A provisional patent application is the most under-rated tool in the Indian patent system. Filed under Section 9 of the Patents Act 1970, it secures a priority date for your invention, gives you 12 months to commercialise, raise funding, run experiments, and refine the technical disclosure, and then lets you file a complete specification โ domestic, PCT international, or direct foreign โ claiming the same priority. Used well, it shifts the cost and timing of the patent process in your favour. Used badly โ or skipped in favour of an immediate complete filing when the invention is still maturing โ it costs founders priority dates, foreign filing options, and sometimes the patent itself.
The 2026 reality is that most early-stage Indian inventors and startups should be filing provisional first, not complete first. Why? Because the moment a startup pitches investors, demos at a conference, files in a non-patent jurisdiction, publishes on its blog, or even shows a prototype to a partner without a strict NDA, the novelty clock starts. India follows an absolute novelty standard โ any disclosure anywhere in the world before the priority date can defeat novelty. A provisional patent stops that clock. It costs a fraction of a complete filing, requires only a working description (no claims required, although recommended), and converts the invention from a public-disclosure liability into a priority-protected asset.
We draft and file provisional patent applications that are technically sufficient under Section 10 โ meaning the disclosure is detailed enough to support the eventual complete specification's claims. A provisional that under-discloses leaves the complete with claim scope no broader than the under-disclosure, which means the priority date is effectively useless for parts of the claim ladder.
File provisional when (a) the invention is real and reduced to practice but commercial scope, embodiments, or experimental data are still maturing, (b) public disclosure is imminent (pitch, demo, paper, launch), (c) you want 12 months of optionality on PCT vs national filings, or (d) budget is constrained but priority cannot be lost. File complete directly when the invention is fully matured, claim scope is settled, and there is no benefit to a 12-month delay on examination.
It secures the priority date โ every later complete or PCT filing that claims this priority is tested for novelty against prior art existing on this date, not the later filing date. It does not get examined, does not get granted, does not become a patent on its own. If a complete is not filed within 12 months under Section 9(1), the provisional is deemed abandoned and the priority date is lost โ at which point any disclosures made in the intervening 12 months become defeating prior art for any future filing. We track the 12-month conversion deadline so this never happens by oversight.
