Copyright Registration

Your code, your script, your logo, your soundtrack — the moment you fix the work in a tangible form, copyright is yours automatically under the Copyright Act 1957. India's Berne Convention membership extends that automatic protection across more than 180 countries. You do not have to register anything for the right to exist.

But automatic ownership is one thing. Proving ownership in court, in front of a marketplace takedown desk, at the customs counter, or before a VC who wants clean IP — that is another thing entirely. A Copyright Certificate from the Registrar gives you prima facie evidence under Section 48 of the date, the author, and the chain of title. That single document turns a dispute from a year-long evidentiary fight into a clean enforcement action.

What's New for FY 2026-27

The Copyright Office portal has tightened scrutiny on software and artistic-work filings, and the procedural calendar around the 30-day objection window now runs more strictly. A few practical changes matter for any filing this year.

• Portal-only filing: Physical filing counters are closed. Every application, objection, reply and assignment moves through the e-filing portal with digital signatures.
• Tighter software scrutiny: Source-code filings (first 25 + last 25 pages) now face closer examination on authorship chains, especially where AI-assisted code is involved; assignment papers from contractors and contributors are expected upfront.
• DPDP Act overlap: Photographs and audiovisual works featuring identifiable individuals now intersect with the Digital Personal Data Protection Act 2023 — consent of the depicted person is checked at scrutiny stage for commercial-use filings.
• Examiner hearings via video: Objection hearings and scrutiny clarifications are routinely conducted over video conference, cutting travel time but tightening response deadlines to 15-30 days.
• Faster diary acknowledgement: Diary numbers are generally issued within 24-48 hours of filing, with the portal auto-rejecting incomplete applications instead of holding them for clarification.

Why Register Even Though Copyright Is Automatic

Copyright vests on creation. You do not need a certificate for the right to exist. So why pay the fee and wait the months? Because what you are buying is not the right — you are buying the evidence.

• Section 48 evidentiary value: A registered Copyright Certificate is prima facie evidence of authorship, ownership and date of creation. In an infringement suit, the burden of proof effectively flips — the other side must rebut your registration, not you proving your right from scratch.
• Marketplace takedowns: Amazon, Flipkart, YouTube, Meta, Google Play and most platforms accept a Copyright Certificate as the cleanest proof for DMCA-style takedown requests. Without it, you submit affidavits and emails and hope.
• Customs IPR enforcement: The IPR (Imported Goods) Enforcement Rules let customs hold counterfeit imports once your copyright is recorded with the IPR cell. The certificate is what the cell asks for first.
• Investor and acquirer due diligence: VCs, PE buyers and enterprise procurement teams now run IP checks at term-sheet stage. A registered copyright on core software, brand artwork and content libraries is treated as a basic hygiene item.
• Criminal action under Section 63: Wilful infringement for commercial gain is a cognisable, non-bailable offence with imprisonment up to three years. Police FIRs and magistrate complaints move faster when backed by a registration certificate.
• Investor confidence on cap table: A clean copyright register sitting next to the cap table tells an acquirer that the company actually owns what it sells. Missing registrations create indemnity reserves and reduce valuation.

How It Actually Works

The path from manuscript to certificate is procedural, not creative. Here is what actually happens once you decide to file.

Step 1: Work Audit and Category Mapping

Every work goes into one of seven categories — literary, dramatic, musical, artistic, cinematograph film, sound recording, or software (filed as a literary work for procedural purposes). The category drives the fee, the form fields, and the prescribed copies you need to attach.

A brand identity package might split into three filings — the logo as artistic, the tagline as literary, the jingle as musical and as sound recording. Getting the split right at this stage avoids re-filing later.

Step 2: Authorship and Ownership Clean-Up

Section 17(c) makes the employer the first owner where the work is created in the course of employment, but only if there is no contrary agreement. For freelancers, contractors and commissioned work, Section 19 requires a written assignment to transfer ownership.

We pull employment contracts, consultancy agreements, NDAs and PO terms to verify the chain of title before filing. Co-authored works need NoCs from every author. Derivative works — translations, adaptations, remixes, forks — need a licence from the underlying-work owner.

Step 3: Form XIV Preparation and Filing

Statement of Particulars covers the title, language, category, year of completion, date of first publication, and author / publisher details. Statement of Further Particulars covers the medium, the underlying work (if any), and the rights claimed.

Prescribed copies — two hard copies for literary or musical works, first 25 and last 25 pages of source code for software, high-resolution images for artistic works, the recording itself for sound recordings — are uploaded. Statutory fees range from ₹500 for most works to ₹5,000 for cinematograph films.

Step 4: 30-Day Mandatory Objection Window

Once the diary number is issued, the Copyright Office holds the application for 30 days. Anyone with a claim — a co-author who was left out, a prior assignee, an earlier creator of a similar work — can file a written objection.

We monitor the docket daily through this window. If no objection comes in, the file moves to the Examiner. If an objection arrives, both sides are heard and the Examiner decides whether to proceed.

Step 5: Examiner Scrutiny and Discrepancy Reply

The Examiner reviews the form, the supporting documents, and the prescribed copies. If anything is unclear — an authorship gap, a missing NoC, a derivative work without a licence, a category mismatch — a discrepancy letter is issued.

You typically get 30 days to reply. Most filings clear scrutiny in one or two rounds; complex ones with multi-author software or assignment chains take longer and sometimes need a personal hearing over video.

Step 6: Registration and Certificate Download

On clearance, the Registrar makes an entry in the Register of Copyrights and the certificate is generated as a PDF downloadable from the portal. The certificate carries the registration number, the diary number, the date of registration, and a description of the work.

Once issued, the certificate does not need renewal. The protection runs for the statutory term tied to the author's life or to the year of publication, whichever applies.

A Real Example: A SaaS Product Across Four Filings

A B2B SaaS company about to raise a Series A wanted clean copyright records on its full product surface before due diligence. Here is how the filing pack looked.

• Software code (literary): Two filings — one for the main backend repo, one for the customer-facing mobile app. First 25 + last 25 pages of source code attached for each. Fee: ₹500 per work. Assignment papers collected from three ex-contractors and two current engineers.
• Brand logo (artistic, commercial use): Single filing for the wordmark and device. Fee: ₹2,000 because the logo is used commercially. NoC from the design agency that originally drew it, plus the assignment letter from their invoice.
• Help documentation and marketing copy (literary): Bundled into one filing for the help centre and product blog library. Fee: ₹500. Two co-authors on the team filed mutual NoCs.
• Onboarding videos (cinematograph film): Single filing covering the entire onboarding video series. Fee: ₹5,000. NoC from the freelance editor and the on-camera spokesperson under the DPDP consent requirement.

Total cost: ₹8,500 in statutory fees across four filings, plus professional fees. Total time: diary numbers in three days, all four certificates issued in eight to eleven months. The investor's IP diligence checklist was cleared in a single email with four PDFs attached.

What Backs Up Each Certificate

A certificate by itself is a defensive document. What turns it into an enforcement weapon is the asset register that sits behind it.

• Chain of title file: Every assignment, NoC, employment contract, consultancy agreement and licence that supports the registration kept in one folder, indexed by registration number.
• Original work archive: The exact version of the work that was registered — the source-code commit, the design file, the master recording — stored with a timestamp and hash so you can prove identity later.
• Use-and-licensing log: Who is licensed to use the work, on what terms, since when. Useful when the same work is licensed to multiple platforms and you need to prove which use is authorised.
• Infringement watchlist: A standing list of marketplaces, app stores, and platforms where your work is most likely to be copied. Quarterly checks catch infringement before it scales.
• Takedown template pack: Pre-drafted takedown notices for the major platforms, ready to attach the certificate and ship within hours of detection.

The certificate proves you own it. The asset register proves what version, since when, and licensed to whom — and that is what wins enforcement.

Where It Goes Wrong

Most rejected or stuck filings fail for the same handful of reasons. Almost all of them are avoidable at the pre-filing stage.

• Wrong category, wrong fee: A logo filed as literary instead of artistic, software filed at the ₹500 slab when it is used commercially as a brand asset — category mismatches force re-filing and reset the 30-day clock.
• Missing employer or contractor assignment: Software written by freelancers without an assignment, photographs taken by a contracted photographer with no transfer of rights, marketing copy from an agency without IP clauses — the Examiner asks and the file stalls until papers are produced.
• Co-author NoC gaps: Two-author scripts, three-author research papers, multi-developer software — one missing NoC and the application is held indefinitely.
• Derivative works without underlying-work licence: A translation, an adaptation, a remix, a software fork — copyright in the derivative does not displace the underlying right. Filing without the licence chain invites a Section 51 infringement reply.
• DPDP consent missing on people-facing works: Photographs, videos and podcasts featuring identifiable individuals now need consent of the depicted person. Old archives without consent slips become hard to register at commercial fees.
• Ignoring the 30-day objection: An objection comes in, the applicant misses the email, the matter is decided ex parte against them. The objection window is short and the response deadlines are unforgiving.
• Treating software like a patent: Algorithms and source code are protected by copyright, not patent, in India. Filing a patent application for code generally fails on Section 3(k) grounds — copyright is the right route.
