India generates over 160,000 tonnes of municipal solid waste every day โ and less than 30 percent of it is scientifically processed. If you are setting up a composting plant, an RDF facility, a biogas plant, or a Waste-to-Energy project, you need an authorisation from your State Pollution Control Board (SPCB) under the Solid Waste Management Rules 2016. This is the legal clearance that allows you to receive, process, and commercially dispose of MSW.
Getting that authorisation is rarely a single-window exercise. You typically need an Environmental Clearance (EC) under the EIA Notification 2006, a Consent to Establish and Operate from the SPCB, a Factory Licence, a Fire NOC, and often a Power Purchase Agreement (PPA) for WtE โ all before commercial operations can begin. Add a ULB concession contract, and the coordination challenge becomes substantial. We manage that entire stack end-to-end.
SWM regulation and project economics have shifted materially this fiscal year. Here are the changes that affect any new or existing SWM facility.
SWM facility setup is a multi-phase, multi-authority process. The sequence matters โ authorisations obtained in the wrong order cause costly restarts.
We assess your site location, proposed capacity, and local waste-mix data โ wet/dry ratio, organic fraction, calorific value. Pathway selection (composting vs. RDF vs. biogas vs. WtE) follows from this analysis alongside a financial model covering capex, tipping-fee requirement, and projected output revenue. EC applicability is confirmed at this stage so you know your approvals timeline before committing to a contract.
For ULB tenders (RFP/RFQ), we prepare the technical and financial bid, structure the tipping-fee ask, and advise on performance security quantum. For bilateral negotiations with smaller ULBs, we draft the concession or O&M agreement โ covering waste-volume guarantees, segregation obligations, SLA penalties, and tipping-fee escalation clauses linked to WPI or CPI.
For WtE and large facilities, EC under the EIA Notification 2006 requires filing with the State EAC or MoEFCC Expert Appraisal Committee. We prepare Form-1, Pre-Feasibility Report (PFR), Terms of Reference (ToR), and the full Environment Impact Assessment report including public hearing coordination. EC timelines typically run 12โ18 months โ beginning this process at feasibility stage, not post-contract, is the single biggest timeline lever.
Consent to Establish (CTE) from the SPCB is filed after EC grant โ or concurrently for EC-exempt projects. We prepare the technical application, emission and effluent compliance documentation, and coordinate the SPCB site inspection. Consent to Operate (CTO) follows after construction. Fire NOC, Factory Licence, and PESO approval (biogas) run in parallel to avoid delays at commissioning.
During construction we track EC and CTE compliance conditions to ensure commissioning trials meet regulatory standards. Post-commissioning, we file for CFO (Combined Factory/Operating consent) renewal and prepare the compliance dossier for the SPCB joint inspection required before commercial operations begin. This inspection is frequently a bottleneck โ advance preparation eliminates the delay.
Compost requires FCO (Fertilizer Control Order) registration for commercial sale โ including quality testing for NPK content, heavy metals, and pathogens. RDF requires a signed off-take agreement with a cement plant or co-processor meeting CPCB specifications. WtE requires a PPA under SERC tariff regulations; CBG projects need MNRE SATAT registration. We structure and negotiate each of these.

The same project structured as a biogas plant would generate CBG revenue under MNRE's SATAT scheme โ but adds PESO approval for compressed gas storage and MNRE SATAT registration as additional authorisation steps before commercial supply begins.
The SWM authorisation is not a one-time certificate. It carries ongoing compliance obligations โ lapses trigger show-cause notices and can result in facility sealing.
A CTO that lapses โ even by 30 days โ gives the SPCB grounds to seal the facility and initiate prosecution under the Environment Protection Act 1986. Set renewal alerts 90 days ahead without exception.
