An NRI divorce is rarely just one case. It is a multi-jurisdictional matter that runs in parallel across an Indian court, a foreign court, an immigration authority, and often a passport / visa file. A wife in Mumbai, a husband in Toronto, a child in Dubai, a marital home in Bangalore, a savings account in London — every layer adds a forum, a law, and a contested document. Get the strategy right and the matter ends in 18-24 months with closure across all jurisdictions; get it wrong and the same parties spend a decade litigating, with the child's life suspended.

The Indian framework is the Hindu Marriage Act 1955 / Special Marriage Act 1954 / Indian Divorce Act 1869 / Muslim Personal Law / Parsi Marriage and Divorce Act 1936, the Family Courts Act 1984, the Protection of Women from Domestic Violence Act 2005, the Hindu Adoptions and Maintenance Act, the Section 498A regime under the BNS (formerly IPC), and the Hague Convention on the Civil Aspects of International Child Abduction (which India has not signed but applies de facto in practice). The Supreme Court in Y. Narasimha Rao v. Y. Venkata Lakshmi (1991) set the test for recognition of foreign divorce decrees in India — and that test remains the bedrock by 2026.

The Modules of an NRI Family Law Matter

• Divorce — Mutual Consent / Contested:: Section 13B HMA mutual consent (or equivalent under SMA / Christian / Muslim law); contested under Section 13 grounds (cruelty, desertion, adultery, irretrievable breakdown).

Foreign Decree Recognition (Y. Narasimha Rao Test):
Recognition in India only if the foreign court had jurisdiction (mutual residence / consent), grounds were available under Indian law, and natural justice was followed. Otherwise, ex-parte foreign divorce is unenforceable in India.

• Child Custody & Hague Convention:: India is not a Hague signatory but Indian courts apply the welfare-of-the-child principle and routinely return abducted children. Habeas corpus, Guardians and Wards Act, and Supreme Court precedent (Nithya Anand Raghavan, Lahari Sakhamuri) form the framework.

• Maintenance & Alimony:: Section 125 BNSS / 144 BNSS, Section 24/25 HMA, Section 18 HAMA, Domestic Violence Act maintenance — multi-pronged and frequently combined.

• Section 498A & Counter-Cases:: False / weaponised 498A cases against NRI husbands and in-laws; quashing under Section 528 BNSS (per Bhajan Lal); look-out circular (LOC) defence; passport impounding contests.

• Asset Division, Stridhan & Marital Property:: India has no community-property regime; recovery is on documentary trail; stridhan recovery; foreign-asset disclosure under Hindu Marriage Act precedents.

Why NRIs Lose When They Use the Wrong Counsel

Filing for divorce in the foreign court without confirming Indian recognition — leaves the marriage subsisting in India. Not contesting an ex-parte 498A — leads to LOC and arrest at airport. Allowing the spouse to remove the child to India / from India without immediate intervention — the child's habitual residence is established and custody outcomes reset.
