Industrial design registration under the Designs Act 2000 — Locarno Class 1–31 filing, novelty / originality assessment, 10-year term plus 5-year extension and Hague Agreement coverage.
For any product company that competes on form, finish, ornamentation, surface pattern, or shape — consumer electronics, apparel, footwear, FMCG packaging, furniture, automotive parts, jewellery, kitchenware — design registration is the IP right that maps most directly onto the commercial moat. Trademark protects the brand name and logo; patent protects the technical invention; copyright protects the artistic work. Design registration under the Designs Act 2000 protects the visual / aesthetic features of an article — shape, configuration, pattern, ornament, composition of lines or colours — that appeal to and are judged solely by the eye. It is the right that stops a competitor from copying the look of your product, even if they avoid the brand name and steer clear of any patented technical mechanism.
By 2026, with cross-border e-commerce and rapid lookalike manufacturing in India and abroad, design registration is no longer optional for serious product companies. The lifecycle of a registered design in India is straightforward: filing under the Designs Act 2000 + Designs Rules 2001, classification under one of the 31 Locarno classes (the international design classification used in India since 2008), examination on absolute novelty and originality, registration, and a term of 10 years from registration with a single 5-year extension on application — total 15-year monopoly. Foreign coverage runs through the Paris Convention (6-month priority window from the Indian filing) and, increasingly, the Hague Agreement on industrial designs for multi-jurisdiction filing through a single international application.
We handle design registration end-to-end — novelty assessment, representation drawings prepared to the IP Office's exacting standards, Locarno class identification, Form 1 filing, examination response, registration, foreign priority filings, and the 10+5-year renewal calendar.
An unregistered design has only the residual remedy of passing off (where reputation can be proved) and the artistic-work copyright route (where the design is not industrially applied beyond 50 articles, after which copyright in the artistic work is lost under Section 15(2) of the Copyright Act). Registered designs get the statutory infringement remedy under Section 22 with damages, injunction, and account of profits — the remedy lookalike defendants actually fear. Registration is the upgrade.
Indian Designs Database, WIPO Global Design Database, EUIPO Designview, USPTO design search and e-commerce platforms scanned before filing — registrability assessed on evidence.
Article mapped to the correct Locarno class (1–31) with sub-class precision; multi-class filings handled where the article spans categories.
Up to 7 views to A4 standard, consistent scale and orientation, line-drawing or photograph format — the cause of most design objections eliminated upfront.
Novelty wording engineered to describe what is genuinely new — neither so narrow it loses commercial scope nor so broad it invites objection.
Registration to year 10 plus the Section 11(2) 5-year extension calendared; renewal filed before expiry; protection runs the full 15-year horizon.
Paris Convention 6-month foreign priority window tracked; Hague Agreement international application for multi-jurisdiction protection through a single filing.
Article identified; Locarno class and sub-class mapped; novelty features captured; statement-of-novelty draft prepared.
Indian Designs Database, WIPO, EUIPO, USPTO and e-commerce search; registrability opinion; design-around suggestions if conflicts surface.
Up to 7 views drawn / photographed to Rule 14 standard; consistent scale, orientation and white space; final sheets approved.
Form 1, representation sheets, statement of novelty, priority document if Paris Convention claim; e-filing on the IP Office portal.
Examination report addressed; amended drawings or arguments filed; hearing attended where called; registration on acceptance.
Registration certificate; 10-year term tracked; Section 11(2) 5-year extension filed before year 10 expiry; Hague / Paris foreign filings as scoped.
PAN, address proof, entity KYC (CoI, MOA, AOA) of applicant; nationality; foreign applicant agency address in India
Product / article name; Locarno class declaration; intended use; manufacturing / commercial deployment plan; material and dimensions
Up to 7 views (front, back, left, right, top, bottom, perspective) on A4; line drawings or photographs; consistent scale; statement of novelty
Certified copy of foreign first filing within 6-month Paris Convention window; English translation if not in English
