A mutual consent divorce is the cleanest exit from a marriage that is no longer working. When both parties agree on the divorce and on the financial and custody terms, the law provides a structured, dignified, and quick exit. By 2026, with the Supreme Court's Amardeep Singh v. Harveen Kaur (2017) jurisprudence settled and the Shilpa Sailesh v. Varun Sreenivasan (2023) Constitution Bench permitting Article 142 dissolution on irretrievable breakdown, mutual consent divorce in India is more practical than ever — provided it is filed correctly.
The framework depends on the marriage law. Section 13B of the Hindu Marriage Act, 1955 for Hindus, Sikhs, Jains, Buddhists. Section 28 of the Special Marriage Act, 1954 for inter-faith and registered marriages. Section 10A of the Indian Divorce Act, 1869 for Christians. Khula / mubarat for Muslims. Section 32B of the Parsi Marriage and Divorce Act, 1936 for Parsis. The common architecture: a one-year separation (with limited exceptions), a written settlement covering financial and custody terms, a first motion before the Family Court, a 6-month cooling-off period (waivable per Amardeep Singh), and a second motion confirming the decision — followed by the decree.
