The memo addresses divorce path (contested vs mutual consent), recognition strategy for any existing or expected foreign decree, custody approach, 498A and LOC defence sequencing, and asset preservation. Cost and timeline are quoted upfront.
Anticipatory bail under Section 482 BNSS is filed before the NRI travels to India. LOC contestation through writ or representation to MHA is initiated where an LOC is suspected. Passport-protection applications are filed where impounding is threatened. Section 9 HMA restitution petitions or mutual-consent first motions are filed where forum priority matters.
Divorce petition, custody petition under the Guardians and Wards Act, maintenance application under Section 144 BNSS and quashing petition under Section 528 BNSS are filed and progressed in parallel. Foreign counsel is briefed to file mirror or supporting applications abroad โ service of process, depositions and asset disclosure are coordinated so neither side can play forum games.
Indian courts increasingly refer matrimonial matters to mediation. A written settlement covering divorce ground, custody schedule (with international travel terms), maintenance, asset division across India and abroad, and mutual withdrawal of criminal complaints is the cleanest exit. Where mediation fails, contested trial is conducted with foreign-jurisdiction evidence properly proved under the Bharatiya Sakshya Adhiniyam 2023.
Decrees are implemented end to end โ mutation of property, closure of joint accounts, registration of settlement, foreign-court mirror order for recognition abroad, passport and visa record correction, and LOC withdrawal. The marriage closes in both jurisdictions, not just one.
A common pattern. Hindu marriage solemnised in Hyderabad in 2018; the couple moves to New Jersey on H1B and H4. In 2024 the wife returns to India with their 4-year-old daughter for a family visit and does not come back. Three months later the husband receives a 498A complaint, a Domestic Violence Act notice and a Section 9 HMA restitution petition โ all filed in Hyderabad. The wife also approaches the New Jersey Superior Court for custody and child support.
Within nine months the matter was in court-monitored mediation with all four heads โ divorce, custody, maintenance and criminal โ on a single negotiating table.
Section 13 CPC declares a foreign judgment conclusive between the same parties on the same matter, except where any of six statutory bars applies. For matrimonial decrees the Supreme Court in Y. Narasimha Rao v. Y. Venkata Lakshmi (1991) read these into four practical tests that remain the working law in 2026:
Where one or more tests fail, the foreign decree is treated as a nullity in India and fresh Indian proceedings are required. We structure foreign filings to satisfy all four tests where possible, and run parallel Indian proceedings where not.
