Environmental Licensing

Environmental licensing in India is not one approval — it is a layered stack of clearances, consents, and authorisations under at least six separate statutes, each administered by a different authority. A typical industrial project needs Environmental Clearance (EC) from MoEFCC, Consent to Establish and Consent to Operate (CFE/CFO) from the State Pollution Control Board (SPCB), and — depending on what your process generates — separate authorisations for hazardous waste, e-waste, plastics, batteries, or groundwater abstraction. Getting the sequence wrong costs months.

The real risk isn't the paperwork — it's starting construction before EC, filing CFE without a matched EC reference, or missing a renewal that triggers a show-cause notice from the SPCB. PARIVESH 2.0 has made central clearances more trackable for FY 2026-27, but State SPCB portals remain fragmented. This guide covers what actually applies to your project, the realistic timelines, and where projects typically stall.

• Turnaround: 12–24 months for the standard stack (EC + CFE + CFO + HW). Forest, Wildlife, or CRZ Clearances add 6–24 months where the project site triggers them.
• Hard rule: No construction or site preparation before EC. Violation under the EP Act attracts closure orders, NGT proceedings, and criminal liability under Section 15.

What's New for FY 2026-27

Several procedural and regulatory changes have been embedded in the FY 2026-27 approval workflow. These affect every project currently at any stage of the licensing pipeline.

• PARIVESH 2.0 integration: EC, Forest Clearance, Wildlife Clearance, and CRZ Clearance now share a single login. EAC and SEAC conduct meetings online by default; document upload validations are significantly stricter than the earlier portal version.
• EPR portals operational: The CPCB EPR portal for E-Waste (Rules 2022), Plastic Waste (Rules amended 2022), and Battery Waste (Rules 2022) is fully live. Annual EPR returns are mandatory; non-filing attracts penalties under the EP Act.
• CGWA 2022 classification active: Groundwater blocks are classified as safe, semi-critical, critical, or over-exploited. Extraction above threshold in critical or over-exploited areas requires CGWA NOC before any construction — including temporary borewells for site water supply.
• EIA Notification amendments: Sector-specific amendments and MoEFCC office memoranda continue to update the 2006 Notification. Verify the current sector notification before drafting Form 1 — filing against a superseded category table is a consistent and avoidable error.
• Green Credit Programme: Notified under the EP Act in 2023 and operational from FY 2024-25, the GCP allows projects to earn and trade credits for afforestation, water conservation, and e-waste activities. Voluntary, but increasingly relevant for ESG-linked project financing.
• NGT compliance visibility: SPCBs are uploading inspection reports and real-time consent status to their portals. Non-compliance is now visible to regulators, lenders, and counterparties in ways it was not two years ago.

Which Projects Need the Full Stack

• New industrial plants: Any manufacturing, processing, or mining project in the EIA Notification 2006 Schedule needs EC before site preparation begins — from bulk drugs and chemicals to food processing and textiles above the threshold capacity.
• Capacity expansions: Expansion beyond the prescribed threshold (typically 25–50% of installed capacity) triggers a fresh EC or an EC amendment. The SPCB also requires a revised CFE for the expanded capacity.
• Product or process change: A change in product mix, raw material, or manufacturing process that increases pollution load requires EC amendment and CFE revision — even if the physical plant footprint stays the same.
• Hazardous waste generators: Any unit generating, storing, or handling wastes listed in Schedule I–IV of HW Management Rules 2016 needs HW Authorisation from the SPCB, independent of EC status.
• Groundwater users: Industrial borewells above extraction thresholds, or in notified aquifer areas, need CGWA NOC — filed separately from EC and CFE, with its own renewal cycle.
• Producers and brand owners: Manufacturers, importers, and brand owners of electronics, plastic packaging, or batteries above threshold quantities need EPR registration with CPCB and must meet annual collection and recycling targets.
• Infrastructure projects: Roads, railways, ports, airports, power transmission lines, and pipelines above the threshold distances or capacities listed in the Schedule require EC before tendering or construction begins.

How It Actually Works

The approval path has two parallel tracks — the EC track through MoEFCC on PARIVESH 2.0, and the consent and authorisation track through State SPCBs and CPCB. The objective is running them in parallel without creating gaps or contradictions between the two document sets.

Step 1: Project Diagnostic & Approval Map

Share your project location, proposed activity, capacity, and land status. We identify every applicable clearance, flag forest proximity or protected-area buffer issues, check CGWA groundwater block classification, and map the full sequence with dependencies. Output: a one-page approval matrix and realistic end-to-end timeline. Completed in 5–7 working days.

Step 2: Pre-Feasibility Report & Terms of Reference

Prepare Form 1 and the Pre-Feasibility Report (PFR) and submit on PARIVESH 2.0. The Expert Appraisal Committee (EAC) or State-level SEAC scopes the study and issues Terms of Reference (ToR) — typically 60–90 days from submission. ToR defines exactly what your baseline monitoring must cover.

Step 3: Baseline Studies

NABL-accredited labs conduct monitoring for air quality, water, noise, soil, ecology, and socio-economic parameters. Four full seasons takes 12 months; EAC may permit one season with dispersion modelling for some project types. Your EIA consultant must appear on MoEFCC's accredited list — non-accredited consultants are rejected at Form 1 submission.

Step 4: EIA Report, EMP & Public Hearing

Baseline data goes into the Environmental Impact Assessment (EIA) Report and Environmental Management Plan (EMP). The SPCB advertises the public hearing 30 days in advance in local-language newspapers. The hearing is held at the project district; all minutes are incorporated into the final EIA submitted to EAC or SEAC.

Step 5: EAC/SEAC Appraisal & EC Grant

EAC or SEAC appraises the EIA Report and public hearing minutes, may issue one or more query rounds, and recommends EC. MoEFCC or SEIAA issues the Environmental Clearance order with conditions. Those EC conditions govern your construction schedule and operational life — review them in detail before the first piece of equipment moves onto site.

Step 6: CFE, HW Authorisation, EPR & CGWA in Parallel

From the ToR stage onwards, file CFE with the State SPCB, HW Authorisation application, EPR registration on the CPCB portal, and CGWA NOC application. This parallel track compresses total approval time by 6–12 months and ensures consent is ready to act on the day EC arrives.

Step 7: Construction, Commissioning & CFO

Construction begins after EC plus CFE. On commissioning, apply for Consent to Operate (CFO) from the SPCB. CFO marks the start of your operational compliance cycle — periodic monitoring, half-yearly compliance reports, and annual renewal obligations that continue for the life of the facility.

A Real Example: API Pharma Plant, Maharashtra

Consider a new Active Pharmaceutical Ingredient (API) manufacturing plant proposed at an MIDC plot in Taloja, Maharashtra — 50 tonnes per day bulk drug capacity. Here is what the approval stack looked like in practice.

• EC category: Category A under EIA Notification 2006 (pharma above 5 TPD bulk drug). MoEFCC plus EAC jurisdiction — no SEAC route available for this project type.
• CGWA: Taloja falls in a notified watershed. CGWA NOC was required before any borewell sinking, including for construction-phase water supply — a step many project teams skip.
• HW Authorisation: API manufacturing generates Category 28.1, 28.2, and 5.1 wastes (spent solvents, process residues). HW Authorisation from MPCB was mandatory alongside EC.
• Baseline shortcut: EAC granted a one-season baseline with modelling for this unit type. That decision saved nine months versus a full four-season monitoring programme.
• Public hearing: Held at Raigad Collectorate — 120 participants, 23 written objections. All objections addressed in the revised EIA; no delays to EAC appraisal resulted.
• Actual timeline: Form 1 to EC grant: 22 months. CFE issued in Month 14 (parallel track). HW Authorisation in Month 16. CGWA NOC in Month 10.

Construction started in Month 23 — the day after EC arrived. A competitor who started civil foundation work in Month 12 without EC received a closure notice from MPCB and an NGT order in Month 18, pushing their commissioning back by over two years.

What Compliance Looks Like After Grant

EC and CFO are not one-time events. Each clearance and consent carries a schedule of ongoing obligations — and missing them is treated by regulators as seriously as operating without the clearance in the first place.

• EC conditions: Half-yearly compliance reports (HCR) filed on PARIVESH 2.0 within 30 days of each half-year end. EC conditions include a milestone schedule for pollution control infrastructure — ETP commissioning, green belt planting, rainwater harvesting — each with a specific completion date.
• CFO compliance: Half-yearly compliance reports to the SPCB. Stack emission testing and ambient air quality monitoring at prescribed frequencies. Effluent analysis before each discharge cycle.
• HW Authorisation: Annual returns to SPCB by 30 June. Manifest-based tracking for every hazardous waste consignment dispatched to a TSDF, recycler, or co-processor — every movement must be documented.
• EPR targets: Annual EPR return on the CPCB portal. Meet your product category's collection and recycling or processing targets for the year. Shortfall attracts environmental compensation calculated on unmet quantities.
• CGWA obligations: Monthly groundwater level and extraction data submitted to CGWA. Annual report by 31 March. Rainwater harvesting infrastructure is typically a condition of the NOC.
• Renewal cycles: CFE and CFO are valid for five years in most States; HW Authorisation for one to five years. EC is valid for the project life but carries amendment obligations on expansion. An expired consent means operating without consent — the consequences are the same as having none.

An SPCB show-cause notice for consent non-compliance can halt your entire operation — not just the specific non-compliant unit. A current compliance calendar is not optional.

Where Projects Stall or Face Penalties

Most delays and enforcement actions are avoidable. These are the patterns that consistently cause timelines to slip or trigger regulatory proceedings.

• Construction before EC: Starting civil work — even foundation piling or borewell sinking — before EC is a violation under the EP Act 1986. The NGT has imposed penalties exceeding annual project turnover in documented cases. EC must arrive before the first piece of earth-moving equipment enters the site.
• Non-accredited EIA consultant: EIA consultants must appear on MoEFCC's accredited list. Using an unlisted firm means Form 1 is rejected at submission and your timeline resets to zero — the accreditation check is the first thing PARIVESH 2.0 validates.
• Non-NABL baseline data: EAC requires baseline monitoring data from NABL-accredited laboratories. A report using a non-NABL source is returned at appraisal — often 12 or more months into the process. The baseline must be redone entirely.
• CFE without EC reference: State SPCBs now require the EC application number or ToR reference before processing CFE. Filing without this reference adds processing time and creates mismatched document sets that surface later in the CFO stage.
• Defective public hearing procedure: The SPCB advertisement must appear 30 days before the hearing in a local-language newspaper for the correct district. A procedural error — wrong date, wrong newspaper, wrong district — voids the hearing. The process restarts from advertisement.
• Ignoring EC condition milestones: EC conditions specify completion dates for pollution control infrastructure. Missing those dates creates automatic non-compliance status on PARIVESH 2.0 even if your actual emissions are within permitted limits.
• Deferred EPR registration: Producers who skip CPCB EPR registration accumulate year-by-year liability on unmet targets. CPCB can withhold no-objections for expansion EC applications where EPR defaults are outstanding — it links the two systems.
• CGWA NOC for construction-phase water: Many projects assume that temporary construction borewells do not need CGWA clearance. In over-exploited or critical blocks, they do. A sealed borewell discovered during an MPCB site inspection can halt the entire construction schedule.
