A patent gives you a 20-year monopoly on your invention in India. It is the strongest intellectual property right available โ stronger than copyright, broader than a trademark, more enforceable than a trade secret once granted. But it is also the hardest to get. The Indian Patent Office rejects more applications than it grants, and most rejections trace back to two failures: weak prior-art clearance and claims that collide with Section 3 exclusions.

The patent landscape has shifted on several fronts since 2024. Filing volumes are at record highs, prosecution timelines are tightening, and several procedural reforms now affect how applications are prepared and prosecuted.
Many inventors think filing equals protection. It does not. A patent application gives you a priority date and the right to mark your product 'Patent Pending' โ it does not stop anyone from copying you until the patent is actually granted. Understanding what a patent does, and what it does not, frames every decision in the next five years.
A patent application is a priority claim, not a shield. Until grant, you have the right to mark 'Patent Pending' and to sue for damages retroactive to publication โ but you cannot stop a copier in real time.
Indian patent prosecution runs on a clear procedural spine. The order matters; missing a date or skipping a form anywhere on the path can cost you the priority or the patent itself.
Everything starts with a structured inventor interview. The technical contribution is captured in a disclosure form: problem solved, prior approaches, the new approach, embodiments, drawings and experimental data. From there, prior-art search runs across WIPO PATENTSCOPE, Inpass, USPTO, EPO, JPO and non-patent literature. A written patentability opinion is delivered before any drafting begins. If the invention is not patentable, you save lakhs in wasted filing and prosecution fees by finding out now.
The specification is the legal heart of the patent. It contains the title, technical field, background, summary, detailed description, drawings, claims and abstract. A provisional specification fixes the priority date with a broad disclosure; the complete specification, due within 12 months, carries the full claims that survive examination. Claims are written as a ladder โ broad independent claims for commercial scope, narrow dependent claims as fallback positions when prior art bites.
Form 1 is the application for grant. Form 2 carries the specification. Form 3 declares any foreign patent filings on the same invention. Form 5 is the inventorship declaration. All four are e-filed on the CGPDTM portal in one bundle, with the correct entity-type fee โ large, small, startup or natural person. Form 26 Power of Attorney to the patent agent is filed at the same time.
The application is published in the Patent Office Journal 18 months after the earliest priority date. Early publication on Form 9 is available if you want to start the examination clock sooner. The Request for Examination on Form 18 must be filed within 48 months of priority โ missing this single deadline kills the application. Form 18A is the expedited route for startups, small entities, female applicants and select PCT applicants.
The First Examination Report (FER) is the examiner's first substantive critique of the application. Objections typically cover novelty, inventive step, Section 3 exclusions, sufficiency of disclosure and clarity of claims. The response window is 6 months from FER issue, extendable by 3 months on Form 4. The response is a written technical and legal argument, often with claim amendments. If unresolved, a Controller hearing is scheduled โ usually a 30-minute virtual proceeding.
Once objections are answered, the patent is granted and the certificate is issued. From the third year of the patent's life, annuity fees fall due โ small early on, rising sharply by year 12 and beyond. Pre-grant opposition under Section 25(1) can land any time before grant; post-grant opposition under Section 25(2) can land within 12 months after. Both are defended through written statements, evidence and Controller hearings.
Consider a DPIIT-recognised SaaS startup developing a new packet-routing algorithm tied to specific network hardware. The team wants protection in India first, with a PCT filing in year one.

Grant is not the end of patent work. The 20-year life of a granted patent demands continuous attention โ annuities, Section 8 updates where foreign prosecution is still alive, and a watch on potential infringers and opposition filings.
Most rejections, oppositions and revocations are self-inflicted. The same handful of mistakes account for the bulk of failed Indian patent prosecutions.
Section 3 โ not Section 2 โ is where most Indian patent applications die. Engineer the claims around the exclusion list before you file, not after the examiner points it out.
