What's New for FY 2026-27

The trademark and copyright landscape has a few procedural updates worth knowing before you file.

• TM portal — e-filing only: The Trade Marks Registry no longer accepts physical TM-A submissions. All applications must be filed through the IP India e-filing portal; paper submissions are returned without processing.
• Opposition window: The opposition period remains 4 months from publication in the Trade Marks Journal. Filing volumes at the Registry have increased, making active monitoring of your application status more important than in prior years.
• Startup India fee concession: DPIIT-recognised startups continue to qualify for the concessional ₹4,500 per class rate. Your DPIIT recognition certificate must be attached to the TM-A at the time of electronic filing to trigger the reduced fee.
• Copyright e-filing standard: The Copyright Office has standardised Form XIV submissions through its e-filing portal. Physical filings are no longer accepted; digital signatures are accepted in lieu of wet signatures throughout the process.
• DPDP Act 2023 — brand implications: If your logo or brand identity appears on any data-collecting digital interface — an app, a website, an onboarding form — that interface element may warrant a separate copyright registration, given India's Digital Personal Data Protection Act 2023 now governs such products.
• Nice Classification 12th edition: Nice Classification updated its class descriptions in 2024. Verify your class mapping against the current edition before filing; outdated class language can trigger formality objections at the examination stage.

Who Needs a Brand-Integrated Logo Design Package

• New company incorporating: Your brand's visual identity should be secured at the time of incorporation — not six months later after you have printed packaging, run ads, and discovered a confusingly similar registered mark already exists.
• App or SaaS launch: Class 9 (software products) and Class 42 (technology services) filings should precede your public launch. A published app or live website establishes prior use that a later filer can argue against your application.
• D2C product brand: Your product packaging, label, and e-commerce listings all carry the logo. File the device mark in the relevant product class before your manufacturer produces the first commercial batch.
• Franchise or licensing intent: You cannot franchise or license a brand you do not legally own. A clean chain of title — strategy brief, design, IP assignment deed, trademark registration — is the non-negotiable prerequisite for any licensing structure.
• NRI or overseas founder: Building an Indian entity and brand simultaneously? The IP must sit in the Indian entity's name from day one to avoid stamp duty and valuation complications if an assignment is attempted later.
• Rebranding: An existing logo that is legally unprotected or built around a name with no TM search behind it is a liability. Rebranding is the right moment to start fresh with a clean search and correct filing.

How It Actually Works

The engagement has six stages — three design stages and three legal and filing stages running roughly in parallel.

Step 1: Brand Strategy Brief (2–3 Days)

Before any concept is sketched, a written positioning and tonality brief is prepared: who the brand is for, what it stands for, what voice it uses, who it competes with, and which visual languages already dominate the category. You review and approve this document. It becomes the single source of truth for all design decisions and the benchmark against which every revision is measured.

Step 2: Three Visual Directions (4–6 Days)

Three distinct logo directions are presented — one typography-led (wordmark or lettermark), one mark-led (icon or monogram paired with type), and one combination mark — each with a written rationale explaining how it expresses the approved brand brief. You are not choosing from random options; you are choosing from argued positions. This makes the selection conversation productive rather than purely subjective.

Step 3: Convergence and Refinement (3–5 Days)

You select one direction — or a hybrid of two — and it moves through two structured rounds of refinement. Colour palette, typeface, spacing, geometry, and proportions are locked by the end of this stage. All revisions are tracked against the original strategy brief so creative drift is identified and corrected before any files are finalised.

Step 4: Final Files and Brand Guidelines (3–4 Days)

Vector master files (AI, SVG, PDF, EPS) are exported in three variants: full-colour, monochrome, and reversed (white on dark). The raster pack covers PNG and JPG at every standard web and print size, plus a favicon set from 16px to 512px and a social-media kit with square, horizontal, story, and banner formats for dark and light mode. The brand guidelines document covers clear-space rules, minimum size, colour values (HEX, RGB, CMYK, Pantone), typography pairings, and a do-not section.

Step 5: Trademark Filing (1–2 Days)

A class-mapping exercise identifies every Nice class your actual business activities fall under. We run a preliminary TM search on the IP India portal for conflicting marks, flag any risks, and file TM-A electronically. You receive the official application number and the Trade Marks Journal publication date — from which your 4-month opposition window begins — within days of filing.

Step 6: Copyright Registration and Closure (1–2 Days)

Form XIV under Section 45 of the Copyright Act 1957 is filed in your entity's name. Supporting documents include the final approved artwork, a statement of authorship, and the signed IP assignment deed transferring all rights from the designer to your entity. The Application Reference Number (ARN) is tracked, and a closure ZIP containing all design files, filing acknowledgements, and receipts is shared with you.

A Real Example: D2C Skincare Brand Launch

Consider a founder launching 'Mritika' — an ayurvedic skincare brand incorporating as a private limited company in FY 2026-27.

• Classes filed: Class 3 (cosmetics, skin-care preparations) plus Class 35 (retail trade, e-commerce) — a two-class TM-A application filed electronically.
• Government fee (company): ₹9,000 per class × 2 classes = ₹18,000 total TM-A government fee payable at filing.
• Logo output: A Sanskrit-script-inspired wordmark combined with a botanical icon mark; four colour variants; an earthy Pantone palette with CMYK equivalents specified for packaging print.
• Copyright filing: Form XIV filed in the company's name with a NOC and signed IP assignment deed from the designer attached as mandatory supporting documents.
• Day-one symbol use: ™ placed on all product packaging, website header, and social profiles from the TM-A filing date — permitted under common-law rights before registration is granted.
• Estimated ® date: ® permissible approximately 14–16 months post-filing, after examination is cleared and the 4-month opposition window closes without adverse action.

The total government fee outlay was ₹18,000. The professional service fee covers strategy, design, and both IP filings. The counterfactual — discovering a confusingly similar mark after launch, after printing 10,000 units of labelled packaging — is many times more expensive to resolve.

After Your Logo Is Delivered: What You Must Do

A delivered logo is the starting line for IP management, not the finish line. Six actions protect what you have built.

• Use ™ immediately: Place the ™ symbol on every use of your logo from the TM-A filing date. This puts the market on notice of your pending application without claiming registered status you do not yet hold.
• Monitor TM Journal: After your application is published in the Trade Marks Journal, any third party has 4 months to file opposition. Track your application number on the IP India portal and respond promptly to any office actions or examination reports.
• Do not use ® prematurely: Using the ® symbol before the Trade Marks Registry grants registration is a criminal offence under Section 107 of the Trade Marks Act 1999. Switch from ™ to ® only after you receive the formal registration certificate.
• Renew every 10 years: Trademark registration is valid for 10 years from the date of the original application and is renewable indefinitely. Missing the renewal window requires a restoration application with additional fees and leaves your mark vulnerable to removal from the register.
• Keep the assignment deed: The signed IP assignment deed is your title document for the copyright in the artwork. File it with your permanent company records and have a certified copy available to any legal counsel who needs to assert or defend the IP.
• Distribute brand guidelines: Share the brand guidelines PDF with every vendor, printer, social-media manager, and employee who uses your logo. Unauthorised colour changes, stretching, or unapproved variants are the most common source of brand dilution — and they typically happen internally, not externally.

Using ® before registration is granted is a criminal offence under Section 107 of the Trade Marks Act 1999. From your TM-A filing date, ™ is your correct symbol. Switch to ® only once the registration certificate is formally issued.

Where Logo Projects Go Wrong

• Raster-only delivery: Accepting a PNG or JPEG as the 'master file' without the vector source (AI or SVG) means you cannot scale the logo, reproduce it above a certain size without quality loss, or register the artwork without an expensive digital redraw.
• No IP assignment deed: If the designer retains copyright — because no written assignment was executed — your trademark and copyright registrations can be legally challenged by the original artist even years after the work was delivered and paid for.
• Wrong class selection: Filing in Class 35 (business services) when your primary product is software (Class 9) leaves your core commercial category entirely unprotected. Correct class selection requires mapping actual business activities, not making assumptions.
• Skipping the TM search: Designing a compelling logo around a brand name that turns out to be confusingly similar to an existing registered mark leads to examination objection, opposition, or court action. A TM search before the strategy brief is started is non-negotiable.
• Missing the word mark: A device mark protects the specific visual combination of icon, type, and layout. It does not protect your brand name across all visual treatments. Filing a standalone word mark alongside the device mark is essential for comprehensive coverage.
• Using ® before registration: A common oversight with serious legal consequences — Section 107 of the Trade Marks Act 1999 makes misuse of the ® symbol a punishable offence. Use ™ at all times until the registration certificate is formally received.
• Single-class filing for a multi-sector brand: A food brand that also runs cooking workshops needs filings in the relevant food product class and in Class 41 (education and training). Filing in one class leaves the other sector open for any third party to claim.
• No brand guidelines document: Without documented colour values, typography rules, and clear-space requirements, your logo will be stretched, recoloured, and misused — typically by vendors and agencies working in good faith with the wrong version of the file.
