 2 MTPA integrated cement plant on 250 hectares with a captive limestone mine 8 km away.
The promoter parallel-tracks Forest Clearance for the mine, CFE from SPCB and water allocation from the state irrigation department, so financial close lands within a month of EC grant.
An EC is not the finish line. Every condition in the letter is a continuing obligation, and the Regional Office cross-verifies them at inspection. The standard evidence pack for each half-yearly compliance report includes the following.
If you cannot show this evidence on file, the half-yearly report is effectively unsupported โ and that is what triggers show-cause action.
