Copyright Registration

Copyright in India does not need to be registered to exist. The moment an original work of authorship is fixed in a tangible form — a line of code committed to a repository, a manuscript saved to disk, a photograph taken, a musical composition recorded, a film master cut — copyright subsists automatically under the Copyright Act 1957, and India's adherence to the Berne Convention for the Protection of Literary and Artistic Works extends that automatic protection to the 180+ Berne member jurisdictions without further formality. Registration is voluntary. So why do serious businesses, investors, and acquirers insist on it? Because the difference between unregistered and registered copyright is not legal existence — it is evidentiary weight. In an infringement suit, a registered Copyright Certificate is prima facie evidence of ownership, authorship, and the date of creation under Section 48 of the Act. Without it, the same facts have to be proved through emails, drafts, server logs, and witness testimony — slower, more expensive, and far more contestable.

The framework is the Copyright Act 1957 read with the Copyright Rules 2013, administered by the Copyright Office under the Department for Promotion of Industry and Internal Trade (DPIIT). Registration is filed on Form XIV, with statutory fees ranging from ₹500 to ₹2,000 per work depending on the category — software typically ₹500, literary / dramatic / musical works ₹500, artistic works used or capable of being used in connection with goods or services ₹2,000, cinematograph films ₹5,000, sound recordings ₹2,000. The application is filed online on the Copyright Office portal with the prescribed copies of the work, a statement of particulars, a statement of further particulars, and an NoC from any third party with rights in the work. Once filed, a 30-day mandatory waiting period opens — to allow any objection from third parties — after which, if no objection is received (or any objection is decided in the applicant's favour), the work moves to scrutiny and the certificate is issued. Once issued, the registration is permanent — there is no renewal cycle, no annuity, no maintenance.

What Copyright Categories Are Registrable

• Literary Works:: Books, articles, manuals, training material, blogs, technical documentation, contractual templates — any original written expression. Source code is also classified as a literary work under the Copyright Act.

• Computer Software:: Source code and object code; mobile apps; SaaS platforms; firmware. Source code excerpts (typically first 25 and last 25 pages) filed with the application; full source archived with the Copyright Office on request.

• Artistic Works:: Logos, drawings, paintings, photographs, architectural drawings, maps, diagrams, sculptures. Where the artistic work is used in connection with goods or services (e.g. a logo), the higher fee applies.

• Musical Works:: Original musical compositions, lyrics; the musical work is registrable separately from the sound recording embodying it.

• Cinematograph Films:: Films, documentaries, short films, advertising films; the film is registrable separately from the underlying script (literary), music (musical) and sound recording.

• Sound Recordings:: Studio recordings, audiobooks, podcasts (where they qualify as original sound recordings).

• Dramatic Works:: Plays, scripts, choreographic works, stage performances reduced to writing.

Why Voluntary Registration Is a Commercial Decision

For software companies, content publishers, training institutes, design studios, music labels, and film producers, the copyright certificate is now a baseline ask in IP DD by VC investors, enterprise procurement teams, and strategic acquirers. The certificate provides a strong evidentiary presumption in litigation, simplifies takedown notices on platforms (YouTube Content ID, Amazon, Flipkart, app stores), and is admissible as proof of ownership in customs and criminal complaints. The cost — ₹500 to ₹2,000 per work plus professional fees — is trivial against the asset being protected, and unlike trademark or patent, the certificate is permanent: file once, own the evidentiary edge for life.
