Contested Divorce

A contested divorce is the legal recognition that a marriage is over, but only one spouse will say so. The other resists — sometimes for genuine reasons, more often for negotiating leverage on alimony, custody, or asset division. Filed and run correctly, a contested divorce ends in a decree on a recognised statutory ground and a settlement of every collateral issue. Filed badly, it becomes a 7-12 year stalemate that drains both sides emotionally and financially while the children grow up watching the litigation. Choosing the right ground, the right forum, the right pleadings, and the right negotiation cadence is what separates the two outcomes.

The grounds vary by personal law. Hindu Marriage Act, 1955 — Section 13: cruelty, desertion (2 years), adultery, conversion, mental disorder, leprosy (deleted by 2019 amendment), venereal disease, renunciation, presumption of death; plus the wife-specific grounds under Section 13(2). Special Marriage Act, 1954 — Section 27: similar grounds, applicable to civil and inter-faith marriages. Indian Divorce Act, 1869 — Section 10: grounds for Christians, including cruelty added by 2001 amendment. Muslim Personal Law: talaq, khula, mubarat, judicial divorce under Dissolution of Muslim Marriages Act 1939; the Supreme Court in Shayara Bano (2017) struck down instant triple talaq, now criminalised under the 2019 Act. Parsi Marriage and Divorce Act, 1936 — Section 32. The Supreme Court in Shilpa Sailesh v. Varun Sreenivasan (2023) Constitution Bench held that the Supreme Court can dissolve marriages under Article 142 on irretrievable breakdown — a route available where personal law grounds are inadequate.

• Reply & Counter-Claim:: Respondent's reply; possible counter-petition (e.g., restitution under Section 9 HMA); rejoinder; mediation referral under Section 89 CPC.

• Mediation:: Court-monitored mediation; many contested divorces settle at this stage as mutual consent — typically faster, cheaper, and outcome-controlled.

• Trial:: Issues framed; chief evidence by affidavit, cross-examination; documentary evidence proved; witness testimony (often family members and friends).

• Final Arguments & Decree:: Written and oral arguments; decree of divorce or dismissal; permanent alimony under Section 25 HMA; child custody under Section 26.

• Appeal:: First appeal to High Court under Section 28 HMA / Section 39 SMA / Section 19 Family Courts Act.
