Your code, your script, your logo, your soundtrack โ the moment you fix the work in a tangible form, copyright is yours automatically under the Copyright Act 1957. India's Berne Convention membership extends that automatic protection across more than 180 countries. You do not have to register anything for the right to exist.
But automatic ownership is one thing. Proving ownership in court, in front of a marketplace takedown desk, at the customs counter, or before a VC who wants clean IP โ that is another thing entirely. A Copyright Certificate from the Registrar gives you prima facie evidence under Section 48 of the date, the author, and the chain of title. That single document turns a dispute from a year-long evidentiary fight into a clean enforcement action.
The Copyright Office portal has tightened scrutiny on software and artistic-work filings, and the procedural calendar around the 30-day objection window now runs more strictly. A few practical changes matter for any filing this year.
Copyright vests on creation. You do not need a certificate for the right to exist. So why pay the fee and wait the months? Because what you are buying is not the right โ you are buying the evidence.
The path from manuscript to certificate is procedural, not creative. Here is what actually happens once you decide to file.
Every work goes into one of seven categories โ literary, dramatic, musical, artistic, cinematograph film, sound recording, or software (filed as a literary work for procedural purposes). The category drives the fee, the form fields, and the prescribed copies you need to attach.
A brand identity package might split into three filings โ the logo as artistic, the tagline as literary, the jingle as musical and as sound recording. Getting the split right at this stage avoids re-filing later.
Section 17(c) makes the employer the first owner where the work is created in the course of employment, but only if there is no contrary agreement. For freelancers, contractors and commissioned work, Section 19 requires a written assignment to transfer ownership.
We pull employment contracts, consultancy agreements, NDAs and PO terms to verify the chain of title before filing. Co-authored works need NoCs from every author. Derivative works โ translations, adaptations, remixes, forks โ need a licence from the underlying-work owner.
Statement of Particulars covers the title, language, category, year of completion, date of first publication, and author / publisher details. Statement of Further Particulars covers the medium, the underlying work (if any), and the rights claimed.
Prescribed copies โ two hard copies for literary or musical works, first 25 and last 25 pages of source code for software, high-resolution images for artistic works, the recording itself for sound recordings โ are uploaded. Statutory fees range from โน500 for most works to โน5,000 for cinematograph films.
Once the diary number is issued, the Copyright Office holds the application for 30 days. Anyone with a claim โ a co-author who was left out, a prior assignee, an earlier creator of a similar work โ can file a written objection.
We monitor the docket daily through this window. If no objection comes in, the file moves to the Examiner. If an objection arrives, both sides are heard and the Examiner decides whether to proceed.
The Examiner reviews the form, the supporting documents, and the prescribed copies. If anything is unclear โ an authorship gap, a missing NoC, a derivative work without a licence, a category mismatch โ a discrepancy letter is issued.
You typically get 30 days to reply. Most filings clear scrutiny in one or two rounds; complex ones with multi-author software or assignment chains take longer and sometimes need a personal hearing over video.
On clearance, the Registrar makes an entry in the Register of Copyrights and the certificate is generated as a PDF downloadable from the portal. The certificate carries the registration number, the diary number, the date of registration, and a description of the work.
Once issued, the certificate does not need renewal. The protection runs for the statutory term tied to the author's life or to the year of publication, whichever applies.
