Provisional Patent Application

You have an invention. It is not quite finished — maybe the prototype works but the algorithm needs tuning, maybe the formulation is proven but you have not tested every variant. And you have a pitch deck due, a conference slot booked, or a strategic partner asking for a demo. The instinct is to wait until everything is perfect before filing a patent. That instinct loses inventions in India.

India follows absolute novelty: the moment you publicly disclose your invention — even to a single non-NDA party — the clock starts and the invention can no longer be patented. A provisional patent under Section 9 of the Patents Act, 1970 stops that clock. File it before you disclose, get your priority date, and you have 12 months to refine, build, raise money, and decide between a complete Indian filing or a PCT international application without losing a day of priority.

What's New for FY 2026-27

The Patent Rules underwent the most significant overhaul in two decades through the 2024 amendment, and several procedural changes affect how a provisional should be filed and converted today.

• RFE timeline shortened: The Request for Examination (Form 18) deadline has been cut from 48 months to 31 months from priority date for applications filed after 15 March 2024. This compresses the post-conversion examination window.
• Form 3 frequency reduced: The statement and undertaking on foreign filings is now filed once at filing and again within 3 months of the first foreign filing — no more 6-month periodic updates through pendency.
• Pre-grant opposition gated: The Controller first decides maintainability of opposition before issuing notice to the applicant. Frivolous oppositions are filtered, but oppositions can still surface closer to grant.
• Working statement eased: Form 27 (working of patent) is now filed once every financial year per three-year block instead of annually. Useful for the post-grant phase but signals lighter overall compliance friction.
• Divisional applications clarified: Section 16 has been amended to expressly allow divisionals from any prior pending application — including a provisional — putting earlier ambiguity to rest.
• Portal and DSC migration: The CGPDTM e-filing system has moved to the new portal with mandatory two-factor authentication. Older digital-signature tokens often need re-registration before the first FY 2026-27 filing.

Why File a Provisional Before You Disclose

• Absolute novelty kills late filers: Indian patent law treats any public disclosure before the filing date as defeating prior art. One LinkedIn post, conference talk, demo to a non-NDA investor or open-source code commit can destroy patentability worldwide.
• Cost discipline: A provisional costs a fraction of a complete in official fees and drafting hours. You buy 12 months of priority before committing to the full complete-specification investment.
• Maturation runway: Real inventions evolve. The 12-month window lets you test embodiments, gather experimental data, and refine the claim ladder so the eventual complete is broad and defensible.
• Foreign-filing optionality: One Indian provisional anchors priority in every Paris Convention country and supports either direct national filings or a PCT route. You decide at month 11 with real evidence of which jurisdictions matter.
• Fundraising leverage: A filed provisional with application number and priority date is materially different from 'we plan to file.' Term sheets and IP warranties look at filed status, not intent.
• First-to-file defence: If a competitor files on overlapping subject matter the day after you, your provisional priority date defeats their claim. The reverse is equally true if you delay.

How It Actually Works

Filing a provisional is mechanical once the strategy is decided. The work that matters happens before filing and after — disclosure capture upfront, and the 12-month maturation plan that follows.

Step 1: Inventor Disclosure and Strategy (3-5 days)

We start with a structured invention disclosure session under NDA. Every inventor on the application participates — co-inventorship matters for downstream disputes and for the inventorship declaration filed at complete stage. We document the technical contribution, the closest prior art the inventors are aware of, and the commercial use case. The output is a strategy memo: provisional vs straight-to-complete, India-only vs PCT, target jurisdictions, and fee-concession route (DPIIT, Udyam, natural-person or educational).

Step 2: Provisional Specification Drafting (1-2 weeks)

The provisional is drafted to Section 10(1) sufficiency. This means title, technical field, background, summary, drawings, detailed description and at least one example or embodiment. We do not file a stub. Under-disclosure here narrows the eventual complete claim ladder because anything not supported by the provisional cannot claim priority. We also draft skeletal claims even though Rule 13(2) does not require them — claims force precision on what the actual invention is.

Step 3: Form Filing and Fee Payment (1-2 days)

Form 1 captures applicant and inventor details. Form 2 carries the provisional specification. Form 3 declares any foreign filings on the same or substantially the same invention — even if none, the form is filed as a nil declaration. Official fees are paid online through the IP India portal at the applicable rate, with the 80 percent rebate applied where Startup India recognition or Udyam registration is in place.

Step 4: Filing Receipt and Priority Date (same day)

E-filing generates an instant filing receipt with the application number and priority date. We issue a safe-to-disclose memo confirming that disclosures made from this date forward will not defeat novelty for the invention as captured in the provisional. The memo is the document inventors and founders carry into investor meetings, conference pitches and partner negotiations.

Step 5: 12-Month Maturation and Disclosure Window

You pitch, demo, publish, build, partner and raise. We maintain a disclosure log — every public statement of the invention is timestamped and matched against the provisional disclosure. Anything disclosed that goes beyond the provisional is flagged because it cannot rely on the priority date and may need to be covered through additional filings or kept within the original scope until the complete is filed.

Step 6: Complete Specification or PCT Conversion (Month 9-12)

At month 9 we open the conversion decision: complete specification under Section 9(1) if the commercial intent is India-focused, or a PCT international application under Section 9(1A) if multi-jurisdiction. The complete includes mature claims, full supported description, and any additional embodiments developed during the 12 months. Both routes must be filed before the 12-month deadline; the 3-month Rule 138 extension exists but is discretionary and not relied on as a buffer.

A Real Example: SaaS Founder Filing Before Series A Pitching

A Bengaluru SaaS founder developed a novel scheduling algorithm for last-mile delivery routing. Series A pitching was due to start in three weeks across 20+ investor meetings, and a demo was scheduled at a logistics industry conference within 6 weeks.

• Inventor disclosure session: 2 days. Two co-inventors documented. Technical contribution captured: dynamic constraint relaxation under traffic-density variance.
• Provisional draft: 9 working days, including 3 drawings — system architecture, data flow, constraint solver.
• Fee position: DPIIT Startup India recognition in place — 80 percent concession applied. Provisional official fee at the startup rate: ₹1,600.
• Form filing: Form 1, Form 2, Form 3 (nil foreign filings) submitted on the IP India portal. Application number and priority date issued the same day.
• Safe-to-disclose memo: Issued within 24 hours of the filing receipt.
• Pitching and demo: Series A meetings and the conference demo proceeded with priority secured. Disclosure log maintained against the provisional content.
• Month 11 conversion: Complete specification with refined claim set drafted; PCT international application filed concurrently claiming Indian priority. Target national-phase jurisdictions: US, EU, UK, Singapore.
• Total cost: Across provisional + complete + PCT international phase: under ₹3.5 lakh in professional fees and roughly ₹1.2 lakh in official fees with the startup concession.

Without the provisional, the pre-pitch demo and the conference disclosure would have defeated novelty. The complete or PCT filed 11 months later would have been refused on the founder's own disclosures as prior art.

What Backs Up Your Priority Date

The provisional filing is one document, but the strength of the priority position depends on supporting evidence. We assemble and retain the following for the 12-month window.

• Filing receipt: Application number and date, digitally retained and version-controlled.
• Specification as filed: Provisional PDF including all drawings, with a cryptographic hash for evidentiary integrity.
• Inventorship record: Disclosure session notes and signed statements identifying every inventor.
• Assignment deed: From inventor to applicant where the applicant is a company, dated before or contemporaneous with the filing.
• Disclosure log: Every public statement of the invention captured with date, audience and content.
• NDAs: Executed with investors, partners and potential licensees before disclosure.
• Foreign-filing decision memo: Drafted at month 9 setting out the PCT vs direct route reasoning.
• Conversion calendar: 9 / 6 / 3 / 1-month internal milestones for the complete or PCT deadline.

The provisional secures the priority date — but the strength of that priority depends entirely on the sufficiency of the specification. A stub provisional is worse than no provisional, because it can mislead the inventor into unsafe disclosures.

Where It Goes Wrong

• Filing a stub provisional: A one-page summary fails Section 10(1) sufficiency. The eventual complete cannot claim priority for anything not supported by the stub, which defeats the entire point of the filing.
• Missing the 12-month deadline: Under Section 9(1), failure to file the complete within 12 months causes the provisional to be deemed abandoned. The Rule 138 three-month extension is discretionary and not granted in every case.
• Disclosing beyond the provisional: Founders pitch the matured version of the invention, not the version captured at filing. Anything beyond the provisional disclosure cannot rely on the priority date.
• Inventorship errors: Leaving out a co-inventor or adding a non-inventor founder for goodwill creates disputes that can invalidate the patent under Section 64. Inventorship is a legal determination, not a courtesy.
• Form 3 nil-filing missed: Applicants forget to file Form 3 when there are no foreign filings, treating it as not required. The nil-statement must still be filed.
• Assignment skipped: If the applicant is a company but the inventor is an individual employee or founder, an assignment deed must exist at or before filing. Late assignments create chain-of-title gaps.
• Premature PCT without budget: Filing PCT without committing to national-phase fees in the target jurisdictions burns the priority. National-phase costs are 5-10x the PCT international phase cost.
• Public disclosure before filing: A demo, blog post, pitch deck shared on the internet, or open-source commit dated before the filing date defeats novelty. The provisional cannot retroactively cure a prior disclosure.
