A great-looking product is a commercial asset — and the moment it hits the market, copycats notice. Design registration under the Designs Act 2000 gives you a 15-year monopoly on the visual appeal of your article: its shape, configuration, pattern, or ornament. Filed correctly, it lets you stop knock-offs at customs, on marketplaces, and in court without arguing about copyright thresholds or patent novelty.

This page walks you through how design protection actually works in India for FY 2026-27 — what to file, when, with which Locarno class, how the 10+5 year term plays out, and where most applications go wrong at the examination stage.

What's New for FY 2026-27

The design ecosystem has tightened up over the past two years — here is what changed and what it means for your filing.

• Faster examination cycles: First examination reports now typically issue within 4-6 months of filing, down from the 9-12 months that was standard earlier, as the Designs Wing clears legacy backlog.
• GUI registrations stabilising: After the Microsoft Corporation order and steady Locarno Class 14-04 acceptances, the Office is now issuing GUI design registrations consistently where the article-of-manufacture test is met.
• Hague filings rising for Indian originals: Outbound Hague System filings by Indian applicants have grown sharply; cost per jurisdiction is now materially below serial Paris Convention filings once three or more countries are designated.
• E-filing only: Physical filings have been discontinued across the board — forms, representations, priority documents and powers of attorney all go through the IP India portal in PDF/A format.
• DPDP-aligned applicant data: Applicant KYC and address-for-service data is handled under DPIIT norms aligned with the DPDP Act 2023; foreign applicants without an Indian presence must appoint an Indian agent with a documented address-for-service.

Why You Need a Registered Design

Design protection is the most under-used IP right in the Indian SME ecosystem — and the most expensive one to skip.

• Copyright collapses at scale: Section 15(2) of the Copyright Act 1957 strips copyright the moment your design is industrially applied to more than 50 articles. If you are mass-producing, copyright cannot help you past unit 51.
• Patents do not cover appearance: A patent protects a new technical invention. The look and feel of your product — silhouette, curves, surface ornament — is outside a patent's scope and needs a design registration to be protected.
• Customs and marketplace enforcement: Registered designs can be recorded with Customs under the IPR Rules and with Amazon, Flipkart and Meesho brand-protection programmes. Without registration, takedowns are slow and contested.
• Litigation leverage: An infringement suit on a registered design proceeds straight to statutory remedies. Unregistered designs require passing-off arguments and copyright workarounds that can take years to resolve.
• Cross-border value: Registration is the foundation for Hague System outbound filings, OEM agreements, licensing deals, and IP-backed financing arrangements.
• A balance-sheet asset: A registered design portfolio is valued during fundraising, acquisitions and licensing — and is enforceable from day one of grant.

How It Actually Works

Six stages, sequenced so the application clears examination on the first or second exchange — not the fifth.

Step 1: Article Definition and Locarno Class Mapping

The first decision is what exactly you are protecting and under which class. "Article" under the Designs Act means an article of manufacture — a tangible product or part of it. We identify the specific article (a chair, a bottle, an icon set, a fabric pattern), confirm it qualifies, and map it to the right Locarno class out of the 31 international classes. A wrong class wastes the filing or invites a Section 5 objection at examination.

Step 2: Pre-Filing Novelty Search

We search four databases before you commit fees: the Indian Designs Database, the WIPO Global Design Database, EUIPO Designview, and the USPTO design search. We also scan Amazon, Flipkart, Alibaba and Instagram for prior art that may not appear in any registry. The output is a registrability opinion — either a green light or a list of design-around tweaks that preserve commercial intent while clearing prior art.

Step 3: Representation Drawings to Rule 14 Standard

Rule 14 of the Designs Rules 2001 governs what your drawings must look like. Up to seven views — front, back, left, right, top, bottom, and a perspective view — on A4 sheets, consistent scale, consistent orientation, clean white space, and either crisp line drawings or shadowless photographs. Most design objections originate at this step. We prepare the sheets in-house and have them approved by you before filing.

Step 4: Statement of Novelty and Form 1 Filing

The statement of novelty is what your monopoly is built on. Drafted too narrow, you lose commercial scope; drafted too broad, the examiner cites prior art and objects. We engineer the wording around the specific novel features — the curvature, the surface pattern, the configuration — that genuinely distinguish your article. Form 1, drawings, novelty statement, applicant KYC, and priority documents go up on the IP India portal in one batch.

Step 5: Examination and Objection Response

The Designs Wing examines the application and issues a report — typically within 4-6 months in FY 2026-27. Objections cluster around three areas: prior-art citations, drawing deficiencies, and statement-of-novelty language. We file the response within the statutory window, amend drawings where needed, and attend a hearing if called. Acceptance leads to publication in the Designs Journal and to registration; the certificate follows.

Step 6: Registration, Term Tracking and Renewal

The 10-year term runs from the date of registration. We calendar the 5-year extension under Section 11(2) at 18, 12, 6 and 3 months before expiry — because filing the extension after the 10-year term lapses is fatal, the design cannot be revived. Hague designations and Paris Convention foreign filings are queued per your geographic roadmap.

A Real Example: D2C Water Bottle Brand in Locarno Class 09-01

A Bengaluru-based D2C beverage startup launches a new insulated water bottle with a distinctive ribbed silhouette and a magnetic cap. Here is what their design filing looked like in practice.

• Article and class: Insulated bottle with magnetic closure mapped to Locarno Class 09-01 (containers and packaging for transport).
• Search outcome: WIPO returned two close prior arts on ribbed bottles but neither used the magnetic-cap configuration; the registrability opinion came back green for the combination.
• Drawings: Seven views prepared as photographs against a white seamless backdrop; perspective view shot at 30-degree elevation; total preparation time 4 working days.
• Filing: Form 1 e-filed with the statement of novelty focused on the rib-and-cap combination; small entity fee of ₹1,000 per design.
• Examination: First report issued in month 5 with one prior-art citation; reply filed in 30 days with comparative drawings; design registered in month 7.
• Outcome: Registration certificate issued; design recorded with Amazon Brand Registry; Hague designation filed three months later covering US, EU and UK at marginal incremental cost.

Total elapsed time from brief to certificate: 8 months. Total spend on the Indian filing: under ₹15,000 including statutory fees and professional charges.

The most important commercial decision was made in week one — choosing what to claim novelty in. A drafted-narrow novelty statement on the rib-and-cap combination cleared examination quickly and gave the brand enforceable rights against the cap configuration that competitors actually wanted to copy.

What Backs Up Your Registration

A registered design is only as strong as the file that supports it. We hand over a complete enforcement file at registration.

• Registration certificate (original): Issued by the Patent Office with registration number and date — the document you produce in any enforcement or licensing action.
• Approved representation sheets: The exact sheets the Office accepted, with examiner annotations if any, kept in your IP file for evidentiary use.
• Examination report and reply: The full prosecution history, often decisive in subsequent enforcement, opposition or cancellation proceedings.
• Statement of novelty (as accepted): The accepted novelty wording — the legal foundation of your monopoly and the language an infringement claim is built around.
• Renewal calendar: The 10-year expiry tracked at 18, 12, 6 and 3 months with the Section 11(2) extension reminder built in.
• Customs recordation pack: Format-ready documents for IPR recordation with Customs and brand-registry enrolment with major Indian marketplaces.

Where It Goes Wrong

Most design rejections, late filings, and lost rights trace back to the same handful of mistakes.

• Publication before filing: Posting product photos on Instagram, launching on a marketplace, or showing at a trade show before filing destroys novelty. The design must be unpublished anywhere in the world at the filing date — Paris Convention priority is the only safety net.
• Wrong Locarno class: Filing under a class that does not match the article triggers a Section 5 objection. Multi-class product spans need separate applications, not a single multi-class filing.
• Drawing deficiencies: Inconsistent scale across views, missing views, photographs with shadows or coloured backgrounds, or hand-drawn sketches that fail Rule 14 — all generate examination objections.
• Statement of novelty too broad: Claiming novelty in "overall shape" without isolating the new features invites prior-art citations; the application then either narrows on amendment or gets refused outright.
• Missing the 5-year extension: The Section 11(2) extension must be filed before the 10-year term ends. There is no grace period and no revival mechanism after expiry — the design falls into the public domain.
• Foreign priority missed: The Paris Convention 6-month window from a foreign first filing is hard. Missing it forces a fresh filing with no priority date and exposes you to anyone who filed in the intervening period.
• GUI applications without article specificity: Filing a GUI without identifying the display article (smartphone, dashboard, kiosk, ATM) still triggers Office objections — precision in the article description is what gets the registration through.
