What's New for FY 2026-27

Regulatory rhythm at the Indian IP office has shifted considerably in the last 18 months. If your portfolio strategy is older than that, it almost certainly needs a refresh.

• Pure e-filing: All trademark prosecution — applications, examination responses, oppositions, renewals — now runs through the IP India portal. Paper filings are no longer accepted and physical hearings have largely shifted to video.
• Faster examination: First examination reports for trademarks are now issuing in 4-6 months for routine classes, down from 9-12 months earlier. Response timelines are stricter and extensions harder to get.
• DPDP Act overlap: Digital Personal Data Protection Act 2023 rules notified for 2026 mean IP licensing or assignment touching customer data, employee inventor records or NRI personal data needs revised consent and processing clauses.
• Customs IPR tightening: Recordal renewals require fresh proof of ownership and product samples. Old recordals from 2018-2020 are being audited and many have lapsed without holders realising.
• Patent rules amended: Working statement Form 27 filing has been simplified to once every three years and pre-grant opposition rules have been tightened to reduce frivolous filings without delaying genuine grants.
• Madrid Protocol uptake: India has expanded examination support and the timeline from international filing to Indian national protection is now around 12-14 months, making Madrid more attractive than direct filings for most outbound brands.

How It Actually Works

The engagement runs as one continuous programme broken into six work tracks. Each has a different cadence and reporting rhythm so nothing falls between the cracks.

Step 1: IP Audit and Inventory

We start with a 1-2 week catalogue exercise. Every registered and pending IP asset across India and foreign jurisdictions gets verified against official portals — IP India, USPTO, EUIPO, WIPO Madrid, PCT. Ownership chain is traced from original applicant through every assignment, merger and licence. Status, renewal date and current proprietor are reconciled against your internal records. Gaps, mistakes and unrecorded assignments are flagged with remediation plans.

Step 2: Strategy and Filing Roadmap

A 1-week strategy phase converts the audit into action. New filings (trademarks in new classes, patents in priority jurisdictions, designs for new product launches), conversions (national-phase entries, Madrid designations), corrections (assignment recordals, name changes) and divestments (lapsed marks worth abandoning) are sequenced over a 12-24 month roadmap with a budget calendar.

Step 3: New Filings and Conversions

Ongoing prosecution work begins. Indian filings — trademark, patent provisional and complete, design, copyright — are managed through IP India. Foreign work runs through partner counsel in destination jurisdictions, coordinated by us so you deal with one team. PCT national-phase entries are calendared at month 28 (two months before the 30-month deadline) to allow translation, claims tailoring and local agent appointment.

Step 4: Watch, Opposition and Renewal

Step 5: Enforcement and Licensing

Event-driven matters get handled as they arise. Cease-and-desist letters, John Doe and Anton Piller orders, infringement suits, criminal complaints under Sections 103 and 104 of the Trade Marks Act, UDRP and INDRP domain disputes. On the commercial side, licensing agreements, royalty audits and assignment deeds are drafted with future enforcement in mind.

Step 6: Annual Portfolio Review

Each year ends with a portfolio review. M&A and DD readiness gets retested. Budget for the following year is built. Marks no longer used commercially are flagged for abandonment to reduce renewal spend. Patents close to lapse are evaluated against revenue contribution before annuities are paid for another costly year.

Consider a Bangalore-based D2C skincare brand with three years of trading, ten product lines and growing exports to the UAE, UK and Singapore.

• Starting portfolio: Two registered trademarks in Class 3 (cosmetics) covering the house brand. One pending application in Class 5. No foreign protection. No design registrations. No copyright recordal. No customs filing. One lapsed domain variant.
• Audit findings: Four unregistered sub-brands actively sold for 18 months, three packaging designs eligible for registration, an entire app and software codebase uncovered, and a marketplace impersonator selling at half the price.

The Renewal and Annuity Calendar

Renewal economics determine portfolio health. Built into the engagement is a redundant reminder system so deadlines never depend on memory or scattered email folders.

• Trademark renewals: Every 10 years from application date under Section 25 of the Trade Marks Act. The six-month window before expiry is the cheap window. The one-year restoration window after expiry costs roughly five times more and triggers re-publication with possible opposition.
• Patent annuities: Payable from the third year onward under the Patents Act 1970, with fees escalating each year. Late payment within six months attracts surcharge; beyond that the patent lapses and restoration becomes a contested, evidence-heavy proceeding.
• Design renewals: Initial 10 years from registration plus a single renewal extension of five years under the Designs Act 2000. A second extension does not exist — at year 15 the design enters public domain.
• Foreign annuities: Each jurisdiction runs its own rhythm — US patent maintenance at years 3.5, 7.5 and 11.5; EPO renewals annually from year three; Madrid trademark renewals every 10 years from the international registration date.
• Copyright: No renewal needed — protection runs for the author's life plus 60 years in India. Register once, file the proof of ownership, and the certificate is permanent.

On-time renewal costs are a small fraction of restoration costs, and lapsed rights mean lost enforcement leverage. Calendar discipline is the single highest-ROI part of IP management.

Where It Goes Wrong

• Ownership in founder's name, not company: Pre-incorporation trademarks and copyrights filed in personal name without later assignment deed. The mismatch surfaces at the first VC due diligence and gets discounted hard or held in escrow.
• Single-class trademark thinking: Brand filed only in the primary class. Year three diversifies into adjacent products and a competitor lawfully registers the same mark in the new class. Recovery is contested, slow and expensive.
• Missing Section 39 licence: Indian residents file directly abroad without first obtaining a foreign-filing licence from the Indian Patent Office, attracting penalty and risking patent invalidity on the Indian counterpart.
• PCT 30-month miss: National-phase entry calendared loosely, then translation and local agent fees come due all at once and one jurisdiction is dropped. Rights in that country are gone permanently with no restoration route.
• Customs recordal lapsed: Recordal valid for five years, then quietly expires; counterfeit shipments resume entering ports unchecked while the brand owner assumes protection is still active.
• Watch turned off to save cost: Annual subscription cancelled in a budget review, six months later a confusing mark registers unopposed and dilutes the brand in its strongest class.
• No assignment deed for ex-employees: Inventor or designer leaves on bad terms and refuses to sign retrospective assignment, blocking future enforcement against that very employee or their new venture.
• Domain variants ignored: Typosquats and country-code variants left unregistered, then used for phishing, customer fraud or to redirect traffic to a competitor's storefront.
