You have an invention. It is not quite finished โ maybe the prototype works but the algorithm needs tuning, maybe the formulation is proven but you have not tested every variant. And you have a pitch deck due, a conference slot booked, or a strategic partner asking for a demo. The instinct is to wait until everything is perfect before filing a patent. That instinct loses inventions in India.
India follows absolute novelty: the moment you publicly disclose your invention โ even to a single non-NDA party โ the clock starts and the invention can no longer be patented. A provisional patent under Section 9 of the Patents Act, 1970 stops that clock. File it before you disclose, get your priority date, and you have 12 months to refine, build, raise money, and decide between a complete Indian filing or a PCT international application without losing a day of priority.
The Patent Rules underwent the most significant overhaul in two decades through the 2024 amendment, and several procedural changes affect how a provisional should be filed and converted today.
Filing a provisional is mechanical once the strategy is decided. The work that matters happens before filing and after โ disclosure capture upfront, and the 12-month maturation plan that follows.
We start with a structured invention disclosure session under NDA. Every inventor on the application participates โ co-inventorship matters for downstream disputes and for the inventorship declaration filed at complete stage. We document the technical contribution, the closest prior art the inventors are aware of, and the commercial use case. The output is a strategy memo: provisional vs straight-to-complete, India-only vs PCT, target jurisdictions, and fee-concession route (DPIIT, Udyam, natural-person or educational).
The provisional is drafted to Section 10(1) sufficiency. This means title, technical field, background, summary, drawings, detailed description and at least one example or embodiment. We do not file a stub. Under-disclosure here narrows the eventual complete claim ladder because anything not supported by the provisional cannot claim priority. We also draft skeletal claims even though Rule 13(2) does not require them โ claims force precision on what the actual invention is.
Form 1 captures applicant and inventor details. Form 2 carries the provisional specification. Form 3 declares any foreign filings on the same or substantially the same invention โ even if none, the form is filed as a nil declaration. Official fees are paid online through the IP India portal at the applicable rate, with the 80 percent rebate applied where Startup India recognition or Udyam registration is in place.
E-filing generates an instant filing receipt with the application number and priority date. We issue a safe-to-disclose memo confirming that disclosures made from this date forward will not defeat novelty for the invention as captured in the provisional. The memo is the document inventors and founders carry into investor meetings, conference pitches and partner negotiations.
You pitch, demo, publish, build, partner and raise. We maintain a disclosure log โ every public statement of the invention is timestamped and matched against the provisional disclosure. Anything disclosed that goes beyond the provisional is flagged because it cannot rely on the priority date and may need to be covered through additional filings or kept within the original scope until the complete is filed.
At month 9 we open the conversion decision: complete specification under Section 9(1) if the commercial intent is India-focused, or a PCT international application under Section 9(1A) if multi-jurisdiction. The complete includes mature claims, full supported description, and any additional embodiments developed during the 12 months. Both routes must be filed before the 12-month deadline; the 3-month Rule 138 extension exists but is discretionary and not relied on as a buffer.

The provisional secures the priority date โ but the strength of that priority depends entirely on the sufficiency of the specification. A stub provisional is worse than no provisional, because it can mislead the inventor into unsafe disclosures.
