What's New for FY 2026-27

Three years into the BNS / BNSS rollout, the family-and-criminal landscape for NRIs looks materially different from the IPC / CrPC era. The headline changes:

• BNS Sections 85 and 86: Replaced IPC 498A from 1 July 2024. The cruelty offence continues, but is now read alongside Arnesh Kumar v. State of Bihar and repeated Supreme Court warnings against mechanical arrest.
• BNSS Section 482 anticipatory bail: Functionally the old Section 438 CrPC, but Sessions Courts are issuing detailed-reasoning orders to address NRI passport and LOC realities.
• LOC standard operating procedure: MHA's revised 2024 office memorandum requires a clear cognisable offence and a credible arrest necessity. Bare matrimonial complaints no longer auto-justify an LOC, opening contestation space.
• Family Court video conferencing: Bombay, Delhi, Karnataka and Madras High Court rules formally allow NRI parties to depose by video link in matrimonial matters, ending the must-travel-to-India trap.
• Supreme Court on child custody: Welfare-of-the-child reaffirmed as supreme, even where a foreign court has passed a custody order — building on Nithya Anand Raghavan and Lahari Sakhamuri.
• Mutual consent through e-PoA: Apostilled or consularised Powers of Attorney from Indian missions abroad are routinely accepted. The Amardeep Singh v. Harveen Kaur waiver of the 6-month cooling period remains available in genuine cases.

Why You Need Integrated Two-Jurisdiction Representation

• Maintenance on guesswork: Without proper income proof from the foreign jurisdiction, courts pass interim orders on inflated estimates that take years to correct.
• Mediation used as a weapon: A spouse who knows you cannot easily travel uses adjournments and procedural delays to grind down resolve.

How It Actually Works

Six stages, each closing a clear gate before the next begins.

Step 1: Confidential Intake and Conflict Check

Before any filing, we run a structured intake covering marriage facts, jurisdiction history, children, assets in both countries, existing complaints or orders, and immigration status. Each fact is anchored to a document. Conflict checks across our India and foreign-counsel network ensure no representation overlap. A confidentiality protocol is signed and communication shifts to secure channels.

Step 2: Forum Mapping and Written Strategy Memo

We map every possible forum — Indian family court, Indian Sessions or High Court for criminal defence, foreign matrimonial court, foreign criminal court if relevant — and decide which to use, in what order, and why. The memo addresses divorce path (contested vs mutual consent), recognition strategy for any existing or expected foreign decree, custody approach, 498A and LOC defence sequencing, and asset preservation. Cost and timeline are quoted upfront.

Step 3: Protective and Pre-Emptive Filings

Anticipatory bail under Section 482 BNSS is filed before the NRI travels to India. LOC contestation through writ or representation to MHA is initiated where an LOC is suspected. Passport-protection applications are filed where impounding is threatened. Section 9 HMA restitution petitions or mutual-consent first motions are filed where forum priority matters.

Step 4: Substantive Petitions and Foreign Coordination

Divorce petition, custody petition under the Guardians and Wards Act, maintenance application under Section 144 BNSS and quashing petition under Section 528 BNSS are filed and progressed in parallel. Foreign counsel is briefed to file mirror or supporting applications abroad — service of process, depositions and asset disclosure are coordinated so neither side can play forum games.

Step 5: Mediation, Settlement or Trial

Indian courts increasingly refer matrimonial matters to mediation. A written settlement covering divorce ground, custody schedule (with international travel terms), maintenance, asset division across India and abroad, and mutual withdrawal of criminal complaints is the cleanest exit. Where mediation fails, contested trial is conducted with foreign-jurisdiction evidence properly proved under the Bharatiya Sakshya Adhiniyam 2023.

Step 6: Post-Decree Closure and Cross-Border Recognition

Decrees are implemented end to end — mutation of property, closure of joint accounts, registration of settlement, foreign-court mirror order for recognition abroad, passport and visa record correction, and LOC withdrawal. The marriage closes in both jurisdictions, not just one.

A Real Example: Hyderabad Marriage, New Jersey Life, 498A Filed

A common pattern. Hindu marriage solemnised in Hyderabad in 2018; the couple moves to New Jersey on H1B and H4. In 2024 the wife returns to India with their 4-year-old daughter for a family visit and does not come back. Three months later the husband receives a 498A complaint, a Domestic Violence Act notice and a Section 9 HMA restitution petition — all filed in Hyderabad. The wife also approaches the New Jersey Superior Court for custody and child support.

• US side: Coordinated with New Jersey family counsel for interim custody motion, emergency application citing wrongful retention of the child, and child-support response.
• India side: Anticipatory bail filed in Hyderabad Sessions Court under Section 482 BNSS within 7 days and secured before any travel.
• LOC check: RTI and counsel verification confirmed no active LOC; a written representation was pre-filed to MHA against any future LOC opening.
• 498A defence: Quashing petition filed at the Telangana High Court under Section 528 BNSS, relying on Bhajan Lal guidelines and Arnesh Kumar safeguards.
• Child custody: Guardians and Wards Act petition and habeas corpus filed at the High Court, with welfare principle and habitual-residence facts placed on record.
• Maintenance: Counter-evidence of US tax returns, mortgage liability and existing child-support obligations filed so the interim order reflected real net disposable income.

Within nine months the matter was in court-monitored mediation with all four heads — divorce, custody, maintenance and criminal — on a single negotiating table.

Foreign Decree Recognition — The Y. Narasimha Rao Test

Section 13 CPC declares a foreign judgment conclusive between the same parties on the same matter, except where any of six statutory bars applies. For matrimonial decrees the Supreme Court in Y. Narasimha Rao v. Y. Venkata Lakshmi (1991) read these into four practical tests that remain the working law in 2026:

• Competent jurisdiction: The foreign court must have had jurisdiction recognised under Indian law — either the marriage was solemnised there, both parties were domiciled or resident there, or the defendant clearly submitted to that jurisdiction.
• Ground recognised under Indian law: The divorce must be on a ground that Indian law also recognises. Pure no-fault and irretrievable breakdown grounds remain problematic for Indian recognition.
• Natural justice: The defendant must have been served, given a reasonable opportunity to defend, and not denied a fair hearing in any material respect.
• Not obtained by fraud: Suppression of facts, false residence claims or forum-shopping vitiate recognition.

Where one or more tests fail, the foreign decree is treated as a nullity in India and fresh Indian proceedings are required. We structure foreign filings to satisfy all four tests where possible, and run parallel Indian proceedings where not.

Where It Goes Wrong

The most damaging mistakes in NRI family matters are made early, before any lawyer is engaged:

• Returning to India without bail: NRIs assume a 498A complaint is civil family stuff and fly in. Arrest at the airport leads to passport impounding and visa cancellation back home.
• Ex-parte foreign divorce: A quick US or UK divorce obtained without properly serving the spouse in India. Indian remarriage gets challenged years later and children's legitimacy is questioned.
• Self-drafted mutual consent through agents: PoAs signed without consularisation, or agreements that omit critical clauses on alimony finality, child travel and criminal withdrawal. Court rejects; matter restarts.
• Removing the child without an order: A parent takes the child out of the foreign country during what was meant to be a visit. The other side files emergency custody abroad and habeas corpus in India simultaneously.
• Hiding foreign assets: Failing to disclose US 401(k), UK pension, RSU vesting or Gulf end-of-service benefits. Discovery destroys credibility; courts draw adverse inferences.
• Recording calls illegally: Recordings made in two-party-consent states like California or Florida can be excluded or backfire. Lawful evidence collection has to be planned, not improvised.
• Public posts during litigation: One LinkedIn post or Instagram story showing income, lifestyle or location reshapes the entire maintenance calculation against you.
