Design Registration

For any product company that competes on form, finish, ornamentation, surface pattern, or shape — consumer electronics, apparel, footwear, FMCG packaging, furniture, automotive parts, jewellery, kitchenware — design registration is the IP right that maps most directly onto the commercial moat. Trademark protects the brand name and logo; patent protects the technical invention; copyright protects the artistic work. Design registration under the Designs Act 2000 protects the visual / aesthetic features of an article — shape, configuration, pattern, ornament, composition of lines or colours — that appeal to and are judged solely by the eye. It is the right that stops a competitor from copying the look of your product, even if they avoid the brand name and steer clear of any patented technical mechanism.

By 2026, with cross-border e-commerce and rapid lookalike manufacturing in India and abroad, design registration is no longer optional for serious product companies. The lifecycle of a registered design in India is straightforward: filing under the Designs Act 2000 + Designs Rules 2001, classification under one of the 31 Locarno classes (the international design classification used in India since 2008), examination on absolute novelty and originality, registration, and a term of 10 years from registration with a single 5-year extension on application — total 15-year monopoly. Foreign coverage runs through the Paris Convention (6-month priority window from the Indian filing) and, increasingly, the Hague Agreement on industrial designs for multi-jurisdiction filing through a single international application.

What's Inside a Real Design Registration Engagement

• Novelty & Originality Assessment:: A registrable design must be new or original, not previously published in India or anywhere in the world, and significantly distinguishable from known designs (Section 4 of the Designs Act). We run a pre-filing search across the Indian Designs Database, WIPO Global Design Database, EUIPO Designview, USPTO design search, and product / e-commerce platforms to assess registrability before filing.

• Locarno Class Identification:: The article's class under the Locarno Classification (Classes 1–31) determines filing fees, examination scope and conflict universe. Class 6 (furniture), Class 9 (packaging), Class 14 (recording / communication / IT equipment), Class 23 (sanitary / heating / ventilating), Class 26 (lighting), Class 28 (cosmetics) — selecting and pleading the class accurately is foundational.

• Representation Drawings:: Up to 7 views (front, back, left, right, top, bottom, perspective) on standard A4 sheets, conforming to Rule 14 of the Designs Rules 2001; line drawings or photographs both acceptable; consistent scale and orientation; no extraneous features. The single biggest cause of design objections is non-compliant representations.

• Form 1 Filing & Statement of Novelty:: Form 1 application + representation sheets + statement of novelty (the words that define what is novel about the design — e.g., 'novelty resides in the shape and configuration of the article as illustrated'); class and sub-class declared; priority claimed if filing within 6 months of a foreign first filing.

• Examination & Objection Response:: Examination on novelty, originality, distinguishability, and Section 4 exclusions (designs contrary to public order, mere mechanical contrivances, designs not intended for industrial application); objection responses with amended drawings or arguments; hearing where called.

• Registration & 10+5-Year Term:: Registration certificate; protection for 10 years from registration date; one 5-year extension on application before the 10-year expiry under Section 11(2); total 15-year term.

• Foreign Priority & Hague Designations:: Foreign filings within the 6-month Paris Convention priority window or Hague Agreement international application designating multiple Hague-member jurisdictions through a single filing.

Why Unregistered Designs Lose at Court

An unregistered design has only the residual remedy of passing off (where reputation can be proved) and the artistic-work copyright route (where the design is not industrially applied beyond 50 articles, after which copyright in the artistic work is lost under Section 15(2) of the Copyright Act). Registered designs get the statutory infringement remedy under Section 22 with damages, injunction, and account of profits — the remedy lookalike defendants actually fear. Registration is the upgrade.
