Design registration under the Designs Act 2000 gives you a 15-year monopoly on the visual appeal of your article: its shape, configuration, pattern, or ornament. Filed correctly, it lets you stop knock-offs at customs, on marketplaces, and in court without arguing about copyright thresholds or patent novelty.

Design protection is the most under-used IP right in the Indian SME ecosystem โ and the most expensive one to skip.
Six stages, sequenced so the application clears examination on the first or second exchange โ not the fifth.
The first decision is what exactly you are protecting and under which class. "Article" under the Designs Act means an article of manufacture โ a tangible product or part of it. We identify the specific article (a chair, a bottle, an icon set, a fabric pattern), confirm it qualifies, and map it to the right Locarno class out of the 31 international classes. A wrong class wastes the filing or invites a Section 5 objection at examination.
We search four databases before you commit fees: the Indian Designs Database, the WIPO Global Design Database, EUIPO Designview, and the USPTO design search. We also scan Amazon, Flipkart, Alibaba and Instagram for prior art that may not appear in any registry. The output is a registrability opinion โ either a green light or a list of design-around tweaks that preserve commercial intent while clearing prior art.
Rule 14 of the Designs Rules 2001 governs what your drawings must look like. Up to seven views โ front, back, left, right, top, bottom, and a perspective view โ on A4 sheets, consistent scale, consistent orientation, clean white space, and either crisp line drawings or shadowless photographs. Most design objections originate at this step. We prepare the sheets in-house and have them approved by you before filing.
The statement of novelty is what your monopoly is built on. Drafted too narrow, you lose commercial scope; drafted too broad, the examiner cites prior art and objects. The Designs Wing examines the application and issues a report โ typically within 4-6 months in FY 2026-27. We file the response within the statutory window, amend drawings where needed, and attend a hearing if called. Acceptance leads to publication in the Designs Journal and to registration; the certificate follows.
The 10-year term runs from the date of registration. We calendar the 5-year extension under Section 11(2) at 18, 12, 6 and 3 months before expiry โ because filing the extension after the 10-year term lapses is fatal, the design cannot be revived. Hague designations and Paris Convention foreign filings are queued per your geographic roadmap.
