The Shop and Establishment Licence โ more accurately the Shops and Establishments registration โ is the foundational labour-side authorisation for any commercial premises in India. It is issued under the State Shops and Establishments Act of the State in which the premises is located: Bombay Shops and Establishments Act 1948 (Maharashtra), Delhi Shops and Establishments Act 1954, Karnataka Shops and Commercial Establishments Act 1961, Tamil Nadu Shops and Establishments Act 1947, West Bengal Shops and Establishments Act 1963, Telangana Shops and Establishments Act 1988 (carried forward into Telangana), Gujarat Shops and Establishments Act 2019, and analogues in every other State and Union Territory. Each Act differs in registration timeline, fee, renewal periodicity, employee thresholds and inspection regime โ but the framework purpose is identical.
The Shops Acts cover commercial establishments โ shops, offices, godowns, restaurants, theatres, hotels, residential hotels, eating houses โ with employed persons. Manufacturing units with power and 10+ workers (or without power and 20+ workers) fall instead under the Factories Act 1948. The Shops Act regulates working hours (typically 9 hours per day / 48 hours per week), spread-over, weekly off (at least one full day per week), opening and closing hours, rest intervals, annual leave with wages, casual and sick leave, festival and national holidays, woman employee working-hour restrictions (varies by State, with safety conditions for night shifts in IT / ITeS), young person and child employment prohibitions, wages payment, termination notice, and maintenance of registers (employment, wages, leave, attendance, deductions, fines).
Registration must be filed within 30 days of commencement of business in most States. The application discloses the establishment name, employer name, category (shop / commercial establishment / restaurant / theatre etc.), address, nature of business, manager / authorised person, employee count by category (adult male / adult female / young person), date of commencement and weekly off. Registration certificates are typically valid for 1 to 5 years depending on State (Maharashtra Gumasta is 1-10 years at applicant's option; Karnataka 5 years; Delhi lifetime with intimation of changes; Tamil Nadu 1 year, etc.) with renewal discipline matching.
By 2026 nearly every State Labour Department has migrated Shops Act registration to an online Shram Suvidha-linked or State labour portal with self-attestation, deemed-approval timelines, and unified Labour Identification Number (LIN) integration. Tamil Nadu (1947), West Bengal (1963), Telangana (1988), Gujarat (2019): each with its own form, fee schedule and renewal cadence; portal routes vary.
Adult: 9 hours / day, 48 hours / week, with overtime at double wages beyond. Spread-over typically 10.5-12 hours. Weekly off compulsory; closure of establishment on weekly off prescribed. Annual leave with wages typically 1 day per 20 days worked (15 days minimum). Casual leave 7-12 days, sick leave 7-12 days (State-specific). Women employees historically barred from work between 9.30 PM and 7 AM under most State Acts; relaxed by recent State amendments (Karnataka, Maharashtra, Telangana) for IT / ITeS / BPO subject to written consent, transport, security and grievance-redress conditions.
Shops Act registration is the proof of establishment used to enrol with EPFO, ESIC, Professional Tax authority, Labour Welfare Fund and to file the half-yearly / annual labour returns. Without it, every downstream registration is fragile and every inspection becomes a cascading violation. With it filed cleanly and renewed on time, the establishment has its labour-side architecture standing.
